After having another Juneteenth committee meeting, the request is for council to change that date to Saturday, June 20, 2026. Consider Agreement between the City of Port Lavaca and Rawley McCoy Architects (RMA) for City Hall Master Plan (Phase 5) Interior Renovations. Presenter is Jody Weaver Interim City Manager Weaver advised Council that the proposed Letter of Agreement from Rawley McCoy Architects for the Phase 5 City Hall Master Plan – Interior Renovations. This is an hourly fee contract with a not-to-exceed amount of $25,000.00, plus an additional $8,000.00 for Mechanical, Electrical, and Plumbing (MEP) consulting services, for a total contract amount not to exceed $33,000.00 without further authorization. The City Council approved $350,000.00 in the 2025 - 2026 Fiscal Year (FY) Budget for City Hall security upgrades. Council has recently awarded the construction contract for Phase 4 Security Upgrades in the amount of $278,780.00. With an additional abatement amount of $14,922.20. After accounting for the proposed $33,000.00 agreement with Rawley McCoy Architects, the remaining project budget is $38,220.00. The estimated construction cost for Phase 5, based on conceptual drawings, is $270,344.50. The proposed scope includes renovations and security upgrades for the Code Enforcement, GIS/Permits, Development Services Coordinator, Permitting, Utility Billing, and Development Services areas. The project also includes a break room conversion and renovations to the Finance Department. The Construction of City Hall Master Plan Phase 5 Interior Renovations will be budgeted for the 2026 – 2027 FY. Staff’s recommendation is that City Council approve the Letter of Agreement with Rawley McCoy Architects, in an amount not to exceed $33,000.00, without further authorization, for architectural services related to Phase 5 City Hall Interior Renovations. Consider Certificate of Construction Completion and authorize release of Retainage and Final Payment for City of Port Lavaca – Ann Street Lift Station Replacement Project. Presenter is Jody Weaver Interim City Manager Weaver advised Council that the City of Port Lavaca completed the Ann Street Lift Station Replacement Project, which was undertaken to improve wastewater infrastructure, enhance system reliability, and address aging equipment at the existing lift station. The project has been constructed in accordance with approved plans and specifications. The project engineer has conducted a final inspection and recommends acceptance of the project as complete. All construction work for the Ann Street Lift Station Replacement Project has been substantially completed. The contractor has fulfilled the required scope of work, and the project engineer has issued a Certificate of Construction Completion. In accordance with the construction contract, retainage has been withheld during the course of the project to ensure proper completion. Upon acceptance of the project, the City may release retainage and issue final payment, contingent upon receipt of all required closeout documents, including final pay application, lien releases, and warranties. Staff recommends approval of the Certificate of Construction Completion and authorization to release retainage and final payment to the contractor, contingent upon receipt and approval of all required closeout documentation. Consider award of professional engineering contract for Texas General Land Office (GLO), Texas Coastal Management Program (CMP) Grant Cycle 31 Contract No. 26-056-017-F417 Smith Harbor Boardwalk. Presenter is Jody Weaver Page 5 of 14 Port Lavaca, TX CITY COUNCIL REGULAR MEETING April 13, 2026 Interim City Manager Weaver advised Council that the City of Port Lavaca was awarded a Coastal Management Program (CMP) Grant from the Texas General Land Office (GLO). As part of the City’s comprehensive planning efforts, the community identified the waterfront as its greatest asset and opportunity. In 2023, the City adopted the Downtown Waterfront Master Plan, which includes conceptual plans to connect the shared-use path in Bayfront Peninsula Park to the Smith Harbor Tract. This area is envisioned as a future recreational and conservation space. The purpose of this project is to provide the public with free, safe, and accessible access to the Downtown waterfront area of Lavaca Bay while promoting recreation, accessibility, and environmental stewardship. This project will establish a safe, durable, and universally accessible pedestrian route that highlights Port Lavaca’s unique bayfront, expand public waterfront access, support recreational activities, promote tourism, and contribute to community revitalization. Evaluation Process: The City issued a Request for Qualifications (RFQ) for engineering services and received three (3) responses from qualified firms: • G & W Engineers • Urban Engineering • EXP U.S. Services A Scoring Committee was formed to evaluate the proposals, consisting of: • Interim City Manager Jody Weaver • Director of Public Works Wayne Shaffer • Harbor Master Jim Rudellat • Raymond Butler, Chairman of the Commission Board The Scoring Committee evaluated all responsive proposals in accordance with the RFQ criteria. Proposals were assessed based on: • Firm qualifications and experience with waterfront boardwalk-type projects • Experience with federally and state-funded projects • Experience in project construction management • Past performance and references • Capacity to perform work within required timeframes Each proposal was independently scored, and the results were compiled to determine the most qualified firm. Staff recommends that City Council approve the award of a professional engineering contract to the top scoring firm, Urban Engineering, for Texas General Land Office (GLO) Coastal Management Program (CMP) Cycle 31 Contract No. 26-056-017-F417 for the Smith Harbor Boardwalk Project and authorize the Mayor to execute the Engineering Agreement. Financial implication: Engineering services will be provided on a reimbursement basis in accordance with the terms of the grant agreement. Consider Resolution No. R-041326-1E of the City of Port Lavaca for replacement of Alternate Early Voting Ballot Board (EVBB) Judge for the City of Port Lavaca General Officers Election held on the uniform date of May 02, 2026 and authorizing the Mayor’s signature. Presenter is Mandy Grant Motion made by Councilman District 2 Dent WHEREAS, on March 09, 2026, the City Council approved Resolution No. R-030926-5E to appoint Election Judges for the City of Port Lavaca General Officers Election held on the uniform date of May 02, 2026; and WHEREAS, Mary Lou Tharling was appointed as Alternate Judge for the Early Voting Ballot Board and the Central Counting Station; however, will not be able to fulfill that appointment due to other obligations. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT LAVACA, TEXAS: SECTION 1. THAT, the following citizen, registered to vote in the city, is hereby appointed Election Officer to conduct said election: Angie Patrick Alternate Judge for the Early Voting Ballot Board (EVBB) and the Central Counting Station SECTION 2. Consider Resolution No. R-041326-2 of the City of Port Lavaca authorizing the submission of the Motor Vehicle Crime Prevention Authority Catalytic Converter Theft Prevention Grant Program. Presenter is Weston Burris Motion made by Councilwoman District 4 (Mayor Pro Tem) Padron WHEREAS, under the provisions of the Texas Transportation Code Chapter 1006 and Texas Administrative Code Title 43; Part 3; Chapter 57, entities are eligible to receive grants from the Motor Vehicle Crime Prevention Authority to provide financial support to law enforcement agencies for economic motor vehicle theft and fraud-related motor vehicle crime enforcement teams; and WHEREAS, this grant program will assist this jurisdiction to combat motor vehicle theft, motor vehicle burglary and fraud-related motor vehicle crime; and WHEREAS, City of Port Lavaca has agreed that in the event of loss or misuse of the grant funds, City of Port Lavaca assures that the grant funds will be returned in full to the Motor Vehicle Crime Prevention Authority. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT LAVACA, TEXAS: SECTION 1. THAT, the Interim City Manager is designated as the Authorized Official to apply for, accept, decline, modify, or cancel the grant application for the Motor Vehicle Crime Prevention Authority Grant Program and all other necessary documents to accept said grant; and BE IT FURTHER RESOLVED that Grant & CIP Coordinator is designated as the Program Director and Finance Director, is designated as the Financial Officer for this grant. Consider approval of the Municipal Court Judge job description and compensation rate for the term beginning on June 30, 2026 and ending on June 29, 2028. Presenter is Jody Weaver Interim City Manager Weaver advised Council that at the June 08, 2026 Regular Council meeting, Council will consider the appointment or reappointment of the Municipal Court Judge for a new two-year term which will begin on June 30, 2026. To provide clarity in the essential duties and responsibilities, minimum qualifications, working conditions and time commitment, the Council discussed these elements of a job description for the Municipal Court Judge at the workshop on March 23, 2026. As no changes were proposed at the workshop and I have received no suggestions for change from Council since the workshop, the attached proposed job description is the same as what was presented and discussed at the March 23, 2026 Workshop. The current compensation for the Municipal Judge is a monthly rate of $2,000.00. At the workshop, Council reviewed a spreadsheet showing the results of a survey of other cities in the region regarding the Municipal Court Judge position. It is staff’s intention to provide notice to the public, beginning on April 15, 2026, that the Council will appoint or reappoint the Municipal Court Judge on June 08, 2026 for a new two-year term beginning on June 30, 2026. Anyone interested in being considered for this appointment is asked to submit a letter of interest with a resume to the City Secretary’s office by June 01, 2026. Consider the recommendation of the Planning Board for the expansion of a childcare facility located at 329 W. Main Street, the legal description is Lots 6 & PT of 2, 4, 8 of Block 44 of the Georgetown Addition. Property ID 51910. Presenter is Derrick Smith Development Services Director Smith advised Council the applicant is currently operating a childcare facility at 411 W. Main Street. The property at 329 W. Main Street is currently being used as Residential. The request is for the change of use to Commercial to allow the operation of a childcare facility. As shown on the conceptual plan, the applicant is proposing the placement of a modular building and playground in the rear yard. The improvement will be to provide additional classroom and playground space for the applicant. According to the tax roll, the property is currently owned by Samuel R. Chamberlain, III. The request complies with our Future Land Use Plan. There were no objections from surrounding neighbors; therefore, the Planning Board and staff recommends approval. Announcement by Mayor that City Council will retire into closed session: • For consultation with City Attorney on matters in which the duty of the Attorney to the City Council under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the Open Meetings Act (Title 5, Chapter 551, Section 551.071(2) of the Texas Government Code). • To discuss personnel matters in accordance with Title 5, Section 551.074 of the Texas Government Code (to discuss appointment, employment, evaluation, responsibilities and duties, reassignment, discipline or dismissal of an officer or employee, or to hear a complaint or charge against an officer or employee [Chief of Police]).
