TOWN OF PITTSBORO BOARD OF COMMISSIONERS REGULAR MEETING MINUTES I 1/13/2025 - Minutes MONDAY, JANUARY 13, 2025 6:00 PM 1. ORDER OF BUSINESS The Pittsboro Board of Commissioners met in Regular Session on Monday, January 13, 2025, at 6:00 p.m. in the meeting room at the Chatham County Agriculture and Conference Center with Mayor Kyle Shipp presiding . The meeting was called to order at 6:03 p.m. Mayor Shipp requested a moment of silence with the recitation of the Pledge of Allegiance led by Commissioner Farrell. Elected Town Officials Present: Mayor Kyle Shipp, Mayor Pro Tern Pamela Baldwin , Commissioners Jay Farrell, John Foley and James Vose. Elected Town Official Absent: Commissioner John Bonitz. Town Staff Present: Town Manager Jonathan Franklin , Assistant Town Manager/Engineering Director Kent Jackson, Town Attorney Paul S. Messick , Chief of Police Shorty Johnson , Finance Director Heather Meacham, Planning Director Randy Cahoon-Tingle, Public Works Director Daniel Snipes, Project Analyst Jenna Peterson, Communications and Emergency Management Director Colby Sawyer, Communications Specialist Caitlin Murphy, and Town Clerk Carrie Bailey. Mayor Pro Tem Baldwin made a motion to approve the agenda, seconded by Commissioner Vose. Aye-4 Nay-0 [ 2. CONSENT AGENDA 2.1. Budget Amendment: Climate Action Plan 2.IV. Budget Amendment: Financial Consulting Services 2.V. Budget Amendment: Powell Bill 2.VI. Budget Amendment: Water And Sewer Grants 2.VII. Request: Designating Custodians For First Citizens Bank 2.VIII. Agreement: Windstone Sculpture Commissioner Farrell made a motion to approve the consent agenda, seconded by Commissioner Vose. Aye-4 Nay-0 3. INFORMATION ITEMS-None Commissioner Bonitz arrived at 6:08pm. 4. CEREMONIAL 4.1. Resolution: PBO-101 Citizen's Academy Graduation Fall 2024 Commissioner Farrell made a motion to adopt the resolution, seconded by Commissioner Foley. Aye-5 Nay-0 5. CITIZENS MATTERS 5.1. Manager Updates Town Manager Jonathan Franklin provided updates to the Board . 5.11. Department Of Month Update-None 5.111. Mayor & Commissioner Committee Liaison Reports Mayor and Board members gave updates on the committees and boards on which they serve. 5.IV. Public Comment Public comment was held at 6:13 pm. 6. MISCELLANEOUS 6.1. Audit Presentation: Sharpe And Patel Audit Review FY 2023-2024 Jay Sharpe, Sharpe and Patel, LLC reviewed the audit PowerPoint presentation with the Board which included the financial standing results . Mr. Sharpe shared the audit was submitted by the deadline and was approved. 7. PUBLIC HEARINGS 7.1. Text Amendment: Unified Development Ordinance ZTA-2024-06 Commissioner Vose made a motion to open public hearing, seconded by Commissioner Bonitz. Aye-5 Nay-0 Project Analyst Jenna Peterson presented the item to the Board. Ms . Peterson shared staff recommended the use of "may" instead of the word "shall" within amendment 4, Section 5.8 entitled Timber Harvest-Effect on Development. No one signed up to speak for the public hearing . Commissioner Farrell made a motion to exit public hearing, seconded by Commissioner Vose. Aye-5 Nay-0 Commissioner Farrell made a motion to approve the text amendment as is, seconded by Mayor Pro Tern Baldwin. Aye-3 (Farrell, Baldwin, Vose) Nay-2 (Foley and Bonitz) 7.11. Conditional Rezoning : PB-24-509 Womble Tract Commissioner Foley made a motion to open public hearing, seconded by Commissioner Vose. Aye-5 Nay-0 Planning Director Randy Cahoon-Tingle presented the item to the Board . Patrick Bradshaw, Bradshaw, Robinson , Slawter & Rainer LLP, and Robbie Oldham , WithersRavenel , provided further details to the Board. Melissa Semenov, 1389 Hadley Mill Road , Pittsboro , spoke in favor of smart growth and asked the Board to follow the UDO. Commissioner Bonitz made a motion to exit public hearing, seconded by Commissioner Vose. Aye-5 Nay-0 Commissioner Bonitz made a motion to approve the rezoning with change to section four, paragraph one, seconded by Commissioner Vose. Aye-5 Nay-0  7.111. Conditional Rezoning : PB-24-511 Bland Tract Commissioner Foley made a motion to open public hearing, seconded by Commissioner Vose. Aye-5 Nay-0 Planning Director Randy Cahoon-Tingle presented the item to the Board. Nick Robinson , Bradshaw, Robinson , Slawter & Rainer LLP, shared details pertaining to the conditional rezoning request. Public Comment: Mark Hewitt, 424 Johnny Burke Road, Pittsboro, shared his opposition of the proposed item . David O'Connell, 347 Branch Drive, Pittsboro, requested the proposed Fire Department to be in a more suitable location within Chatham Park. Toby Turnbull, 2025 US 64 Business East, Pittsboro, was opposed to the conditional rezoning . Hally Bland, 387 Hanks Chapel Road , Pittsboro requested the proposed Fire Department be moved across the street as a more suitable location. Carol Hewitt, 424 Johnny Burke Road , Pittsboro, urged the Board to reconsider and not approve the rezoning request. Beverly Ward Bland , 165 Lucian Bland Road, Pittsboro, asked the Board to deny the rezone request. Emma Hewitt, 424 Johnny Burke Road offered her speaking time to Steven Ferlauto. Steven Ferlauto, 323 Hanks Chapel Road , opposed the request. Adham Abdalla , 255 Johnny Burke Road, urged the Board to vote against the request. Warren Mitchell , 104 Amber Wood Run , Chapel Hill , spoke in favor of the conditional rezoning request. Robbie Oldham, WithersRavenel , clarified questions for the Board. Mayor Pro Tern Baldwin made a motion to exit public hearing, seconded by Commissioner Farrell. Aye-5 Nay-0 Bonitz made a motion to continue the public hearing until the Small Area Plan is approved, seconded I by Commissioner Foley. Commissioner Bonitz made an amended motion to table the rezoning proposal until the Small Area Plan is revealed. Commissioner Bonitz made an amended motion to table the item until the February meeting, seconded by Mayor Pro Tern Baldwin. Commissioner Bonitz made a motion to withdraw the first motion and move to table this item until the February meeting, seconded by Mayor Pro Tern Baldwin. Aye-2 Bonitz, Baldwin Nay-3 Farrell, Foley, Vose Commissioner Farrell made a motion to recommend approval of PB-24-511 as presented for Town standards and is consistent with the Land Use Plan with addition of affordable housing also, seconded by Commissioner Vose. Aye-3 (Farrell, Baldwin, Vose) Nay-2 (Foley, Bonitz) 8. ACTION ITEMS Commissioner Bonitz made a motion to take a 10 minute recess, seconded by Mayor Pro Tern Baldwin. Aye-5 Nay-0 8.1. Map Amendment: PB-24-466 Powell Place MUPD Jody Leidolf, reviewed the item to the Board. Commissioner Foley made a motion to approve PB-24-466 Powell Place MUPD Map Amendment as [ amended, seconded by Commissioner Bonitz. Aye-5 Nay-0 8.11. Request: FPI~ Response Letter Finance Director Heather Meacham presented the item to the Board .  Mayor Pro Tem Baldwin made a motion to approve the FPIC response letter to the LGC, seconded by Commissioner Bonitz. Aye-5 Nay-0 8.111. Appointment: Planning Board ET J Member Planning Director Randy Cahoon--Tingle presented the item to the Board . Commissioner Foley made a motion to approve the following Town of Pittsboro ETJ Planning Board member Connie McAdams for a term to expire December 31, 2025, seconded by Commissioner Farrell. Aye-5 Nay-0 8.IV. Request: Designate Voti ng Delegate And NC LM Bienn iu m Legislative Goals For FY 2025-2026 Mayor Pro Tern Baldwin made a motion to motion to designate Mayor Shipp as Town of Pittsboro voting delegate to complete, seconded by Commissioner Bonitz. Aye-5 Nay-0 AND Commissioner Foley made a motion for the following Town of Pittsboro ten legislative goals to be submitted to North Carolina League of Municipalities by January 17, 2025, seconded by Commissioner Vose. Aye -5 Nay-0 • Establish long-term funding streams that adequately address water; sewer; stormwater; transportation and other infrastructure needs. • Expand state transportation funding streams for construction and maintenance of municipal and state-owned secondary roads. • Increase funds to remediate contamination in local water supplies. • Expand incentives and funding for local economic development. • Create incentives to encourage the development of diverse housing options. • Create incentives that encourage and adequately fund regionalized water and sewer solutions. • Provide local revenue options beyond the property tax. • Support technical assistance programs to assist municipalities with securing or maintaining grants or other necessary municipal resources. • Address the needs of a changing municipal workforce through state assistance that supports employee retention, including training and recruitment. • Preserve authority for extraterritorial jurisdiction to ensure that growth is well-planned and investments by homeowners and business owners are protected. 9. CLOSED SESSION Commissioner Farrell left the meeting at 9:06pm . Commissioner Vose made a motion to enter into closed session pursuant to N.C.G.S. §143-318.11 (a)(3), (a)(5) and (a)(6) , seconded by Mayor Pro Tern Baldwin. Aye-5 Nay-0 Mayor Pro Tern Baldwin made a motion to exit closed session pursuant to N.C.G.S. §143-318.11 (a)(3), (a) (5) and (a)(6), seconded by Commissioner Vose. Aye-5 Nay-0 10.
