L Board of Adjustment Agenda May 19, 2014 The Board of Adjustment will hold its regular meeting on Monday, May 19, 2014 at 5:00 p.m. in the Council Chambers of City Hall. Welcome Visitors 1. A request to review and approve the minutes of the April 28, 2014 Regular Meeting. 2. A Public Hearing requesting approval for variances from the Zoning Code Article XII from the front side and rear setback requirement of 25 feet in an M-1 zone, submitted by Dave Garza of Barrett & Associates on behalf of Bibler Lumber Company, 2401 South Arkansas, as follows: 2a) 24.4-foot variance for a metal building surface shed along South Arkansas Avenue 2b) 4.2-foot variance for a metal building in the north corner of Tract 1 2c) 10-foot variance for the sawmill building by the railroad right-of-way BOARD OF ADJUSTMENT MINUTES May 19 2014 The Russellville Board of Adjustment met in its Regular Meeting, Monday, May 19, 2014, at 5:00 p.m. in the City Hall Council Chambers. Members Present: Chairman Blake Tarpley, Jimmy Sims, Jimmy Davenport, and Wesley White. Members Absent: Secretary Aldona Standridge Visitors/Officials Present: Mayor Eaton, City Planner David Harris, City Attorney Trey Smith, Planning Assistant Lequitta Jones, Building Official Brian Holstein, Jim Lynch/City Corporation, and Dave Garza/Barrett & Associates. WELCOME VISITORS The First Order of Business was a request to review and approve the minutes of the April 28, 2014 Regular Meeting. Member Sims made the motion to approve the minutes as written. Member Davenport seconded the motion and passed unanimously. The Second Order of Business was a Public Hearing requesting approval for variances from the Zoning Code Article XII from the front, side and rear setback requirement of 25 feet in an M-1 zone, submitted by Dave Garza of Barrett & Associates on behalf of Bibler Lumber Company, 2401 South Arkansas, as follows: 2a) 24.4-foot variance for a metal building surface shed along South Arkansas Avenue 2b) 4.2-foot variance for a metal building in the north corner of Tract 1 2c) 10-foot variance for the sawmill building by the railroad right-of-way City Planner Harris said the request was to grant three separate variances to address setback issues at existing buildings. The large shed adjacent to AR7 just north of the main gate is less than a foot from the ROW line, but the problem was created at least in part by AHTD's acquisition of additional ROW several years ago to widen AR7. On the rear of the property are two more existing buildings that do not meet the setback requirement. One is sited adjacent to the D&R Railroad, so you could even make a case that no setback is required. It appears that everything is in order, and that there have been no contacts from any property owners or other citizens opposing the variances. With a sale of the property pending, the petitioners just want to clear up any questions. Member Sims made the motion to approve the three variances as submitted. The motion was seconded by Member Davenport and passed unanimously. Adjourned. ____________________ Chairman Blake Tarpley
