Council Minutes September 1, 2020 – 12:00 p.m. Canvass & Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street, on Tuesday, September 1, 2020. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Roll Call: Marie Turner, City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Walker Councilor Roberts Councilor Churchwell Councilor McCain Minutes: Councilor Roberts offered a motion to waive the reading of the August 20, 2020, minutes. Councilor Churchwell duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Churchwell made a motion to accept the minutes as written of the August 20, 2020. Councilor Walker duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders" Let the record reflect both motions passed unanimously". The City Clerk mentioned that we had 8 Provisional Ballots from the August 25, 2020 election, of which 2 are to be counted as verified and approved by the Jefferson County Board of Registrar’s office. The City Clerk opened the Provisional Ballots of which the results in the Mayoral race were: 2 additional votes for Richard “Joe” Cochran and 0 additional votes for Hoyt Sanders. The results in the Council Place 5 race were: 1 additional vote for Glenda R. Kirkland and 0 additional votes for Durvatheheir Chris Esquire. Councilor Roberts offered a resolution for canvassing Election results for Mayor. The results of the election were as follows: Richard “Joe” Cochran – 433; Hoyt Sanders – 389. Richard “Joe” Cochran received the majority of the votes for Mayor and is duly elected to that office for the term beginning on November 2, 2020. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main resolution with the following results: Mayor Sanders-abstain; Councilor Tanner-yes; Councilor Walker-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, resolution adopted, as Resolution number 20-15. Councilor Roberts offered a resolution for canvassing Election results for Council Place No. 5. The results of the election were as follows: Durvatheheir Chris Esquire – 218; Glenda R. Kirkland – 538. Glenda R. Kirkland received the majority of the votes for Council Place No. 5 and is duly elected to that office for the term beginning on November 2, 2020. Councilor Walker duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main resolution with the following results: Mayor Sanders-abstain; Councilor Tanner-yes; Councilor Walker-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, resolution adopted, as Resolution number 20-16. Committee Chair Comments: Finance: Councilor Tanner offered a motion to pay the bills in the amount of $51,745.68, a copy of the bills schedule is attached. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Enhancements: Councilor McCain offered a motion to approve $5,000.00, for Veterans Day, which will be a Drive-Thru/Pick up lunch and an umbrella as a gift. Councilor Tanner duly seconded the motion. Mayor’s Report: Mayor Sanders mentioned there will be possibly 2 vacancies on the Planning Commission and asked if anyone is interested to please advise Mr. Jones. Old Business: Mayor Sanders stated the Flock cameras have been installed. Mayor Sanders added Bob Jones will have access to the feed and our Deputies will get alerts as well. Councilor Churchwell offered an ordinance authorizing the lease of certain real property to Birmingham-Southern College. Councilor McCain duly seconded the motion. Mayor Sanders called for unanimous consent to consider. Mayor Sanders-yes; Councilor Tanner-yes; Councilor Walker-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, unanimously consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Walker-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as, Ordinance 2020-40 Councilor McCain offered a resolution authorizing the demolition of a nuisance at 4229-4269 Main Street, with a quote in the amount of $17,640.00. Councilor Churchwell duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Walker-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, resolution passes unanimously as, Resolution 20-17. Councilor Roberts offered a motion to request a ABBF COVID Plan from Clay Pinson Chamber of Commerce to be submitted to the Jefferson County Health Department and to the City of Pinson for review, which will allow us to add to the plan as needed. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. After brief discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders" Let the record reflect the motion passed unanimously". New Business: Councilor Tanner offered a motion approving repairs to the Amphitheater, in the amount of $22,400.00. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. After brief discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Tanner offered a resolution authorizing the Mayor to execute a lease for property at 4182 Powell Avenue, 6 months @ $750.00/month. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Walker-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, resolution passes unanimously as, Resolution 20-18. Councilor Walker offered a motion to enter executive session to discuss litigation and real estate. Councilor Churchwell duly seconded the motion. Attorney Rollins, I provide certification in regard to litigation it would be detrimental if items were discussed in open forum. Mayor Sanders called for all opposed say “no”, all in favor say “aye”.
