Council Minutes November 7, 2019 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on Thursday, November 7, 2019. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Roll Call: Marie Turner, City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Galamore Councilor Roberts Councilor Churchwell Councilor McCain Minutes: Councilor Roberts offered a motion to waive the reading of the October 17, 2019, minutes. Councilor Churchwell duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Churchwell made a motion to accept the minutes as written of the October 17, 2019, meeting. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders" Let the record reflect both motions passed unanimously". Committee Chair Comments: Councilor Tanner offered a motion to pay the bills in the amount of 132,912.01, a copy of the bills schedule is attached. Councilor Galamore duly seconded the motion. Mayor Sanders called for any discussion. Councilor Tanner mentioned a portion of the total was for the City Biannual Insurance; Alarm at Rock School; and PYSC Sound System. Mayor Sanders called for any further discussion. As there was no further discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." Education: Mayor Sanders mentioned the upcoming Play-off game Round 1, PVHS vs Homewood, at PVHS, November 8th. Enhancements: Councilor McCain announced the Veterans Day Luncheon will be held, November 11, 2019, beginning at 11:30 a.m. at the Rock School Center Auditorium, with the Kool Kats performing. Councilor McCain added, Olive Garden will be catering this event. Councilor McCain announced the Christmas Parade will be held on Saturday, December 7, 2019, at 10:00 a.m. Councilor McCain added the Christmas Tree lighting will possibly be held on Saturday or Sunday afternoon, December 7th or 8th, we will announce the time and date soon. Councilor McCain offered a motion nominating Raisa Eady, for Grand Marshal of the 2019 Christmas Parade. Adding, Ms. Eady is a biology teacher at Pinson Valley High School who received the Milken National Educator Award. Councilor Galamore duly seconded the motion. Mayor Sanders" Let the record reflect the motion passed unanimously". Mayors Report: Mayor Sanders announced Taco Bell has purchased the old Hardee’s building. Mayor Sanders added, Taco Bell plans to demolish and raise the building which will be like the Clay Taco Bell when finished. Mayor Sanders stated this will be very beneficial to the city because Texaco & the current Taco Bell location is not in the City limits and once Taco Bell moves to their new location, they will be in the city limits. Mayor Sanders added, as you will remember the PAC Group was instrumental in getting McDonald’s annexed earlier this year, which only leaves Texaco, the current location of Taco Bell and the Shell Station on Highway 79 not within the incorporated City limits. Mayor Sanders stated the plans are to be in the new location by the first of the year. Mayor Sanders suspended rules and opened a Public Hearing regarding an Abatement of property located at 4233 Walnut Street and Post annexation rezoning of property located at 6807 Briarwood Drive and 5171 Briarwood Circle. Mayor Sanders, “Let the record reflect there was no one present to speak for or against either case”. Bob Jones, Zoning Administrator, stated the property at 4233 Walnut Street has made some improvement, but there is still a large pile of wood and 2 nonconforming vehicles on the property. Mr. Jones added, he has not had a lot of contact with the owner. Mayor Sanders stated we will have Attorney Black follow up with a letter to the owner. Mayor Sanders reinstated rules. Councilor McCain offered an ordinance changing the zoning classification of real estate located in the City of Pinson, Alabama, 6807 Briarwood Drive and 5171 Briarwood Circle, from Jefferson County A1 to City of Pinson RM. Councilor Galamore duly seconded the motion. Mayor Sanders called for unanimous consent to consider. Councilor Tanner offered a motion to change the December 19, 2019, council meeting to be held at 1:00 p.m. at the Palmerdale Homesteads Community Center. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Old Business: Councilor Churchwell offered an ordinance regarding granting an electric franchise to Alabama Power, ITS Successors and Assigns in the City of Pinson, Alabama. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Galamore-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as, Ordinance 2019-19. New Business: Councilor Tanner offered an amendment to a motion she offered at the October 17, 2019, council meeting, regarding a request of $10,500 for the PVHS Baseball team, stating the full amount of $10,500 will go to help pay for new uniforms due to additional players. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Tanner offered a motion to approve assistance for PVHS Wrestling team in the amount of $4,000.00, for new uniforms; and PVHS Track team in the amount of $4,000.00 for various items. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. Mayor Sanders, motion passes unanimously. Councilor Tanner offered a first reading regarding window shades for the Event Center. Councilor McCain stated she has found someone to do the Angel Murals and will have him do a rough draft and get back with council. Councilor Roberts offered a motion approving attendance for council at the ALM Grant Seminar at a cost of less than $1,000. Mayor Sanders congratulated Councilor Dawn Tanner for her achievement of Emeritus status with the Alabama League of Municipalities. Allison Scanlan, Library Director, gave the Library report. Chief Gene Coleman, Center Point Fire District, gave the Fire District report. Public Comment: None. Councilor McCain offered a motion to enter executive session to discuss litigation, trade and commerce and real estate. Councilor Roberts duly seconded the motion.
