No item will be heard before its scheduled time, but may be heard later in the meeting. Oral communications from the audience relating to any of the agenda items are limited to three minutes, and you will be asked to state your name and city of residence. City Planning Commission action on all items may be appealed to the City Council within ten calendar days for zoning and map cases. Contact the Planning Division for further information. State law restricts the City Planning Commission from taking action on an item unless it has been included on an agenda and posted at least 72 hours in advance of a meeting, or unless the matter falls within one of the narrow exceptions. Consequently, any item not listed on this agenda will normally have to be delayed until the item can be made part of a posted agenda. Additionally, significant changes to a project made subsequent to posting of the agenda and not addressed in the City Planning Commission staff report will result in continuance of that item in order to allow for adequate review by the Commission. Materials related to an item on this Agenda submitted to the City Planning Commission after distribution of the agenda packet are available for public inspection in the Planning Division office during normal business hours. 9 A.M.--PUBLIC HEARINGS 1 PLANNING CASE P13-0719 (Continued from February 20, 2014): Proposal by Ceazar Aguilar of Amaya/CPA Food and Entertainment Corporation to consider a Conditional Use Permit to allow entertainment in conjunction with an existing 4,100 square foot restaurant (Amaya Japanese Restaurant), located at 3775 Tyler Street, situated in the “North Village” of the Galleria at Tyler, on the southerly side of Magnolia Avenue, between Hughes Alley and Tyler Street, in the CRC-SP - Commercial Regional Center and Specific Plan (Magnolia Avenue) Overlay Zones, in Ward 6. It has been determined that this proposal is an exempt project per California Environmental Quality Act (CEQA) Section 15301 (minor alteration to an existing facility). Attachments: P13-0719 continuance req City of Riverside Page 2 Printed on 3/14/2014 Planning Commission Agenda March 20, 2014 2 PLANNING CASES P13-0165, P13-0166, P13-0167 and P13-0168: Proposal by Mohamed Sierafi to consider 1) an Amendment to the General Plan to change the land use designation of approximately 5.54 acres from O-Office to MU-V – Mixed Use Village and approximately 1.29 acres from O-Office to C-Commercial; 2) to amend the Municipal Code (Title 19) to rezone approximately 5.54 acres from the R-1-7000 – Single Family Residential Zone to the MU-V – Mixed Use Village Zone and to rezone approximately 1.29 acres from the R-1-7000 – Single Family Residential Zone to the CR-Commercial Retail Zone; 3) for a Conditional Use Permit to allow construction of a vehicle fuel station with an automated vehicle wash facility; and 4) the Design Review of the plot plan and building elevations for an approximately 4,858 square foot vehicle fuel canopy, an approximately 3,156 square foot convenience store, an approximately 2,000 square foot vehicle wash facility, and two approximately 920 square foot vacuum canopies, on an approximately 1.29 acre portion of an approximately 6.8 acre vacant site, situated on the westerly side of La Sierra Avenue, southerly of Indiana Avenue and northerly of Liverpool Lane, in Ward 6. It is recommended that the Planning Commission recommend to the City Council adoption of a Mitigated Negative Declaration in conjunction with these cases. It is recommended that the Planning Commission recommend to the City Council adoption of a Mitigated Negative Declaration in conjunction with these cases. Mohamad Khalad, to consider: 1) a Conditional Use Permit to remove the northerly gasoline canopy and dispensers and vehicle repair facility to facilitate redevelopment of approximately 0.51 acres with a renovated vehicle fuel station, including a 2,941 square-foot convenience store and self-service automated single bay car wash; and 2) the Design Review of the plot plan and building elevations for the proposed site improvements.
