Council Minutes August 6, 2020 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street, on Thursday, August 6, 2020. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Roll Call: Marie Turner, City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Roberts Councilor Churchwell Absent: Councilor McCain Mayor Sanders suspended rules. Chief Gene Coleman, Center Point fire district, gave the fire district report. Mayor Sanders reinstated rules. Minutes: Councilor Roberts offered a motion to waive the reading of the July 16, 2020, minutes. Councilor Churchwell duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Churchwell made a motion to accept the minutes as written of the July 16, 2020. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders" Let the record reflect both motions passed unanimously". Committee Chair Comments: Finance: Councilor Tanner offered a motion to pay the bills in the amount of $77,246.15, a copy of the bills schedule is attached. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." Mayor’s Report: Mayor Sanders suspended rules. Mayor Sanders opened the Public Hearing regarding zoning at 8662 & 8642 Woodview Lane. Mayor Sanders stated there was no one present to speak for or against any of the other properties. Mayor Sanders reinstated rules. Councilor Roberts offered an ordinance changing the zoning classification of real estate located in the City of Pinson, Alabama, 8662 & 8642 Woodview Lane. Councilor Tanner duly seconded the motion. Mayor Sanders asked for unanimous consent to consider. Mayor Sanders-yes; Councilor Tanner-yes, Councilor Galamore-yes; Councilor Roberts-yes; Councilor Churchwell-yes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders, asked for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes, Councilor Galamore-yes; Councilor Roberts-yes; Councilor Churchwell-yes. Mayor Sanders, ordinance passes unanimously as, Ordinance 2020-13. Mayor Sanders updated council on the following properties: 4719 Brookcrest-completed; 6833 Brittany Place-moved; 4284 VFW Rd-process has begun by the attorney; 4018 St. John Way has transitioned to an unsafe structure. Councilor Roberts offered a resolution declaring a public nuisance relating to overgrown grass/weeds at 7338 Plantation Road. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders asked for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes, Councilor Galamore-yes; Councilor Roberts-yes; Councilor Churchwell-yes. Mayor Sanders, resolution passes unanimously as, Resolution 20-29. Attorney Black explained that state law gives municipalities the ability to take care of unsafe structures within the city. Attorney Black explained the process for declaring an unsafe structure, adding 7338 Plantation Rd., 3721 Fitzgerald Mountain Rd., and 4018 St. John Way, are all unsafe structures. Old Business: Councilor Roberts offered an ordinance concerning the abatement of litter and junk public nuisances. Councilor Churchwell duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders asked for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes, Councilor Galamore-yes; Councilor Roberts-yes; Councilor Churchwell-yes. Mayor Sanders, ordinance passes unanimously as, Ordinance 2020-14. Councilor Roberts spoke regarding floodplain properties within the city limits and what can and cannot be done in those areas. Councilor Churchwell offered a resolution authorizing the Mayor to enter into a contract for the infrastructure installation as part of the Turkey Creek Nature Preserve Pavilion project, at a cost of $21,000.00. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. Councilor Churchwell offered an ordinance authorizing the city’s exchange of certain real property located at 3104 and 3108 Sweeney Hollow Circle for property located in the Turkey Creek nature preserve. Councilor Roberts duly seconded the motion. Mayor Sanders asked for unanimous consent to consider. New Business: Councilor Churchwell offered a motion to approve a quote for restriping the parking lot at Pinson Elementary School, at a cost of $1650.00. Councilor Tanner duly seconded the motion. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders asked for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-abstain, Councilor Roberts-yes; Councilor Churchwell- yes. Mayor Sanders, resolution passes unanimously as, Resolution 20-31. Councilor Churchwell offered a resolution electing the office of Councilor-Place 2 without opposition, Michael Brad Walker. Councilor Roberts duly seconded the motion. Councilor Roberts offered a resolution electing the office of Councilor-Place 4 without opposition, John Churchwell, Jr. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders asked for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes, Councilor Roberts-yes; Councilor Churchwell- abstain. Councilor Churchwell offered a resolution appointing the City Clerk to perform the duties for holding a municipal election as required by state law. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. Councilor Churchwell offered a resolution setting the compensation for election officers for the 2020 municipal elections and for any related run-off election. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. Mayor Sanders, resolution passes unanimously as, Resolution 20-36. Councilor Churchwell offered a resolution appointing election officials for Pinson’s 2020 election cycle. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders asked for a roll call vote on the main resolution with the following results: Mayor Sanders-abstain; Councilor Tanner-yes, Councilor Roberts-yes; Councilor Churchwell- yes. Mayor Sanders, resolution passes unanimously as, Resolution 20-37. Councilor Churchwell offered a resolution appointing Brad Walker to the Pinson City Council. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. Councilors Tanner and Roberts offered congratulations to Mr. Walker. Mayor Sanders stated Mr. Walker will be seated in Council Place 2 to replace Ms. Galamore’s remaining time on council. Mayor Sanders called for any further discussion. As there was no further discussion, Mayor Sanders asked for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes, Councilor Roberts-yes; Councilor Churchwell-yes. Mayor Sanders, resolution passes unanimously as, Resolution 20-38. Attorney Black swore in Brad Walker. Councilor Tanner offered a first reading of a request for backpack misters and social distancing decals for the schools, at a cost of approximately $1,800.00. Chief Jason Howell, Palmerdale Fire District, gave the fir district report. Councilor Tanner offered congratulations to Attorney Black and Attorney Goldman as they were awarded a Hometown Hero award at the Alabama League of Municipalities. Councilor Tanner offered a motion to enter executive session to discuss trade and commerce and litigation. Councilor Roberts duly seconded the motion.
