Council Minutes November 2, 2017 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on Thursday, November 2, 2017. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Roll Call: Marie Turner, City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Galamore Councilor Roberts Councilor Churchwell Councilor McCain Minutes: Councilor Roberts offered a motion to waive the reading of the October 19, 2017, minutes. Councilor McCain duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Churchwell made a motion to accept the minutes as written of the October 19, 2017, meeting. Councilor Galamore duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders" Let the record reflect both motions passed unanimously." Pre-meeting comments: Representative Allen Treadaway spoke to council reminding them to contact him with any concerns. Murk McKee gave a report on the city owned building located on Spring Street. Mr. McKee stated that the building is in irreparable condition. Councilor Tanner asked Mr. McKee for clarification purposes, did he recommend that the building be torn down. Mr. McKee replied that is his recommendation. Mayor Sanders stated he had someone express interest in purchasing to disassemble and move the building, adding he would contact them again to see if they are still interested. Councilor Roberts asked if the Historical Society had been told. Mayor Sanders replied he will contact Stanley Moss to let him know. Mayor Sanders reinstated rules. Committee Chair Comments: Finance: Councilor Tanner made a motion to approve payment of the bills in the amount of $127,756.94 a copy of the bills schedule is attached. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." Education: Mayor Sanders mentioned the Education Committee will meet on Monday, November 6, in Council Chambers. Annexation: Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, located at 5649 Red Hollow Road. Councilor Roberts duly seconded the motion. Mayor Sanders called for unanimous consent to consider: Mayor Sanders- yes; Councilor Tanner-yes; Councilor Galamore- yes; Councilor Roberts- yes; Councilor Churchwell- yes; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders- yes; Councilor Tanner-yes; Councilor Galamore- yes; Councilor Roberts- yes; Councilor Churchwell- yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as, Ordinance 2017-34. Enhancements: Councilor McCain announced the Veterans Day Luncheon will be held November 10, 2017 at the Rock School Center beginning at 11:30, with the Kool Kats Band entertaining. Mayor Sanders mentioned PVHS begins the 1st round of play-offs against Florence on Friday, come support our schools. Mayor’s Report: Mayor Sanders opened a Public Hearing regarding properties located at 5675 Red Hollow Road; 5671 Red Hollow Road; and 4730; 4660; 4662; 4664; 4666; 4668 Elfreth Johnson Road. Mayor Sanders stated No one was present to speak for or against Mayor Sanders closed the Public Hearing. Councilor McCain offered an ordinance changing the zoning classification of real estate located in the City of Pinson, Alabama, 5675 and 5671 Red Hollow Road and 4730 Elfreth Johnson Road, from Jefferson County RR to City of Pinson AG. Councilor Galamore duly seconded the motion. Mayor Sanders called for unanimous consent to consider. Councilor Galamore offered an ordinance changing the zoning classification of real estate located in the City of Pinson, Alabama, 4660; 4662; 4664; 4666; and 4668 Elfreth Johnson Road, from Jefferson County U1 to City of Pinson RH. Councilor McCain duly seconded the motion. Mayor Sanders called for unanimous consent to consider. Mayor Sanders, ordinance passes unanimously as, Ordinance 2017-36. Old Business: Attorney Black spoke regarding the Garbage Contract bid. Councilor Roberts offered a resolution authorizing and directing the Mayor to advertise for bids for residential garbage collection services. Councilor Churchwell duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Galamore-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, resolution passes unanimously as, Resolution 17-54. New Business: Councilor Roberts offered a resolution authorizing the Mayor to enter into an amendment to the contract for enhanced law enforcement services between the City of Pinson and the Sheriff of Jefferson County. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. After brief discussion, Mayor Sanders called for a roll call vote with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Galamore-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, resolution passes as, Resolution 17-55 Public Comment: James Hyche, 5900 Block of Miles Spring Road. Mr. Hyche asked if the handicap and disabled are welcome at all City of Pinson facilities. Wayne Hyche, 5900 Block of Miles Spring Road. Stated he had been denied entrance at PHCC by Mr. Screws and Mr. Justin. Councilor Tanner offered a motion to enter executive session to discuss real estate, trade and commerce and litigation. Councilor Churchwell duly seconded the motion. Attorney Black, I provide certification in regard to Litigation it would be detrimental if items were discussed in open forum.
