REGULAR MEETING OF THE COMMON COUNCIL

Mayor Magiera called the meeting to order at 7:00 PM. After the Pledge of
Allegiance, Mayor Magiera asked for a moment of silence in memory of former Fire
Chief Robert DeGaine.
Moved by Hill and seconded by Johnson:
RESOLVED: That we hereby approve and dispense with the reading of the
minutes of the last regular meeting of November 8, 2023, with the following change on
page one, “EXCUSED: Council Member Koch”.

Moved by Johnson and seconded by Smith:
RESOLVED: That we hereby appoint Joseph Gray, Olean, NY, Patrick Steffan,
Olean, NY, and Travis Whitehouse, Great Valley, NY, from the Civil Service eligible
list to the position of Fire Lieutenant with 26 weeks probation and salary in accordance
with the terms of the current Union Contract, effective November 30, 2023.
Council Member Koch noted that she asked to separate the resolution for Kyle
Gross, due to the City’s Code of Ethics states she should not vote for a family relative.
She noted she is in favor of the promotion but will abstain because he is her nephew.

RESOLVED: That we hereby appoint Kyle Gross, Little Valley, NY, from the
Civil Service eligible list to the position of Fire Lieutenant with 26 weeks probation and

Resident Jodi Clark asked if there is a residency requirement. It was noted that
there is not for Firefighters however, there is a preferred given to Salamanca residents
when hired. The Fire Lieutenant’s positions are promotional for officers already
employed in the Department.
Moved by Koch and seconded by Hill:
RESOLVED: That we hereby confirm the Salamanca Housing Authority
appointment of Justin Farnham as Lead Maintenance Mechanic, effective November
10, 2023, at 37.5 hours per week with a wage of $19.50 per hour, plus benefits.

RESOLVED: That we hereby confirm the Salamanca Housing Authority
approval to set the annual salary of Tracy Fuller-Meek, Housing Manager to $65,000.00,
effective November 10, 2023.
Council Member Reed stated he is not in favor of backdating this change.
Council Member Koch noted that when Mrs. Fuller-Meek was promoted the
SHA did not fill the position she left and she has been doing both jobs.
SHA Board Member Julie Hamacher noted that this change in positions saved
the SHA approximately $50,000 annually.
There was a consensus of the Council to approve this retroactive to November
10, 2023.

RESOLVED: That we hereby confirm the dismissal of Department of Public
Works Part Time Laborer Ryan Smith and Part time Laborer Jerome Strang, both

RESOLVED: That we hereby accept the quote of Rock City Chrysler Jeep
Dodge, Little Valley, NY for the purchase of one new 2023 Dodge RAM 5500 dump
truck, for the Department of Public Works, under NYS Office of General Services bid #
PC68929, in the amount $134,770, with a discount of $4,114.00 for a total cost of
$130,656.00, as approved in the 2023-2024 City Budget.

RESOLVED: That we hereby accept the quote of Fleet Maintenance, Inc., West
Seneca, NY for the purchase of one new 2024 Freightliner M2 106 Plus single axle
truck, for the Department of Public Works, under NYS Office of General Services bid #
PC68935, in the amount $266,028.00, with a discount of $51,952.00 for a total cost of
$214,076.00, as approved in the 2023-2024 City Budget.

RESOLVED: That we hereby accept the quote of HUNT Engineers,
Horseheads, NY for engineering services approved November 2022, for the culvert
replacement on Front Avenue over Titus Creek, to convert to a bridge replacement, for
additional engineering fees, for a total cost of $38,000.00.
Resident Jodi Clark noted that Front Avenue is a Federal Aid Highway. Mayor
Magiera noted that the City is working with the Seneca Nation of Indians. Grant Writer
Brundage explained that the project was started as a culvert replacement and the SNI
suggested changing to a bridge to receive additional funds. There was some discussion
regarding the lack of assistance from the NYS DOT on City roads.

RESOLVED: That we hereby approve the closing of certain streets for the
Silver Bells Santa’s Christmas Parade to be held Saturday, December 2, 2023.
Mayor Magiera requested the West end of Clinton Street be closed and direct
traffic to South Main Street.

WHEREAS, by reason of immunity from Real Property Taxes of the Seneca Nation of
Indians, it is necessary for the City Assessor to identify and verify such immunity and
remove such properly immune property owners from the County Tax Roll, the City Tax
Roll, the School Tax Roll and the Indian Lease Roll.
WHEREAS, in preparing the 2019 to 2021 County Tax Roll, the 2019 to 2021 Indian
Lease Roll, the 2019 to 2021 City Tax Roll and the 2019 to 2021 School Tax Roll
property has continued to change ownership or change exemption status on property
already owned and now there is a need to cancel such Tax Bills, and
WHEREAS, the following is a list of Tax Bills that need to be cancelled.
NOW THEREFORE BE IT RESOLVED: that upon the action of the Common Council,
the City Comptroller is authorized and directed to cancel the below list of Taxes

unpaid taxes and the taxes owned need to be removed from the computer system.

WHEREAS, pursuant to Title XVI, Section 182-b of the City Charter of the
City of Salamanca, the Common Council may by resolution relieve the Comptroller
from the obligation of selling tax sale certificates pertaining to certain estates and land,
when in the judgment of the Common Council the benefit to the City of protecting and
preserving its tax base exceeds the benefit of selling a tax sale certificate at tax sale, and
WHEREAS, the Common Council has determined that the benefit to the City of
protecting its tax base exceeds the benefit to the City of selling tax sale certificates as to
the properties on a list generated by December 31, 2023.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The City Comptroller is hereby relieved of the obligation to sell tax sale
certificates at the annual tax sale for the properties listed by December 31, 2023.
2. All unpaid taxes are hereby moved to tax pending status and the City
Comptroller is directed to send out all the proper notifications and required legal
advertisements.
3. This resolution shall take effect immediately.
Council Member Koch noted she will be voting no, as she feels the City should
hold the annual tax sale.

Council Member Koch stated that Police Commission recommended adding this
position, instead of filling to position with full time Police Officers at an overtime wage
and Officers can then be out patrolling rather than at dispatch.

Communications from the Mayor and Council:
Council Member Hill would like to say congratulations to the Salamanca
Varsity Football team for making it as far as they did and it was a great season.
He noted it was great to see all the people out at the games and congratulations
to the cheerleaders too. Council Member Koch noted it brought the community
together and noted the team and the coaches did an excellent job.

Council Member Koch stated congratulations to the four Fire Lieutenants that
were promoted tonight. She noted she is sorry she could not vote for Lieutenant
Gross but she does support him. She thanked the gentleman for risking their
lives as a Firefighter.
Mayor Magiera noted that the new Salamanca Fire Truck made its debut in the
Lancaster Christmasville Firetruck Parade. The truck was in that area and was
asked to participate. Fire Chief Sturdevant noted that when the truck is back to
the station the Council can take a look at it. They also noted the Salamanca
High School Wrestling team had a photo taken to be in the school’s calendar.
Council Member Hill also thanked the Fire Department for assisting with the
two parades for the football team.

RESOLVED: That the bills be paid as warranted and recommended by the
appropriate Commissions and/or Department Heads, the City Comptroller and City
Clerk and that the reports of the City Clerk, Fire Chief, Police Chief and Dog Control

Public Discussion:
Julie Hamacher asked who was on the Charter Commission. Mayor Magiera
stated she appointed a committee between 9 and 15 members. She listed City
residents that were members. It was noted that prior to it being placed on the
election ballet, newspaper articles were published, there were posts on Facebook
and a webpage was created. Mayor Magiera noted there were certain rules that
needed to be followed. There was some discussion regarding some of the changes
made. Mrs. Hamacher noted she was disappointed with the election voter numbers
being low and that voters did not know what they were voting on. Mayor Magiera
stated that the rules required the Charter Commission to complete the amended
Charter within two years and present it for vote by the second General Election.
Clerk Chamberlain stated there was a deadline that the entire Charter document
had to be provided to the Board of Elections, but did not know the requirement for
them. She thought the document would have been available at each polling place.
Jodi Clark noted she feels that notices should have been sent to the residents.
Mayor Magiera stated that there were not any major changes made, it mostly
removed things that no longer pertained. There was some discussion regarding
City employee wages. It was noted that the amended Charter was not required to
be voted on by the Common Council, it was to be voted on by the residents. There
was discussion regarding the Board Members being absent from regular meetings.
Mrs. Hamacher noted she is not criticizing anyone, she was looking for
clarification on changes to the Charter and commends everyone that worked on it
for two years. It was a surprise to her that it was up for a vote.
Jodi Clark stated she is a member of the Seneca and Salamanca Mothers Against
Drug (SSMAD). She noted one of their concerns are the amount of homeless
people in the City. Council Member Koch noted that she was informed there are
approximately 30 homeless within the City. Ms. Clark noted SSMAD is
concerned with what is going to happen to these people when there is a “Code
Blue” due to cold weather. They are trying to find out what agencies handle
