March 5, 2015 – 7:00 p.m.
Regular Meeting
The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on
Thursday, March 5, 2015. Mayor Sanders led the invocation. Councilor Tanner led the Pledge
of Allegiance to the Flag of the United States of America.
Roll Call: Marie Turner, City Clerk, called roll of Pinson City Council with the following
council members present:
Mayor Sanders
Councilor Tanner
Councilor Cochran
Councilor Roberts
Councilor Churchwell
Councilor McCain
Minutes: Councilor Roberts made a motion to waive the reading of the February 5, 2015,
minutes. Councilor Cochran duly seconded the motion. Mayor Sanders called for all opposed to
say "no", all in favor say "aye." Councilor Cochran made a motion to accept the minutes as
written of the February 5, 2015, meeting. Councilor McCain duly seconded the motion. Mayor
Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all
opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect both motions
passed unanimously."
Councilor Roberts made a motion to waive the reading of the February 19, 2015, minutes.
Councilor Cochran duly seconded the motion. Mayor Sanders called for all opposed to say "no",
all in favor say "aye." Councilor Cochran made a motion to accept the minutes as written of the
February 19, 2015, meeting. Councilor Churchwell duly seconded the motion. Mayor Sanders
called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to
say "no", all in favor say "aye." Mayor Sanders "Let the record reflect both motions passed
unanimously."
Committee Chair Comments:
Finance: Councilor Tanner made a motion to approve payment of the bills in the amount of
$240,747.15; a copy of the bills schedule is attached. Councilor Cochran duly seconded the
motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders
called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect
that both motions passed unanimously."
Public Safety: Mayor Sanders thanked Councilors Cochran and Roberts for their help in
sanding the roads during the bad weather.
Enhancements: Councilor McCain mentioned there is an Enhancements meeting every Friday
at 2:00 p.m. at City Hall, to discuss the Bicentennial Celebration.
Education: Councilor Roberts stated the Board of Education is planning to extend the IB
School to include grades 6, 7, & 8 this coming fall. The deadline to apply is March 26, 2015.
Planning and Zoning: Mayor Sanders suspended rules for a public hearing on a post
annexation zoning case, regarding Lea Anne Gardens Sectors 2 lots and common area, along
with metes and bounds parcels. Mayor Sanders stated “Let the record reflect there was no one
present to speak for or against”.
Mayor Sanders reinstated rules.
Councilor Roberts offered an ordinance changing the zoning classification of real estate located
in the City of Pinson, Alabama, located at Lea Anne Gardens Sectors 2 lots and common area,
along with metes and bounds parcels, from Jefferson County zoning RG to City of Pinson zoning
RH. Councilor McCain duly seconded the motion. Mayor Sanders called for unanimous consent
to consider with the following results:
Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes;
Councilor Churchwell-yes; Councilor McCain-yes.
Mayor Sanders, unanimous consent passes.
Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for
a roll call vote on the main ordinance with the following results:
Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes;
Councilor Churchwell-yes; Councilor McCain-yes.
Mayor Sanders, ordinance passes unanimously as Ordinance 2015-9.
Mayor’s Report: Councilor Cochran offered a motion to purchase City of Pinson shirts for
Council and Staff in colors Light Stone and Cool Grey, and to add Councilmember/Mayor and
name under the seal at a cost of $1000.00. Councilor McCain duly seconded the motion. Mayor
Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all
opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion
passed unanimously."
Old Business: Councilor Cochran offered a resolution to contract with the Greater Birmingham
Humane Society for animal control and pound services. Councilor McCain duly seconded the
motion. Mayor Sanders called for any discussion. Councilor McCain stated this is not full time
only field time. Mayor Sanders stated that is correct, 9 hours of field service and kenneling per
month. Councilor Cochran stated this is required by the state. Mayor Sanders called for any
further discussion. As there was no further discussion, Mayor Sanders called for a roll call vote
on the main resolution with the following results:
Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes;
Councilor Churchwell-yes; Councilor McCain-yes.
Mayor Sanders, resolution passes unanimously as Resolution 15-16.
Councilor Cochran offered a resolution authorizing and directing the Mayor to execute a contract
for residential garbage collection pursuant to bids received on the 14th day of November 2014,
for residential trash removal services. Councilor Roberts duly seconded the motion. Mayor
Sanders stated the monthly fee will be $44.01. Mayor Sanders called for any discussion. As
there was no discussion, Mayor Sanders called for a roll call vote on the main resolution with the
following results:
Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes;
Councilor Churchwell-yes; Councilor McCain-yes.
Mayor Sanders, resolution passes unanimously as Resolution 15-17.
New Business: Councilor Roberts offered a resolution concerning the membership of the
Library Board of the City of Pinson, Alabama, reappointing Stanley Moss, Jane Montgomery, &
Patrick Coleman. Councilor Cochran duly seconded the motion. Mayor Sanders called for any
discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main
resolution with the following results:
Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes;
Councilor Churchwell-yes; Councilor McCain-yes.
Mayor Sanders, resolution passes unanimously as Resolution 15-18.
Councilor McCain offered a resolution authorizing and directing the Mayor to execute a deed
receiving certain greenspace property. Councilor Cochran duly seconded the motion. Mayor
Sanders stated this is property L & M offered to convey to us and is most likely undevelopable
with no access. Mayor Sanders called for any discussion. As there was no discussion, Mayor
Sanders called for a roll call vote on the main resolution with the following results:
Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes;
Councilor Churchwell-yes; Councilor McCain-yes.
Mayor Sanders, resolution passes unanimously as Resolution 15-19.
Public Comment: None.
Councilor Cochran moved to adjourn. Councilor Churchwell duly seconded the motion. Mayor
Sanders called for all opposed to say “no”, all in favor say “aye”. Motion carried.
