REVISED Town Council Meeting Agenda Pursuant to A.R.S. § 38-431.02 notice is hereby given to the public that the Sahuarita Town Council will hold a meeting at the date and time specified below at the Sahuarita Council Chambers, 375 West Sahuarita Center Way, Sahuarita, AZ. Members of the Town of Sahuarita Council will attend either in person or by telephone conference call. To better serve our community, the Sahuarita Council Chambers is wheelchair accessible. Persons with a disability may request a reasonable accommodation, such as a sign language interpreter, by contacting the Town Clerk’s Office at 520-822-8801. Presentations A. Proclamation declaring April 21, 2019 to be PowerTalk 21® Day. B. Recognition of Sahuarita Middle School students Melissa Gonzalez and Jorge Calvillo by the Rural/Metro Fire Department for quick thinking in an emergency. 6. Approval of Agenda Action recommended: approve the agenda. 7. Call to the Public At this time, any member of the public is invited to address the Town Council on any issue which is on tonight’s Consent Agenda or on any issue which the Town Council can lawfully act upon at a future meeting. Written comments regarding any item on the agenda or on any issue which the Town Council can lawfully act upon may be submitted prior to the beginning of the council meeting for distribution to the Town Council. Pursuant to the Arizona Open Meeting Laws, the Council may not discuss the items, but individual members of the Council may respond to criticism made by those who have addressed the Council, may ask staff to review the matter, or may ask that the matter be placed on a future agenda. 8. Approval of the March 11, 2019 Regular Meeting Minutes. B. Adoption of Ordinance No. 2019-138, amending Chapter 12.25 (Spirituous Liquor on Park Premises) and Chapter 12.40 (Penalties) of Title 12 of the Sahuarita Town Code (Parks and Recreation) relating to consumption and possession of spirituous liquor on Town Parks and Recreation Areas, and classification of penalties for violations of the provisions of Title 12, and repealing all Resolutions, Ordinances, and Rules of the Town of Sahuarita in conflict therewith. C. Adoption of Resolution No. 2019-0588, authorizing the Town to enter into Sahuarita Contract No. 190043, an Intergovernmental Agreement between the Town of Sahuarita, for and on behalf of the Sahuarita Police Department, and the Arizona Department of Homeland Security, for the purpose of receiving grant funds in the amount of $16,800 for equipment purchases, and increase the Town’s law enforcement capacity to combat criminal activity associated with or directly stemming from the international border. The grant is in effect from January 1, 2019 through December 31, 2019 (18-AZDOHS-OPSG- 180423-02). D. Adoption of Resolution No. 2019-0589, authorizing the Town to enter into Sahuarita Contract No. 190042, an Intergovernmental Agreement between the Town of Sahuarita, for and on behalf of the Sahuarita Police Department, and the Arizona Department of Homeland Security, for the purpose of receiving grant funds in the amount of $210,000 for overtime and mileage, and increase the Town’s law enforcement capacity to combat criminal activity associated with or directly stemming from the international border. The grant is in effect from January 1, 2019 through December 31, 2019 (18-AZDOHS-OPSG- 180423-01). E. Approval of the Final Plat for Quail Creek Unit 35B (Case No. SA12-18-00016). 9. Possible adoption of Resolution No. 2019-0585, granting a license agreement for right-of-way encroachment to SICAN, Inc., as trustee for Community Water Company of Green Valley Row Trust, Sahuarita Contract No. 190040, for the purpose of allowing SICAN, Inc., as trustee for Community Water Company of Green Valley Row Trust, access to install and maintain a water delivery pipeline located in the Town of Sahuarita’s right-of-way, and possible adoption of Resolution No. 2019-0586, granting a license agreement for right-of-way encroachment to FICO CAP Line, LLC and Freeport-McMoRan Sierrita, Inc., Sahuarita Contract No. 190041, for the purpose of allowing FICO CAP Line, LLC and Freeport-McMoRan Sierrita, Inc., access to install and maintain a water delivery pipeline located in the Town of Sahuarita’s right-of-way and a discussion of both projects. Action recommended: adopt the resolutions. 10. Discussion and possible appointment to the Board of Adjustment. Action recommended: pleasure of the Council. 11.
