BOARD OF ADJUSTMENTS Zoom Meeting 2:30 P.M. August 20, 2020 MEMBERS PRESENT: Phil Burkhalter, Von Lambert, Jeff Williams, Terry Williamson, Will Byington, Eric McDowell MEMBERS ABSENT: Carol Hatch STAFF PRESENT: Kayla Schaaf, Artagus Newell, Patrick Eidson, Brittany Griffin, James Martin, Frank Beacham PUBLIC PRESENT: Evan and Katelynn Mather, Cooper Clotfelter, Ryan Murphy, Larry Maxy, Stephane LaPointe, Barry McCullough DETERMINATION OF QUORUM: the six members listed above were determined to be present via roll call REVIEW OF THE MINUTES The minutes were approved by 6-0 vote, after a motion to approve from Burkhalter and a second from Williams. APPLICATIONS: BOA20-06-03, Requests a six-foot tall privacy fence in the front yard (Chatillon Road frontage) of the property at 204 Chatillon Road, Rome, GA 30161, Floyd County Tax Parcel J13W426. Applicant/Owner: Michael Barry McCullough. Newell presented the application, staff report and staff recommendation of approval. McCullough was present to speak on behalf of the application. There was no one present to speak in opposition. Phil Burkhalter made a motion to approve, which was seconded by Byington. The motion passed 6-0. BOA20-07-01, Requests a six-foot tall privacy fence along Royal Oaks Drive road frontage for the property located at 17 Royal Oaks Drive, Rome, GA 30165, Floyd County Tax Parcel J11W287. Applicant/Owner: Jessica Gregory. Newell presented the application, staff report and staff recommendation of approval. Clotfelter, the fence builder, was present to speak on behalf of the application. He presented handout information to the committee. Lambert made a motion to accept the new information, motion seconded by Williamson. Clotfelter brought to the attention of the committee that the neighbors six-foot tall privacy fence was approved approximately 5 years ago. There was no one present to speak in opposition. Williamson made a motion to approve the fence. The motion was seconded by Byington. The motion to table the application passed 6-0. BOA20-07-02, Requests to increase the height of the existing monument sign by 2 feet for the property located at 800 Broad Street, Rome, GA 30161, Floyd County Tax Parcel J14C003. Applicant/Owner: Jimmy Byars/Roger Manis LLC. Newell presented the application, staff report and recommendation of approval. Byars was present to speak on behalf of the application. There was no one present to speak in opposition. Burkhalter made a motion to approve as is, which was seconded by Williams. Williamson abstained from the vote. The motion passed 5-0. BOA20-07-03, Request to reduce the rear setback to four feet and the western side setback to two feet for the property located at 13 Pebblecreek Drive, Rome, GA 30165, Floyd County Tax Parcel H12Z307. Applicant/Owner: Ryan Murphy/Ruby Curry. Newell presented the application, staff report and staff recommendation of approval. Murphy was present to speak on behalf of the application. Maxey was there to speak in opposition. Murphy rebuttled Maxey’s disagreement. Williams made a motion to approve, which was seconded by Byington. Lambert abstained from the vote. The motion passed 3-2-1. BOA20-08-01, Requests a six-foot tall privacy fence in the front yard (Green Street frontage) of the property at 13 Elmwood Street NE, Rome, GA 30161, Floyd County Tax Parcel J13W573. Applicant/Owner: Evan James Mather. Newell presented the application, staff report and staff recommendation of approval. No one was present to speak on behalf of the application. There was no one present to speak in opposition. Phil Burkhalter made a motion to approve, which was seconded by Lambert. The motion passed 6-0. BOA20-08-02, Request to reduce required frontage on purposed parcel from 300ft to 200ft and reduce frontage remaining, existing parcel from 300ft to 270ft as shown on plat provided for the properties located at 10 Redmond Circle, Rome, GA 30165, Floyd County Tax Parcel I12036. Applicant/Owner: Kyle Sharpe/ State Mutual Insurance Company. Newell presented the application, staff report and staff recommendation of approval. Kyle Sharp was present to speak on behalf of the application. There was no one present to speak in opposition. Phil Burkhalter made a motion to approve, which was seconded by Byington. The motion passed 6-0. BOA20-08-04, Request to reduce front lot width on tract 8A from 150 ft to 107 feet and reduce front lot width on tract 8B from 150 feet to 92 feet to subdivide parcel for new lot for the property located at 2128 Calhoun Hwy, Rome, GA 30161, Floyd County Tax Parcel K12Z126. Applicant/Owner: Aniceto Ambrocio. Newell presented the application, staff report and staff recommendation of approval. Ambrocio was present to speak on behalf of the application. There was no one present to speak in opposition. Phil Burkhalter made a motion to approve, which was seconded by Lambert. The motion passed 6-0. BOA20-08-05, Requests to increase the allowed sign height to 20 feet tall and allow for a sign that would be 50 square feet instead of 32 square feet for the property located at 1100 Martha Berry Blvd, Floyd County Tax Parcel J13Y345. Applicant/Owner: Hi-Tech Signs/Dr. Stephan LaPointe. Newell presented the application, staff report and staff recommendation of approval. LaPointe was present to speak on behalf of the application. There was no one present to speak in opposition. Williamson made a motion to postpone application and after no second, Williamson then withdrew his motion to postpone. Byington made a motion to approve as staff recommends, which was seconded by Lambert. The motion passed 6-0. ADJOURNMENT: There being no further business to bring before this body, the 16, 2020, meeting of the Board of Adjustments was adjourned by 6-0, at approximately 3:15 p.m.
