After the Pledge of Allegiance, Mayor Magiera asked for a moment of silence. Moved by Smith and seconded by Johnson: RESOLVED: That we hereby approve and dispense with the reading of the minutes of the last regular meeting of May 14, 2025. Adopted Ayes: Johnson, Smith, Reed, Myers Abstain: Hill Nays: None Moved by Reed and seconded by Smith: RESOLVED: That we hereby authorize the City Clerk to issue a Fireworks Permit to Seneca Gaming Corporation and Starfire Corporation for a firework display to be held on Saturday, July 5, 2025 (rain date July 7, 2025) at dusk pending the approval of the site by the Police Chief, Fire Chief and Building Code Inspector. It was noted the proper proof of liability insurance and a Federal Explosives License/Permit has been submitted to the City Clerk. Council Member Smith stated it is nice that they do this. Adopted Ayes: Hill, Johnson, Smith, Reed, Myers Nays: None Moved by Johnson and seconded by Reed: WHEREAS, New York State Homes and Community Renewal (HCR) has established the Pro-Housing Community Program to support municipalities that are actively working to remove barriers to housing growth and expansion; and  REGULAR MEETING OF THE COMMON COUNCIL MAY 28, 2025 PAGE TWO WHEREAS, the City of Salamanca recognizes the need to expand housing opportunities to support current residents, attract new residents, revitalize underutilized properties, and sustain long-term economic vitality; and WHEREAS, participation in the Pro-Housing Community Program may improve the City’s eligibility and competitiveness for various state grant programs and economic development initiatives; NOW, THEREFORE, BE IT RESOLVED that the City Council of Salamanca does hereby: 1. Adopt and affirm the Pro-Housing Community Resolution language as required by New York State Homes and Community Renewal without modification. 2. Commit to submitting all necessary documentation in support of the City’s application under Option 2, including zoning maps, zoning code summary, and housing permit data from 2018–2022. 3. Designate the City Administrator to serve as the primary contact for all communications related to the Pro-Housing Community certification process. This resolution shall take effect immediately. Adopted Ayes: Hill, Johnson, Smith, Reed, Myers Nays: None Moved by Myers and seconded by Smith: RESOLVED: That we hereby request the New York State Department of Transportation (NYS DOT) to do a traffic study, to consider a round-about, at the intersection of Route 219 (Central Avenue) and East State Street in the City of Salamanca, as recommended by the Police Commission. Council Member Myers stated this was discussed at the Police Commission meeting. The intersection is a hot spot and it is tough to see traffic when entering Central Avenue from the west off of East State Street. The Police Commission feels a round- about would help reduce the amount of accidents. Past studies did not warrant a traffic light. Council Member Myers noted this is to fill an open position and Sergeant Sandy does a good job for the City and feels he will do a better job. Adopted Ayes: Hill, Johnson, Smith, Reed, Myers Nays: None Moved by Myers and seconded by Smith: RESOLVED: That we hereby appoint the following as full-time Police Officers from the Civil Service eligible list, according to the current union contract with up to 52 weeks probation: • Austin Manna, Little Valley, NY effective May 31, 2025 • Cheyne Jimerson, Versailles, NY, to attend the Police Academy, effective June 21, 2025. Adopted Ayes: Hill, Johnson, Smith, Reed, Myers Nays: None Moved by Reed and seconded by Myers: RESOLVED: That we hereby approve authorize the Salamanca Board of Public Utilities to secure financing through a bond to purchase a 2025 Camel Max 1200 Ejector/Sewer Cleaner (Vacuum Truck) from Cyncon Equipment, in the amount of $515,059.00.  REGULAR MEETING OF THE COMMON COUNCIL MAY 28, 2025 PAGE FOUR General Manager Hensel noted the vehicle carries water as well as having a vacuum holding tank. The Environment Protection Agency (EPA) has done inspections with violation at the pump stations requiring the BPU to use a vac truck. Adopted Ayes: Hill, Johnson, Smith, Reed, Myers Nays: None Under Communications from the Mayor and Council: • Mayor Magiera welcomed City resident Diane Bach. • The Memorial Day service was held at the Salamanca American Legion. • The City is working on the Summer Fest to be held Saturday, July 12, 2025. • The Salamanca City School Senior Parade will be held on June 25th at 5:30 PM, this is the day of a regular Common Council Meeting. The Council Members hope to arrive for the 7:00 start. There was some discussion regarding the BPU lower cost hydroelectric through New York Municipal Power Authority (NYMPA). It was explained that the number of jobs in the community help NYMPA to determine what portion of the low-cost electric is applied to the BPU. Ms. Clark asked if there is a way to report the number of jobs in the community that are not recorded through employee taxes. There was also discussion regarding the closing of the Rite Aid store. Ms. Clark asked about if there will be a procedure established for the surveillance cameras with regard to the users, installers and FOIL requests. It was noted the City has a legal agency that assists with the recreation of policies and procedures. BPU General Manager Hensel noted BPU and SNI representatives meet with the NYS Department of Conservation (DEC) regarding the levy system and pump stations. The NYS DEC will provide a report with a plan on upgrades that are needed. Council Member Smith noted there will be free community movie nights offered in the Jefferson Street Park on Saturday evenings, depending on weather.
