Council Minutes November 21, 2016 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on Monday, November 21, 2016. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Mayor Sanders appointed Anje May, Acting City Clerk. Roll Call: Anje May, Acting City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Roberts Councilor Churchwell Councilor McCain Absent: Councilor Galamore Special Recognition (During Pre-Council): Councilor Tanner offered a resolution in recognition of the 2016 Rudd Middle School Boys Track Team and their exceptional season, winning the Jefferson County Championship. Councilor Churchwell duly seconded the motion. Mayor Sanders called for any discussion. After some discussion, Mayor Sanders called for a roll call vote with the following results: Mayor Sanders- yes; Councilor Tanner- yes; Councilor Roberts- yes; Councilor Churchwell- yes; Councilor McCain- yes. Mayor Sanders, resolution passes unanimously as Resolution 16-59. Councilor Roberts offered a resolution in recognition of the Charlotte Phillips and her exceptional season, winning the individual girls Jefferson County Championship. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. After some discussion, Mayor Sanders called for a roll call vote with the following results: Mayor Sanders- yes; Councilor Tanner- yes; Councilor Roberts- yes; Councilor Churchwell- yes; Councilor McCain- yes. Mayor Sanders, resolution passes unanimously as Resolution 16-60. Minutes: Councilor Roberts offered a motion to waive the reading of the November 7, 2016, minutes. Councilor Churchwell duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Roberts made a motion to accept the minutes as written of the November 7, 2016, meeting. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect both motions passed unanimously." Councilor Roberts offered a motion to waive the reading of the November 3, 2016, minutes. Councilor McCain duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor McCain made a motion to accept the minutes as written of the November 3, 2016, meeting. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect both motions passed unanimously." Committee Chair Comments: Finance: Councilor Tanner made a motion to approve payment of the bills in the amount of $25,774.48; a copy of the bills schedule is attached. Councilor Churchwell duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." Annexations: Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, located at 4165 Pinson Boulevard and Old Sweeney Hollow Road. Councilor McCain duly seconded the motion. Mayor Sanders called for unanimous consent to consider: Mayor Sanders- yes; Councilor Tanner- yes; Councilor Roberts- yes; Councilor Churchwell- yes; Councilor McCain- yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders- yes; Councilor Tanner- yes; Councilor Roberts- yes; Councilor Churchwell- yes; Councilor McCain- yes. Mayor Sanders, ordinance passes unanimously as, Ordinance 2016-33. Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, located at 5641 Miles Spring Road. Councilor McCain duly seconded the motion. Mayor Sanders called for unanimous consent to consider: Mayor Sanders- yes; Councilor Tanner- yes; Councilor Roberts- yes; Councilor Churchwell- yes; Councilor McCain- yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders- yes; Councilor Tanner- yes; Councilor Roberts- yes; Councilor Churchwell- yes; Councilor McCain- yes. Mayor Sanders, ordinance passes unanimously as, Ordinance 2016-34. Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, located at 5856 Willow Ridge Road and Pendleton Road. Councilor Roberts duly seconded the motion. Mayor Sanders called for unanimous consent to consider: Mayor Sanders- yes; Councilor Tanner- yes; Councilor Roberts- yes; Councilor Churchwell- yes; Councilor McCain- yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders- yes; Councilor Tanner- yes; Councilor Roberts- yes; Councilor Churchwell- yes; Councilor McCain- yes. Mayor Sanders, ordinance passes unanimously as, Ordinance 2016-35. Enhancements: Councilor McCain stated the Veterans Luncheon was a success. Councilor McCain stated there were over 180 in attendance. Councilor McCain stated there were over 10 volunteers from PVHS helping. Mayor’s Report: Mayor Sanders stated he would appoint Councilor Tanner to Finance Committee, Councilor McCain to Enhancements Committee, Councilor Churchwell to Annexation Committee, Councilor Galamore would assist the Mayor with the Education Committee and Councilor Roberts as library liaison and would assist Mayor with Public Safety Committee and was Mayor Pro-Tem. Mayor Sanders stated that several of the non-seasonal produce sellers from the Farmers Market would like to continue on Fridays until 5 p.m. until the cold weather sets in. Councilor Tanner stated she thought it would be a great idea. Mayor Sanders “no objection voiced”. Mayor Sanders announced Tuesday, November 22 there will be a Planning and Zoning meeting to discuss the changes of the Master Plan. Mayor Sanders suspended rules to allow council to discuss several items with Eric Winfrey, Mowing Crew Leader. Mayor Sanders asked council to go by Bicentennial Park and look at the place picked out for the Christmas tree. Mayor Sanders stated it was marked with a red X. Mayor Sanders stated he and Eric would be meeting in January to talk about the ROW and would bring a report back to council. Mayor Sanders reinstated rules. Councilor Roberts gave a report on his trip to Pittsburg and NLC. Councilor Roberts stated that he would email council information on “See, Click, Fix”. Councilor Roberts stated he thinks it will be a great thing for city. Councilor McCain made a motion to pay expenses for the Alabama League of Municipalities Conference in Birmingham in May 2017. Councilor Churchwell duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." Councilor Churchwell announced the National League of Cities will be in Charlotte, NC in 2017. Old Business: None New Business: None Public Comment: Pat Wise, 4161 Main Street, announced the senior citizen day is next Tuesday, November 25, at the community center from 10-12 a.m. Councilor McCain offered a motion to enter executive session to discuss real estate. Councilor Roberts duly seconded the motion. Mayor Sanders called for all opposed say “no”, all in favor say “aye”. Mayor Sanders, “Let the record reflect the motion passed unanimously. Mayor Sanders stated we will not reconvene other than to adjourn. Mayor Sanders called council out of executive session. Councilor Churchwell moved to adjourn. Councilor Tanner duly seconded the motion. Mayor Sanders called for all opposed to say “no”, all in favor say “aye”. Motion carried.
