Minutes (Draft) Board of Adjustments June 17, 2021 Conducted in the Sam King Room of City Hall and via Zoom 2:30 pm MEMBERS PRESENT: Terry Williamson, Von Lambert, Cameron Abney, Jarrod Johnson, Phil Burkhalter MEMBERS ABSENT: Will Byington, One Vacant Position STAFF PRESENT: Artagus Newell, Brice Wood, Brittany Griffin, James Martin, Frank Beacham, Chris Jackson, Meredith Ulmer PUBLIC PRESENT: Olivia Morley, Marka Palmer, Melani Clements, Greg Gibson, Sherry Bonds, Amanda Swader, Sean Swader, Tommy Cannon, Allan Hagerstrand, Karla Gushue, Alejandro Fonseca, Emmet Woods, Jake Hager WELCOME: Chair Williamson called the meeting to order and welcomed everyone at approximately 2:30 PM DETERMINATION OF QUORUM: A quorum was determined via roll call. REVIEW OF THE MINUTES: Cameron Abney made a motion to approve the May 2021 Minutes, which was seconded by Von Lambert. The motion passed unanimously (3-0). Terry Williamson abstained. APPROVAL OF AGENDA: Von Lambert made a motion to approve the agenda, which was seconded by Phil Burkhalter. The motion passed unanimously (6-0). BOA21-06-01, requests a variance to allow for a seven-foot-tall fence instead of the allowable six feet in height, for the properties located at 0 and 818 S. Broad St, Rome, GA 30161, Floyd County Tax Parcels I14Z084 and I14Z085. Applicant/Owner: Emmet Woods. Brice Wood presented the application, staff report and staff recommendation of denial. Mr. Woods was present to speak on behalf of the application. There was no one present to speak in opposition. Phil Burkhalter made a motion to deny, which was seconded by Cameron Abney. The motion to deny carried with a 4-0 vote. BOA21-06-02, requests a variance to the front setback along E 12th street from 20 feet to 14 feet for the property located at 1200 Dean Ave Rome, GA 30161, Floyd County Tax Parcel J14J343. Applicant/Owner: RGP Ranges LLC, Greg Gibson. Brice Wood presented the application, staff report and staff recommendation of approval. Greg Gibson was present to speak on behalf of the application. There was no one present to speak in opposition. Von Lambert made a motion to approve, which was seconded by Phil Burkhalter. The motion to approve carried with a 4-0 vote. BOA21-06-03, requests a variance to allow for an eight-foot-tall fence instead of the allowable six feet in height for the property located at 45 Yale Road, Rome, GA 30161, Floyd County Tax Parcel K13W029. Applicant/Owner: Alejandro Fonseca. Brice Wood presented the application, staff report and staff recommendation of denial. Alejandro and Jessica Fonseca were present to speak on behalf of the application. Alan Hagerstrand was present to speak in opposition. Members had multiple questions for County Attorney Chris Jackson as to whether the metal structure constituted a fence, wall, etc. Members also had multiple questions for James Martin, Chief Building Official – Phil Burkhalter made a motion to deny which was seconded by Cameron Abney. The motion to deny carried with a 4-0 vote. BOA21-06-04, requests a variance to reduce the road frontage requirement from sixty feet to fifty feet for the property located at 424 Wayside Road, tract two of the survey, Rome, GA 30161, Floyd County Tax Parcel L13X077. Applicant/Owner: Marka Palmer/Khalid Javid. Brice Wood presented the application, staff report and staff recommendation of approval. Marka Palmer was present to speak on behalf of the application. David Kirkland was present to speak regarding some concerns regarding his adjacent property. Staff advised that a surveyor would have to settle any/all boundary disputes. Phil Burkhalter made a motion to approve, which was seconded by Jerrod Johnson. The motion to approve carried with a 4-0 vote. Adjournment Motion to adjourn by Burkhalter. Second by Williamson. Motion carried unanimously.
