REGULAR PLANNING COMMISSION MEETING MINUTES OCTOBER 13, 2016 THE REGULAR MEETING OF THE RICHMOND PLANNING COMMISSION WAS CALLED TO ORDER ON THURSDAY, OCTOBER 13, 2016, AT 7:00 P.M., BY CHAIRMAN McCLELLAN. ROLL CALL Present: Durkee( 7:12 pm), Frank, Kaminski, McClellan, Moore, Rix, Weinert, Zink Absent: None Others: City Planner Jeschke, City Clerk Stagl Visitors: None APPROVAL OF MINUTES Motion by Rix, seconded by Moore, to approve the minutes of the September 22, 2016, regular meeting as presented. All yeas Motion passes AUDIENCE PARTICIPATION None. CORRESPONDENCE - City Council Meeting Minutes of September 6, 2016 - City Council Meeting Minutes of September 19, 2016 Motion by Zink, seconded by Frank, to receive and file the correspondence as presented. All yeas Motion passes ADOPTION OF AGENDA Motion by Moore, seconded by Rix, to adopt the Agenda as presented. All yeas Motion passes PCM: 10/13/2016 Page 1 of 3 PUBLIC HEARING None scheduled. ITEMS FOR CONSIDERATION B-1. Discussion on Public Acts 281, 282 and 283 of 2016, which amend and expand the Michigan Medical Marihuana Act Provisions City Planner Jeschke informed the Commission of the new Public Acts, recently signed by Governor Snyder. Public Act 281, 282 and 283 of 2016, amend and expands the Medical Marihuana provisions within the State of Michigan. The City’s currently ordinance is very simple in structure and defines what Dispensaries, Compassion Centers and other similar operations are, and then prohibits them. The new laws now allow for dispensaries as well as setting up a licensing and tracking system. Commissioner Durkee entered at 7:12 p.m. The City has the option to allow 1 or all of the five types of licenses that are now allowed, or we can keep our current ordinance which prohibits all but home grown facilities. The City Manager and City Planner have been receiving calls from business speculators questioning what the City’s position is on the new laws. Discussed with the Commission on which direction they would like the City to go into. Most Commissioners felt that the City should move slowly and carefully. We are in the process of redoing our master plan. The Commission should review the Master Plan to determine how a medical marihuana facility will fit into the City’s future plans. McClellan – As a doctor, indicated that there was not much evidence that shows the effective of medical marihuana. It would be difficult for him to support an ordinance that would allow medical marihuana facilities within the City. The Commission discussed the possibility of posing this question to the Community during the public hearings that would be held for the Master Plan. The consensus of the Commission was to keep the existing ordinance and move forward slowly with any new legislation. MISCELLANEOUS MATTERS FROM THE CITY STAFF City Planner Jeschke - distributed to Commission Members the rough draft of the Character AreaMap created by the Macomb County Planning Department. PCM: 10/13/2016 Page 2 of 3 City Manager Moore - reminded Commission of the Fire Department’s open house this Sunday (10/16). - The City keeps moving forward with the streetscape improvements. COMMENTS FROM CHAIRMAN AND COMMISSION MEMBERS Frank – Questioned the status of the Pound Road reconstruction. City Manager Moore informed the Commission that the contractor would be putting down the wearing course next week. We encountered some sewer work that needed to be done, which has delayed the project. Kaminski – Questioned if the City could do anything about the condition of the Lenox Square Plaza and the Kmart Plaza. City Manager Moore informed the Commission that there was no clear cut owners of these plazas, but the City was working on some code enforcement issues. Mayor Rix – Informed the Commission that the Richmond-Lenox EMS recently held a groundbreaking on their new building. McClellan – Questioned the City’s noise ordinance and how it is being applied to the excessive noise at Miller Transit. City Manager Moore informed the Commission that this issue would be going to court.
