Council Minutes July 7, 2016 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on Thursday, July 7, 2016. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Roll Call: Marie Turner, City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Cochran Councilor Roberts Councilor Churchwell Councilor McCain Minutes: Councilor Roberts offered a motion to waive the reading of the June 16, 2016, minutes. Councilor Cochran duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Cochran made a motion to accept the minutes as written of the June 16, 2016, meeting. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders" Let the record reflect both motions passed unanimously." Committee Chair Comments: Finance: Councilor Tanner made a motion to approve payment of the bills in the amount of $69,352.41; a copy of the bills schedule is attached. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. Councilor Tanner mentioned part of the total bills are Jefferson County Sheriff $21,000.00. Mayor Sanders mentioned the Pike’s Plumbing bill will be reimbursed by AT&T due to damage caused by AT&T. Mayor Sanders called for any further discussion. Enhancements: Councilor Cochran offered a motion to approve the purchase of a 20 ft. Sequoia Christmas tree at a cost of approximately $12,000.00. Councilor Churchwell duly seconded the motion. Mayor Sanders stated he will confirm the bulb size. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor McCain announced the following events planned at the Bicentennial Park in July: July 9th-DieDra and The Ruff Pro Band; July 15th-The Clay Boys; July 29th-Movie for Teens/God’s Not Dead or Woodlawn have been suggested; July 30th-PVHS Choir. Councilor McCain added all events will begin at 7:00 p.m., except the Movie which will begin at dark. Mayor Sanders asked council to review the proposed flyer for Senior Citizen Tuesdays, beginning on the 12th from 10:00 a.m.-1:00 p.m. Mayor Sanders stated the flyer is approved as presented. Mayors Report: Mayor Sanders reminded everyone of the Beat the Heat at Turkey Creek event scheduled for July 16, 2016. Mayor Sanders announced the National Night Out event for August 2, 2016 will be held at the Innsbrooke Pavilion adding this is a community event and everyone is invited, this is not a political event. Councilor Cochran offered a resolution authorizing the Mayor to purchase vehicles for use by the City of Pinson, 1-T191 new Dodge Ram Extended Cab Truck $20,901.00 for use at Turkey Creek Nature Preserve and 1-T191 new Dodge Ram Crew Cab with 4WD and extended bed $26,916.00 for use by the mowing crew. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. Mayor Sanders, resolution passes unanimously as Resolution 16-32 Councilor Cochran offered a motion to amend resolution 16-32 to specify “white” as the color of the trucks to be purchased. Mayor Sanders, “Let the record reflect the motion passed unanimously Councilor Cochran offered a resolution concerning surplus property-1998 Ram Truck. Councilor Roberts duly seconded the motion. Mayor Sanders stated the truck was conveyed to us from Jefferson County, adding it was 10 years old when conveyed to us and now needs the brakes repaired at a cost of approximately $1,000.00. Mayor Sanders called for any further discussion. As there was no further discussion, Mayor Sanders called for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, resolution passes unanimously as Resolution 16-33. Councilor Tanner offered a motion to authorize the repair of the concrete stairs at the PYSC Football Field, at a cost of $21,450.00. Councilor Cochran duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the motion with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, motion passes unanimously. Mayor Sanders stated the Notice of Election was posted on July 5, 2016, as required by law. Planning and Zoning: Ben Goldman, Attorney Hand Arendall explained the process for the abatement at 4169 Powell Avenue. Mayor Sanders opened the Public Hearing regarding the abatement of 4169 Powell Avenue. Mayor Sanders stated “Let the record reflect no one was present with an interest in the property located at 4169 Powell Avenue”. Mayor Sanders closed the Public Hearing. Mayor Sanders recognized Bob Jones, Zoning Administrator, City of Pinson. Mr. Jones stated the home burned 2 years ago and the initial complaint was received on November 7, 2014. Councilor Roberts asked if there had been any action taken by the owners, Mr. Jones replied, non that I can see. Councilor Roberts offered a resolution ordering the demolition of a building or structure located at 4169 Powell Avenue, Pinson, AL 35126, Parcel ID# 09 00 31 3 002 017.000, in compliance with Sections 11-40-30 through 11-40-36, Sections 11-53B-1 through 11-53B-16, inclusive, of the Code of Alabama, and in compliance with ordinance number 2016-16 of Pinson, Alabama; and calling for the city to cause said demolition to be performed and directing the City Attorney and the City Clerk to cause the cost of such demolition to be charged against the land on which the building or structure exists as a municipal lien or cause such cost to be recovered in a suit at law against the owner or owners. Mayor Sanders opened the Public Hearing regarding post annexation zoning classification on properties located at: 5620 Dewey Heights Road and 6084 Knob Knoster Road from Jefferson County A-1 to City of Pinson RR; 5041 Bearden Road and 6224 Emerald Forest Drive form Jefferson County A-1 & R-1 to City of Pinson RM. Mayor Sanders, “Let the record reflect no one was present to speak for either property”. Mayor Sander closed the Public Hearing. Councilor Cochran offered an ordinance changing the zoning classification of real estate located in the City of Pinson, Alabama, regarding 5041 Bearden Road and 6224 Emerald Forest Drive, from Jefferson County A-1 & R-1 to City of Pinson RM. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as Ordinance 2016-26. Councilor Churchwell offered an ordinance changing the zoning classification of real estate located in the City of Pinson, Alabama, regarding 5620 Dewey Heights Road & 6084 Knob Knoster Road, from Jefferson County A-1 to City of Pinson RR. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as Ordinance 2016-27. Old Business: None. New Business: Councilor Tanner offered a motion to move the July 21, 2016 meeting to Palmerdale Homesteads Community Center (PHCC), at 10:00 a.m. Councilor Cochran duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed say “no”, all in favor say “aye”. Mayor Sanders, “Let the record reflect the motion passed unanimously.” Councilor Churchwell offered a resolution appointing the City Clerk to perform the duties for holding a municipal election as required by State law. Councilor Cochran duly seconded the motion. Mayor Sanders stated we may need to appoint other uninterested persons if the Clerk needs help. Mayor Sanders called for any discussion. Mayor Sanders, resolution passes unanimously as Resolution 16-35. Mayor Sanders introduced Audrey Grant and Sandy Reeser with VC3 to give a presentation on Website hosting and computer services. Mr. Reeser gave council a visual presentation and explained the services VC3 offers to government offices. Public Comment: Charles Yeager, TCNP Resident Manager. Mr. Yeager thanked council for the purchase of the new truck adding it is vital to his job. Mr. Yeager announced some events upcoming-Float your Boat-July 16, 2016; Darter Dash-July 30, 2016; TCNP Un-tournament Fishing Tournament-September 4, 2016. Karen Hutchinson, President of Friends of Turkey Creek. Ms. Hutchinson mentioned volunteers are needed and announced a Build your Boat event on July 10, 2016, at 1:00 p.m. April Wallace, Library Director. Mrs. Wallace gave a report on the Summer Reading program and some of the events that have been held. Andrea McTyer, 6115 Edgefield Lane. Requested more lighting on Highway 75. Mayor Sanders stated we have made that request to ALDOT in the past but will request lighting once again. Connie Branham, Cobblestone Court. Mr. Branham asked that the traffic lights at Main Street and Pinson Boulevard be adjusted because they are holding too long. Mayor Sanders stated we have made that request to ALDOT as well and will be glad to contact them once again. Shane Shelnutt, 7961 Happy Hollow Road, Trussville. Mr. Shelnutt explained he had served on Pinson City Council until 2012, and wanted to publicly apologize to the citizens and the council members for his behavior and wanted to wish the best for the City of Pinson. Mike Sullivan, Park and Recreations Director. Mr. Sullivan gave a report on PYSC and Bicentennial Parks. Shannon Galamore, 4400William Way. Mrs. Galamore thanked council for the purchase of the new Cheerleading mats. Bill Dooley, 8211 Brookwood Road. Mr. Dooley thanked Mr. Shelnutt for his apology and offered his prayers for the loss of his Father. Councilor Cochran moved to adjourn. Councilor Churchwell duly seconded the motion.
