MINUTES TOWN OF PITTSBORO BOARD OF COMMISSIONERS REGULAR MEETING MONDAY, JANUARY 11, 2021 7:00 PM Members Present (Virtual): Mayor Jim Nass, Mayor Pro Tern Pamela Baldwin, Commissioner John Bonitz, Commissioner Michael Fiacco and Commissioner Kyle Shipp. Members Absent: Commissioner Jay Fan-ell. Call to Order - Mayor Nass Mayor Nass called the meeting to order. Invocation - Moment of Silence Mayor Nass asked for a moment of silence. UPDATES & COMMISSIONER CONCERNS 1. Manager Updates Town Manager Chris Kennedy announced that Town Planning Director Jeff Jones will be leaving the Town to pursue another job opportunity. Mr. Kennedy thanked Mr. Jones for his five years of service to the Town and wished him the best in his future endeavors. 2. Mayor Updates Mayor Nass advised that he received a number of calls from residents concerned about the sequencing and timing of the traffic lights on US 15-501 between the traffic light at the entrance to the Mosaic development and the Powell Place neighborhood. 3. Commissioner Updates 2  • Boys & Girls Club Commissioner Shipp advised that he and other volunteers associated with the Boys & Girls Club and the Kiwanis Club delivered twenty (20) child-size desks which were built and donated by local businesses. Commissioner Shipp stated that the Kiwanis Club has officially voted to partner with the Pittsboro Boys & Girls Club and therefore now the Club formally has a location. • Chatham County Arts Council • Chatham County Economic Development Corporation (EDC) Commissioner Fiocco advised that the EDC has officially hired a new President, Michael Smith, who comes to Chatham County with twenty years of experience in Sanford, North Carolina. • Climate Change Commissioner Bonitz advised that the Chatham County Climate Change Advisory Committee has a new co-chair and their next meeting with be on January 28, 2021. Commissioner Bonitz added that he would like the Board of Commissioners to adopt a resolution in support of Carbon Fee and Dividend policy at the federal level. Commissioner Bonitz stated that he will be providing some materials on the policy for the Board to consider. • Downtown Commissioner Fiocco advised the NCDOT traffic circle project began today. Commissioner Fiocco added that this project was one of the main projects defined in the Town's Downtown Vision Plan that was adopted in 2014. Commissioner Fiocco also stated that he shared that news with State Representative Robert Reives, and offered that Representative Reives was pleased to see the project coming to fruition. • Fairground Association • Human Relations Committee • Main Street Pittsboro (MSPBO) • Parks and Recreation Advisory Board (PARAB) Commissioner Fiocco advised that the next meeting of the PARAB is this Wednesday evening. • Pittsboro Business Association (PBA) Commissioner Fiocco advised he and the Town Manager Chris Kennedy will be at the PBA meeting on Wednesday morning to share the latest details on the downtown traffic circle project. • Triangle Area Rural Planning Organization (TARPO) Commissioner Fiocco again commended Town staff for moving quickly on getting the application submitted for CMAQ grant funding. • Triangle J Council of Governments (TJCOG) Mayor Pro Tern Baldwin advised she will be meeting at her regular TJCOG meetings later this month. • Chatham County Affordable Housing Mayor Pro Tern Baldwin advised that the group were scheduled to meet on January 7, 2021, however the meeting was postponed. Board Appointments - Parks and Recreation Advisory Board o Malica Evans - In-Town Member [Initial Appointment] o Term: January 11, 2021 - January 11, 2023 End of Consent Agenda. Commissioner Fiocco requested a modification to the draft minutes for the November 9, 2020 Regular Meeting of the Board of Commissioners stating that he believed that once phrase was in need of correction due to seemingly redundant language. Town Manager Chris Kennedy stated that on the surface the language may appear to be redundant but that this phrase is correct as staff intended to differentiate between "mixed-use" and "a mixture of uses". Commissioner Fiocco accepted the explanation and withdrew his modification request. Commissioner Fiocco stated that he would like to remove from the Consent Agenda items #9 and #10 as the Board has yet to receive support materials for these applications. Site Plan Review - SP-2020-07 - COD Dialysis Center - Powell Place Village Center LLC Commissioner Fiocco requested the Board recuse himself from any deliberation or voting on this item on the basis that he works for the design firm and was intimately involved in the project. Planner Kayleigh Mielenz delivered the staff report for this request. Ms. Mielenz outlined the requirements and the general overview of the project. Ms. Mielenz stated that at their December 7, 2020 meeting, the Planning Board unanimously recommended approval of the site plan with a vote of 6-0. Michael Fiocco, now recused and acting in his non-Commissioner professional capacity, further described the project and explained that the developer seeks to develop this vacant parcel with a 10,000 square feet medical office to be used as a dialysis center. Mr. Fiocco also described that this project is not requesting any sewer allocation from the Town as the private development team has coordinated an arrangement to utilize previously allocated flow purchased by the developer of Powell Place. Discussion ensued between staff, the Board and the applicant. Commissioner Shipp made a motion to approve the Site Plan as presented, seconded by Mayor Pro Tern Baldwin. Site Plan Review - SP-2020-08 - "SoCo" Development - Stafford Properties & WineAndBeerAre We LLC Planner Kayleigh Mielenz provided the staff report and reviewed the request for the Board. Ms. Mielenz outlined the requirements and the general overview of the project. Ms. Mielenz stated that the petitioner is seeking to redevelop the property located at 56 Sanford Road into a two-story, 4,000 square feet restaurant to be located within the downtown SoCo development. As part of this site plan request, the developers are also requesting the approval of a sewer allocation request in the amount of 7,178 GPD. At their December 7, 2020 meeting, the Planning Board unanimously recommended approval of the site plan with a vote of 6-0. On behalf of the petitioner, Greg Stafford asked the Board and staff for clarification on the sewer allocation and its terms of expiration pursuant to the Town's sewer allocation policy dated October 2019. Town Manager Chris Kennedy and Town Attorney Paul Messick advised that so long as Mr. Stafford's project proceeded with construction and did not have a lapse of 12-months without work, the sewer allocation would remain valid. Furthermore, that once the project received a Certificate of Occupancy, the sewer allocation was locked in regardless of whether a tenant occupied the space or not. Further discussion ensued and Mr. Stafford ultimately agreed with the staff interpretation. Commissioner Fiocco made a motion to approve the Site Plan and Sewer Allocation request as presented, seconded by Commissioner Bonitz. Town of Pittsboro Pilot Study and Advanced Treatment of Emerging Contaminants Report Findings and Recommendations - CDM Smith 6 Town Manager Chis Kennedy introduced the consultants from CDM Smith, Reed Barton and Bill Dowbiggin, and provided a general overview of the recent work performed by CDM Smith with the Town's pilot study for advanced treatment since the Board was last updated in August 2020. Mr. Barton and Mr. Dowbiggin walked the Board through the recent work and presented a PowerPoint. The presentation included an overview of the approaches to address PF AS/PFOA compounds in our drinking water as well as how we may address I, 4 Dioxane should it become detectable again. These approaches included Reverse Osmosis (RO), Granulated Activated Carbon (GAC), GAC Combined with Ion Exchange (GAC + IX) and Ultraviolet (UV). Discussion ensued between the Board, staff and the consultants from CDM Smith. After Mr. Barton and Mr. Dowbiggin covered the treatment options, they discussed the implementation options and their recommendations. Town Manager Chris Kennedy added that preliminary conversations with staff in advance of this meeting, discussed both short- and long-term approaches so that the Town can provide expedient and effective treatment results to improve the confidence in our drinking water. Discussion ensued between the Board, staff and the consultants from CDM Smith. Commissioner Bonitz advised he wanted to make a motion that we begin working toward the Fast- Track using either Option I or Option 2. Commissioner Shipp stated that he too would like to begin with Fast-Track as soon as possible, but he would like to wait a few weeks to discuss the longer-term option. Commissioner Shipp added that the initial phase is most important and if we can initiate that first without harm to the project, then that would be his preference. No formal motion was offered or voted upon, but the Board agreed to direct the Town Manager to work with the consultants on initiating the Fast-Track option presented. Town Manager Chis Kennedy stated that he will work with CDM Smith and begin working on the Fast-Track option. As part of this effort, Mr. Kennedy stated that he will need to put together a Cost Estimate for the Board's consideration as well as a Budget Amendment since this is an unbudgeted project in this year's budget. Mr. Kennedy stated that he will bring this back to the Board for review at one of the upcoming Board of Commissioners meeting and proceed forward from there. 2. Town of Pittsboro Planning Department Report to the Board - Unified Development Ordinance Status Updates and Timeline Overview Senior Planner Theresa Thompson provided an overview of the current status of the UDO, including content update and the most up-to-date timelines. Ms. Thompson stated that Planning staff intends to discuss UDO objectives with the Board at their second meeting of each month, the next UDO update for the Board will be at the January 25, 2021 Regular Meeting of the Board of 7 Commissioners. Staff anticipate adoption of the UDO to take place at the April 26, 2021 Regular Meeting of the Board of Commissioners. Commissioner Shipp made a motion to go into Closed Session pursuant to N.C.G.S. § 143-318.11. (a) (6), seconded by Commissioner Fiocco. Commissioner Shipp made a motion to come out of Closed Session, seconded by Commissioner Bonitz. Final Board of Commissioner Comments & Adjournment Following up on the Mayor's comments delivered at the beginning of the meeting, and in addition to the timing of traffic lights on US 15-501, Commissioner Bonitz asked if the posted speed limit could also be assessed in this same section of road. Adding that it can be very confusing as the speed limit goes from 55MPH to 45MPH, back to 55MPH, then to 45MPH, 35MPH and ultimately 20 MPH as one drives southward back to downtown. Town Manager Chris Kennedy advised the Board that US 15-501/Hillsboro Street is a NCDOT maintained road, and therefore, NCDOT dictates the speed limits in this stretch and the timing of the traffic lights. Mr. Kennedy added that this entire stretch of roadway is now within the corporate limits of the Town due to a few recent annexations, so we may be able to persuade NCDOT to an 8 alternative posted speed limit if that is desired. Mr. Kennedy stated that he would contact NC DOT to discuss the posted speed limits and the traffic light timing concerns. Commissioner Fiocco made a motion to adjourn, seconded by Commissioner Bonitz at 11 :37pm.
