Council Minutes May 5, 2016 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on Thursday, May 5, 2016. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Roll Call: Marie Turner, City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Roberts Councilor McCain Absent: Councilor Cochran Councilor Churchwell Minutes: Councilor Roberts offered a motion to waive the reading of the April 21, 2016, minutes. Councilor McCain duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor McCain made a motion to accept the minutes as written of the April 21, 2016, meeting. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect both motions passed unanimously." Committee Chair Comments: Finance: Councilor Tanner made a motion to approve payment of the bills in the amount of $55,501.07; a copy of the bills schedule is attached. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. Councilor Tanner mentioned the $21,000.00 of the total bills is for our contracted Jefferson County Sheriff Deputies. Mayor Sanders called for any further discussion. As there was no further discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." Councilor Tanner made a motion authorizing payment to Alabama Power for utilities upgrade at PYSC in the amount of $5,576.70. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." Mayor Sanders mentioned there will be a Finance Committee meeting on May 12, 2016, at 6:30 p.m. to discuss the preliminary 2016/2017 Budget. Enhancements: Councilor McCain reminded everyone about May Movies in the Park. Councilor McCain offered a motion authorizing additional family events at the park in June and July with expenses needed of approximately $1,000.00. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." Mayor’s Report: Mayor Sanders opened a Public Hearing regarding changes to the zoning ordinance. Also, Post Annexation rezoning of properties located at 4240 Clayton Street; 6213 Kaley Lane; 3320 Sweeney Hollow Road; and 6100 Oak Lane. Mayor Sanders, “Let the record reflect no one was present to comment for or against”. Mayor Sanders closed the Public Hearing. Councilor McCain offered an ordinance changing the zoning classification of real estate located in the City of Pinson, Alabama, 4240 Clayton Street and 6213 Kaley Lane, from Jefferson County, R-6 & R-2 to City of Pinson RM. Councilor Tanner duly seconded the motion. Mayor Sanders called for unanimous consent to consider with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as Ordinance 2016-17. Councilor roberts offered an ordinance changing the zoning classification of real estate located in the City of Pinson, Alabama, 3320 Sweeney Hollow Road and 6100 Oak Lane, from Jefferson County, R-1 to City of Pinson RM. Councilor McCain duly seconded the motion. Mayor Sanders called for unanimous consent to consider with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as Ordinance 2016-18. Mayor Sanders reported the Celebration in the Park went very well with several hundred in attendance. Councilor McCain offered a motion authorizing additional parking for the Bicentennial Park. Councilor Tanner duly seconded the motion. Mayor Sanders explained Campbell’s Paving will gravel the parking spaces for now and pave the spaces in the fall. Mayor Sanders called for any further discussion. As there was no further discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." Councilor Tanner offered a motion to authorize extended rental of the backhoe and additional topsoil for the Bicentennial Park. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." Councilor Tanner offered a motion authorizing the purchase of additional fire safe cabinets at a cost of $2,885.00. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." Old Business: Councilor Roberts offered a motion approving the purchase of a copier at a cost of $6,092.00. Councilor Tanner duly seconded the motion. Councilor Roberts amended his motion to include eCopy Software with 5 licenses, 3 years of support, installation and training, at an additional cost of $2,032.00, total $8,124.00. Councilor Tanner accepted the amendment. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." New Business: Councilor Roberts offered an Ordinance authorizing the lease of certain real property to Daniel Buchanan, at a cost of $12.00/year. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for unanimous consent to consider: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as Ordinance 2016-21. Councilor Roberts offered an Ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, Parcels 13-1-1-1-10.000 and 13.001. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for unanimous consent to consider: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as Ordinance 2016-19. Councilor Roberts offered an ordinance concerning the voting place for municipal elections, to be located at the Rock School Center. Councilor Tanner duly seconded the motion. Mayor Sanders explained many polling sites in Jefferson County have been inspected by ADA and found to be out of compliance with ADA and ours was one of those. Mayor Sanders this ordinance also allows for up to $5,000.00 in repairs as needed. Mayor Sanders called for any further discussion. As there was no further discussion, Mayor Sanders called for unanimous consent to consider: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as Ordinance 2016-20. Mayor Sanders offered a first reading of a resolution to contract with the Greater Birmingham Humane Society for Animal Control and Pound Services. Public Comment: Deidra Ruff, 4055 Ruff Road, Pinson. Would like to create a Music Festival in the Park using various artist. Councilor Roberts moved to adjourn. Councilor McCain duly seconded the motion. Mayor Sanders called for all opposed to say “no”, all in favor say “aye”. Motion carried.
