APPROVED 12/17/2018 REGULAR MEETING MINUTES December 3, 2018 THE REGULAR MEETING OF THE RICHMOND CITY COUNCIL WAS CALLED TO ORDER AT 7:03 P.M., ON MONDAY, DECEMBER 3, 2018, BY MAYOR RIX. ROLL CALL Present: Allen, LaFore, Misteravich, Reindel, Rix, Warn Absent: Greene Others: City Manager Moore, Deputy Clerk Focht Visitors: Police Chief Teske, City Planner Jeschke, DPS Director Goetzinger, Library Director Kammer, David Bauman Motion by Reindel, seconded by Warn, to excuse Councilor Greene from tonight’s meeting due to being out of town. All yeas Motion carried APPROVAL OF MINUTES Motion by Warn, seconded by Allen, to approve the minutes of the November 19, 2018, regular meeting as presented. All yeas Motion carried AUDIENCE PARTICIPATION None ADOPTION OF AGENDA Motion by Warn, seconded by Allen, to adopt the agenda as presented. CONSENT AGENDA a) Approval of Schedule of Bills dated November 29, 2018, in the amount of $146,264.14 Motion by LaFore, seconded by Misteravich, to adopt the Consent Agenda as presented. Consideration of Approving the West Richmond Site Condominium/Teltow Contracting Motion by Reindel, seconded by Warn, to approve the Condominium Site Plan Review for the West Richmond Condominium Development consisting of 54 lots on 25.5 acres of property located at the western terminus of Woodside Drive, Richwood Lane, and Diane Lane All yeas Motion carried Councilor Reindel appreciates all the information that went into the background brief. Mayor Rix stated that Teltow has gone above and beyond what they could have done with this subdivision. Councilor LaFore asked if the developer was in agreement with the proposed streetlights and connecting the sidewalk. City Manager Moore said they need to work with the Macomb County Drain Commission, but the developer is not opposed to any of it. 2. Consideration of Little League Banner and Sign Request Motion by Allen, seconded by Warn, to approve the special event application from Richmond Little League to have an across the road banner in conjunction with their registration event to be displayed January 11, 2019 through January 28, 2019, and yard signs that will be placed at City Limit Signs from January 11, 2019 to February 3, 2019. All yeas Motion carried David Bauman, President of Little League spoke and said the banners really help get this word out and that the proposed dates are fine. He did inquire on the actual sign locations. City Manager Moore will be in touch via email with the location information. 3. Consideration of Approving Resolution No. 2018-16/Code Enforcement/Richmond Township Motion by LaFore, seconded by Misteravich, to approve Resolution 2018-16; a Resolution approving the intergovernmental agreement between the City of Richmond and Richmond Township to have the City of Richmond Police Department assist the Township Code Enforcement Officer All yeas Motion carried Mayor Rix asked if there is a lot of time spent in court. Chief Teske said no, there is not. He feels it is working well and is not time consuming. CCM: 12/03/2018 Page 2 of 5  APPROVED 12/17/2018 4. Consideration of Library Contract with Richmond Township Motion by Allen, seconded by Reindel, to approve the Agreement for Library Services between the Township of Richmond and the City of Richmond Lois Wagner Memorial Library. All yeas Motion carried Mayor Pro-Tem Misteravich wondered how this information was going to be communicated to the Richmond Township residents. City Manager Moore stated there will be a press release, use of Richmond Township’s messaging system and printed in Richmond Township’s newsletter. Library Director Kammer said she is very happy for the patrons that use the library and now can receive full services. 5. Consideration of Revised Cemetery Layout Motion by LaFore, seconded by Misteravich, to approve revising the Cemetery layout with the majority of the graves changing to an east/west orientation. All yeas Motion carried 6. Consideration of Resolution No. 164/Prohibition of Recreational Marihuana Establishments within the City of Richmond Motion by Reindel, seconded by Warn, to approve resolution 2018-17 which announces the City’s intent to prohibit recreational marihuana establishments within the City of Richmond. All yeas Motion carried Motion by Allen seconded by Reindel, to give introduction and first reading to Ordinance #164 which will prohibit recreational marihuana establishments within the City of Richmond. All yeas Motion carried St. Clair County needs to be added to the Resolution and the Ordinance. MISCELLANEOUS MATTERS FROM THE CITY MANAGER Friday is the Community Tree Lighting and Parade. The parade will start 6:30 p.m. and the tree lighting is at 7:00 p.m. Thank you to Sue Kiel and her helpers for decorating the Christmas trees at City Hall. COUNCIL COMMENTS CCM: 12/03/2018 Page 3 of 5  APPROVED 12/17/2018 Mayor Rix thanked TIFA for the new Christmas decorations. Lot of volunteers to help put them up and lots of compliments on them. Mayor Rix announced the upcoming events: 12/7 – Parade 6:30 p.m. 12/7 – Tree Lighting 7:00 p.m. 12/7 – Historical Society open house 4-8 p.m. 12/8 – Lion’s Breakfast with Santa 8:30 a.m. 12/11 – Cable Commission meeting 7:00 p.m. 12/14 – Cookie Sale Library 1-7 p.m. 12/14 – Santa at Library 6-7 p.m. 12/17 – City Council 7:00 p.m. Hall walking T-W-Th at 6-8 p.m. CLOSED SESSION 1. City Manager Evaluation Motion by LaFore, seconded by Misteravich, to convene into closed session in accordance with Section 8 (a) of the Michigan Open Meetings Act, Public Act 267 of 1976, as amended, for the purpose of considering a periodic personnel evaluation of the City Manager as requested by the City Manager. Roll Call Vote: 6 yeas (LaFore, Misteravich, Reindel, Rix, Warn, Allen) 1 absent (Greene) Motion carried Recessed at 8:00 p.m. to go into closed session. OTHER BUSINESS Motion by Warn, seconded by Allen, to reconvene into open session at 8:25 p.m. All yeas Motion carried Motion by Misteravich, seconded by LaFore, to approve the City Manager’s evaluation results. The City Council has completed the City Manager’s evaluation with input from all Councilor’s. The City Manager scored a 3.55 on a 4.00 scale which is effective to very effective. We as a City Council appreciate the work that City Manager Moore does and anticipate future success in leading the City of Richmond. A salary compensation increase will be determined during the time that the non-affiliated employee’s compensation is discussed.
