Council Minutes October 1, 2020 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street, on Thursday, October 1, 2020. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Roll Call: Marie Turner, City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Walker Councilor Roberts Councilor Churchwell Councilor McCain Minutes: Councilor Roberts offered a motion to approve the amended minutes of the September 1, 2020. Councilor Churchwell duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders" Let the record reflect the motion passed unanimously". Councilor Roberts offered a motion to waive the reading of the September 17, 2020, minutes. Councilor Churchwell duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Churchwell made a motion to accept the minutes as written of the September 17, 2020. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders" Let the record reflect both motions passed unanimously". Committee Chair Comments: Finance: Councilor Tanner offered a motion to pay the bills in the amount of $53,496.16, a copy of the bills schedule is attached. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." Enhancements: Councilor McCain stated the Veterans Day Lunch will be held on, November 11, 2020, and will be a Drive Thru this year due to COVID-19. Councilor McCain added Veterans will be asked to Drive Thru at City Hall, they will be given Chick-fil-a boxed lunches and an umbrella as their gift. Councilor McCain mentioned, this is for the Veteran + 1. Please call City Hall to make reservations. Councilor McCain announced the Shred-a-Thon will be held, Saturday, October 17th, from 8am- 11am, at City Hall. Mayor’s Report: Mayor Sanders opened a Public Hearing regarding: 5735 Miles Soring Road; 5727 Hickory Court; and 453 Heritage Place. Mayor Sanders, “Let the record reflect there was no one present to speak for or against any of these properties”. Mayor Sanders closed the Public Hearing. Councilor Churchwell offered an ordinance changing the zoning classification of real estate located in the City of Pinson, Alabama, 5688 Clay Palmerdale Road & 5735 Miles Spring Road. Councilor Tanner duly seconded the motion. Mayor Sanders called for unanimous consent to consider. Mayor Sanders-yes; Councilor Tanner-yes; Councilor Walker-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, “unanimous consent passes”. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Walker-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously, as Ordinance number 2020-17. Councilor McCain offered a resolution declaring a public nuisance relating to overgrown grass/weeds at 5727 Hickory Court. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Walker-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, resolution passes unanimously, as Resolution number 20-48. Attorney Black explained the litigation process for 453 Heritage Place. Old Business: Mayor Sanders mentioned the upcoming Alabama Butterbean Festival on, October 2-3. New Business: Councilor Tanner offered a motion approving the purchase of flowers and other landscaping items for the Burkett Center, which is the temporary location of some of the students from Rudd Middle School. Councilor Walker duly seconded the motion. Mayor Sanders called for any discussion. After brief discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Roberts gave the Library report, stating the Library will reopen on October 5th from 10am-2pm, Monday -Friday, and Curbside will continue to be available from 10am-5pm. Chief Gene Coleman, Fire Chief Center Point Fire District gave the fire district report. Councilor Roberts offered a motion to enter executive session to discuss litigation and trade and commerce. Councilor Walker duly seconded the motion. Attorney Black, I provide certification in regard to litigation it would be detrimental if items were discussed in open forum.
