Council Minutes May 2, 2019 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on Thursday, May 2, 2019. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Roll Call: Marie Turner, City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Galamore Councilor Roberts Councilor Churchwell Councilor McCain Minutes: Councilor Roberts offered a motion to waive the reading of the April 18, 2019, minutes. Councilor Churchwell duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Churchwell made a motion to accept the minutes as written of the April 18, 2019, meeting. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders" Let the record reflect both motions passed unanimously". Pre-meeting comment: Mike Sullivan, Park and Recreation Director announced he will be leaving the city on, May 10th. Mr. Sullivan added his appreciation for the opportunity serving the city as Park and Recreation Director. Matt Nixon, Assistant Park Director, will be taking care of Mr. Sullivan’s responsibilities in his absence. Committee Chair Comments: Councilor Tanner offered a motion to pay the bills in the amount of 49,022.54, a copy of the bills schedule is attached. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Annexation: Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, located at 6268 Spraul Avenue, owner Shelly L. Bryant. Councilor Galamore duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Galamore-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as, Ordinance 2019-10. Enhancements: Mayor Sanders stated CityFest was be held, April 27, 2019, at Bicentennial Park. Mayor Sanders added there were 520 arm bands given out for the free rides for the children. Councilor Churchwell mentioned it was the city’s 15th birthday. Councilor McCain mentioned Movies in the Park will begin, May 3, 2019, with the following movies to be shown: May 3rd -Grinch; May 10th – Ralph breaks the Internet; May 17th – Mary Poppins Returns. All movies will be shown at Bicentennial Park beginning at dusk. Mayor Sanders mentioned the Shred-a-thon is, Saturday, May 4th; Beat the Heat at Turkey Creek will be held, July 20th; and the date for National Night Out is August 6th and this year will be held at Bicentennial Park. Mayor’s Report: Mayor Sanders stated after discussion with council, the July 4th, 2019 council meeting will be rescheduled for, July 3, 2019, at 2:00 p.m. Councilor Galamore offered a motion approving a quote from Hinkle Roofing for gutters at Bicentennial Park, at a cost of $3,240.00. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. After brief discussion, Mayor Sanders called for all opposed to say “no”, all in favor to say “aye.” Mayor Sanders, “Let the record reflect the motion passed unanimously”. Old Business: None. New Business: Attorney Black explained a resolution the city received from ALDOT. Councilor Churchwell offered a resolution to cooperate with ALDOT on planned improvements being made on AL Highway 75. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Galamore-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, resolution passes unanimously as, Resolution 19-20. Councilor Tanner offered an ordinance regarding the removal of a structure located at 4422 Main Street. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. Councilor Roberts asked if the structure was not repairable? Mayor Sanders replied, no, but we may be able to save some of the rock on the front of the home for signage at the Rock School. Councilor Galamore asked if there was anything of historical value inside? Mayor Sanders replied, no. Councilor Churchwell stated this home was Betty Mullins old Home place. Mayor Sanders called for any further discussion. As there was no further discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Galamore-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as, Ordinance 2019-11. Attorney Black asked that council make a motion to allow him to review and modify as needed the ALDOT resolution to be sure it is the same as before. Councilor Churchwell offered a motion to authorize Attorney Shane Black to review, amend and attach other documents of clarification as needed. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders call for all opposed say “no”, all in favor say “aye.” Mayor Sanders, “Let the record reflect the motion passed unanimously.” Eric Winfrey, Public Works Director, gave the public works report. Allison Scanlan, Library Director, gave the Library report. Public Comment: Chief Gene Coleman, Center Point Fire District, gave a report on the Center Point Fire District. Wayne Hyche, 5900 Block of Miles Spring Road, Asked about crosswalks at Winn Dixie for the handicapped. Mayor Sanders suggested Mr. Hyche contact S.E. Groceries as that is on private property. Councilor McCain offered a motion to enter executive session to discuss real estate, trade & commerce & litigation. Councilor Galamore duly seconded the motion. Attorney Black, I provide certification in regard to litigation it would be detrimental if items were discussed in open forum. Mayor Sanders stated we will not reconvene other than to adjourn. Mayor Sanders released the City Clerk and appointed Councilor Tanner as acting clerk. Mayor Sanders called council out of executive session. Councilor Galamore moved to adjourn. Councilor Tanner duly seconded the motion.
