Council Minutes May 4, 2017 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on Thursday, May 4, 2017. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Roll Call: Anje May, Acting City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Galamore Councilor Churchwell Councilor McCain Absent: Councilor Roberts Minutes: Councilor Churchwell offered a motion to waive the reading of the April 7, 2017, minutes. Councilor McCain duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor McCain made a motion to accept the minutes as written of the April 7, 2017, meeting. Councilor Churchwell duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders" Let the record reflect both motions passed unanimously." Committee Chair Comments: Finance: Councilor Tanner made a motion to approve payment of the bills in the amount of $73,699.75; a copy of the bills schedule is attached. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders stated Gray Lancaster’s family has received $1,000.00 in donation which they are presenting to the City to fund two benches to be placed in the Bicentennial Park in Grey’s memory. Councilor McCain offered a motion to accept a donation from the Lancaster Family for benches to be placed in Bicentennial Park in Grey Lancaster’s memory. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." Mayor Sanders offered a first reading on the 2017/2018 Budget for the City of Pinson. Enhancements: Councilor McCain mentioned the movie scheduled for May 12th has been postponed until June 2nd due to the threat of bad weather. Mayor Sanders mentioned Cityfest was well attended with approximately 600 wristbands for rides given out. Councilor Churchwell stated it was a well-attended event with approximately 2,500 in attendance. Mike Sullivan, Park Director, gave the Park report. Allison Scanlan, Library Director, gave the Library report. Mayor’s Report: Mayor Sanders stated Silver Lake Circle was originally designated to be a gated area but it was never installed. Mayor Sanders added the road was completed when the houses on that road where finished but now needs maintenance. Mayor Sanders asked Attorney Black to explain the procedure for maintaining the road should council vote to do so. Attorney Black explained that in the dedication of a Private road, all owners must sign the dedication paperwork. Attorney Black added there will also be title work involved. Mayor Sanders asked for an estimate for this procedure. Attorney Black state the title work would be approximately $1,600.00. Councilor Churchwell stated everything was done correct by the developer. Councilor Tanner mentioned she is not opposed but would like the owners to reimburse the city for any charges incurred. Attorney Black stated Council may offer that as a condition. Mayor Sanders asked Attorney Black to prepare a letter to the owners explaining the process. Old Business: Councilor Tanner offered a resolution of the City Council of Pinson, Alabama, approving the contract for Architectural services in regards to the design and construction of the First Responder Saferoom. Councilor Churchwell duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders- yes; Councilor Tanner- yes; Councilor Galamore- yes; Councilor Churchwell- yes; Councilor McCain- yes. Mayor Sanders, resolution passes unanimously as, Resolution 17-27. New Business: Councilor Churchwell offered a motion renaming the Mowing Crew Department and designating it as the Public Works Department. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." Public Comment: James Hyche, 5900 Block of Miles Spring Road. Thanked council for putting a walking area at Triangle Park. Wayne Hyche, 5900 Block of Miles spring Road. Regarding the 1st responders shelter, originally it was said it would be a 99-person capacity and it was just passed as a 50-person capacity, why has it changed. Mayor Sanders stated it was not stated as a 50 person capacity in the motion, it has always been and will be a 99 person capacity with 1st responders having 1st priority. James Hyche, 5900 Block of Miles Spring Road. Asked Attorney Black to check the law on the ADA requirements. Mr. Hyche stated 1st priority is for elderly and handicapped. Mayor Sanders stated that is not the wording of the Federal grant. Deidra Ruff, 4055 Ruff Road. Asked if there is a date set for the Ruff Pro Band to perform at Bicentennial Park at this time. Councilor McCain stated not at this time. Mrs. Ruff stated she would put it on her calendar tentatively for June 3rd. Councilor Churchwell offered a motion to enter executive session to discuss trade and commerce and litigation. Councilor McCain duly seconded the motion. Attorney Black, I provide certification in regard to Litigation it would be detrimental if items were discussed in open forum. Mayor Sanders, I provide certification in regard to Trade and Commerce it would be detrimental if items were discussed in open forum. Mayor Sanders called for all opposed say “no”, all in favor say “aye”. Mayor Sanders, “Let the record reflect the motion passed unanimously. Mayor Sanders stated we will not reconvene other than to adjourn. Mayor Sanders called council out of executive session. Councilor McCain moved to adjourn. Councilor Tanner duly seconded the motion.
