City of Salem Zoning Board of Appeals Meeting Minutes May 15, 2024 A meeting of the Salem Zoning Board of Appeals (“Salem ZBA”) was held on Wednesday, May 15, 2024 at 6:30 pm via remote participation in accordance with Chapter 2 of the Act of 2023 and a Special Act extending remote participation meetings. Chair Nina Vyedin calls the meeting to order at 6:35 pm. Chair Vyedin explains how individuals can participate in the meeting remotely via Zoom, and that instructions to participate remotely can also be found on the Salem website. Ms. Vyedin also explains the rules regarding public comment. ROLL CALL Those present were: Nina Vyedin, Paul Viccica, Ellen Simpson, Hannah Osthoff, and Stephen Larrick. Also in attendance were Daniel Laroe – Staff Planner, Voula Orfanos — Acting Zoning Officer, and Jonathan Pinto – Recording Clerk. Those absent were: Carly McClain MEETING MINUTES April 17, 2024 Ms. Osthoff states she has one suggested edit, noting that on the Maitland Farms petition, the standard condition numbering is inaccurate. Mr. Viccica states that for the 30 Northey Street application, the special condition should replace the word “present” with “represent”. Motion and Vote: Mr. Viccica motions to approve the minutes from the April 17, 2024 meeting of the Zoning Board of Appeals, as amended. Ms. Osthoff seconds the motion. The vote is five (5) in favor and none (0) opposed. The motion passes OLD/NEW BUSINESS Extension of Variances at 266, 282, 286, and 282R Canal Street and 2 Kimball Court Chair Vyedin introduces the matter, noting the extension request would be through January 12, 2025. Chris Koeplin introduces himself and discusses the requested extension. Mr. Koeplin explains that the building at the site was demolished and that they are still in the process of obtaining building permits. Chair Vyedin opens the floor to public comment but there is none. City of Salem Zoning Board of Appeals May 15, 2024 Meeting Minutes Motion and Vote: Ms. Osthoff motions to approve the variance extension at 266, 282, 286, and 282R Canal Street and 2 Kimball Court through January 12, 2025. Mr. Viccica seconds the motion. The vote is five (5) in favor, and none (0) opposed. The motion passes Extension of Special Permit at 6 Lathrop Street Chair Vyedin introduces the matter. Kristin Kolick introduces herself on behalf of the petitioner, and notes that Michael Buonfiglio is also present. Ms. Kolick describes the extension request for a Special Permit to convert a two- family home to a three-family home. The original Board decision was granted in December 2021, and pursuant to a full 18-month demolition delay, and extension was granted in September 2023. Ms. Kolick explains that since applying for building permits, the petitioner discovered they had to go before the Conservation Commission and received an order of conditions in April. Therefore, the petitioner requires more time and is seeking an extension to November 17, 2024. Chair Vyedin opens the meeting to public comment but there is none. Motion and Vote: Mr. Viccica motions to approve the Special Permit extension at 6 Lathrop Street through November 17, 2024. Ms. Simpson seconds the motion. The vote is five (5) in favor, and none (0) opposed. The motion passes Next Meeting June 12, 2024 ADJOURNMENT Motion and Vote: Mr. Viccica motions to adjourn the meeting. Ms. Osthoff seconds the motion. The vote is all in favor. The motion passes. The meeting ends at 6:50 PM on May 15, 2024. Members of the public will be asked to use the virtual “Raise Hand” function in Zoom to indicate that they would like to provide comment. • Dial *9 on your phone’s dial pad to raise your hand if you are using the toll-free number. • Click the “Raise Hand” button if you are using the Zoom application on your computer or phone. ROLL CALL II. REGULAR AGENDA *Revised to remove the application of 50 Circle Hill Road* 1. Location: 50 Circle Hill Road (R2 Zoning District) Applicant: Pasquanna Developers, Inc. Description: The petition of PASQUANNA DEVELOPERS, INC. at 50 CIRCLE HILL ROAD (Map 9, Lot 256) (R1 Zoning District). This is a refiling for a Variance from Section 4.1.1 Dimensional Requirements of the Salem Zoning Ordinance to construct two (2) single-family dwellings on five (5) separate and contiguous land court parcels. One proposed dwelling will meet the requirements of the Salem Zoning Ordinance for R1 Zoning. The other dwelling will be constructed at 10,788 square feet.
