PUBLIC HEARING ID#15-435 Appeal of Planning Commission Decision to Deny Conditional Use Permit 2015-016 Upon motion by Councilmember Lutes, second by Councilmember Craig, the City Council adopted Resolution 20865 approving a Conditional Use Permit CUP 2015-016 to establish and operate an alcohol related use consisting of an off-sale beer and wine license (Type 20) at an existing service station with convenience store use (Valero) located at 215 East Alisal Street. The motion failed by the following vote: Ayes: 2- Councilmember Castañeda and Councilmember De La Rosa Noes: 5- Councilmember Barrera, Councilmember Lutes, Councilmember McShane, Councilmember Craig and Mayor Gunter CONSIDERATION ID#15-343 Sidewalk Ordinance Update Introduce Ordinance adding additional sections to Article I, Chapter 30 of the City Code to codify maintenance and repair responsibility for City sidewalks to the abutting property owner, and shift liability for injuries occurring on City sidewalks to the responsible property owner. ID#15-383 2nd reading, Deconstruction, Demolition and Construction Material Recovery and Diversion from Landfills. Introduced an Ordinance amending Chapter 9 of the City Code to provide for “Deconstruction, Demolition and Construction Material Recovery and Diversion from Landfills.” Enactment No: ORD 2566 CONSENT AGENDA ID#15-438 Financial Claims Approved financial claims report. Ayes: 7- Councilmember Barrera, Councilmember Castañeda, Councilmember De La Rosa, Councilmember Lutes, Councilmember McShane, Councilmember Craig and Mayor Gunter ID#15-388 Salinas Police Department Parking Lot Masonry Wall and Fencing; Project No. 9119 Upon motion by Councilmember Craig, second by Councilmember McShane, the City Council adopted Resolution 20866 rejecting all bids received for the Salinas Police Department Parking Lot Masonry Wall and Fencing; Project No. 9119. The motion carried by the following vote: Ayes: 7- Councilmember Barrera, Councilmember Castañeda, Councilmember De La Rosa, Councilmember Lutes, Councilmember McShane, Councilmember Craig and Mayor Gunter Enactment No: RES 20866 ID#15-390 Sublease of 115-125 East Lake Street: Chinatown Health Services Center City of Salinas Page 2 City Council Meeting Minutes - Final November 3, 2015 Upon motion by Councilmember De La Rosa, seconded by Councilmember Craig, the City Council adopted Resolution 20867 authorizing the Mayor to execute a Sublease with the Franciscan Workers of Junipero Serra for the development and operation of the Chinatown Health Services Center at 115-125 East Lake Street. The motion carried by the following vote: Ayes: 7- Councilmember Barrera, Councilmember Castañeda, Councilmember De La Rosa, Councilmember Lutes, Councilmember McShane, Councilmember Craig and Mayor Gunter Enactment No: RES 20867 ID#15-416 Fire Station No. 5 Expansion, Project No. 9235 Upon motion by Councilmember Lutes, second by Councilmember Craig, the City Council adopted Resolution 20868 approving plans and specifications for the Fire Station No. 5 Expansion, Project No. 9235; and Authorize issuance of invitation to bid, with bids to be opened on December 1, 2015. The motion carried by the following vote: Ayes: 7- Councilmember Barrera, Councilmember Castañeda, Councilmember De La Rosa, Councilmember Lutes, Councilmember McShane, Councilmember Craig and Mayor Gunter Enactment No: RES 20868 ID#15-434 Modification to the Classification/Salary Schedule and Workforce Allocation change for the Community Development Department Upon motion by Councilmember Craig, second by Councilmember McShane, the City Council adopted Resolution 20869 adding the position of Administrative Fire Captain to the Classification/Salary Schedule at the salary range of 51.1; adding the position of Computer Systems Administrator to the Classification/Salary schedule at the salary range of 50.7; and modifying the workforce allocation to the Community Development Department and accordingly approve the modification to the Classification and Salary Schedule. The motion carried by the following vote: Ayes: 6- Councilmember Barrera, Councilmember De La Rosa, Councilmember Lutes, Councilmember McShane, Councilmember Craig and Mayor Gunter Noes: 1- Councilmember Castañeda Enactment No: RES 20869 ID#15-415 El Dorado Park Improvements Project No. 9670 Upon motion by Councilmember Craig, second by Councilmember Lutes, the City Council adopted Resolution 20870 accepting the El Dorado Park Improvements, City C.I.P. Project No. 9670, for maintenance and responsibility. The motion carried by the following vote: Ayes: 7- Councilmember Barrera, Councilmember Castañeda, Councilmember De La Rosa, Councilmember Lutes, Councilmember McShane, Councilmember Craig and Mayor Gunter Enactment No: RES 20870 City of Salinas Page 3 City Council Meeting Minutes - Final November 3, 2015 ID#15-436 Donation of Surplus Fire Apparatus to City of Quiroga, Michoacan, Mexico Upon motion by Councilmember McShane, second by Councilmember De La Rosa, the City Council adopted Resolution 20871 authorizing the donation of two (2) surplus fire apparatus to the City of Quiroga, Michoacan, Mexico. The motion carried by the following vote: Ayes: 7- Councilmember Barrera, Councilmember Castañeda, Councilmember De La Rosa, Councilmember Lutes, Councilmember McShane, Councilmember Craig and Mayor Gunter Enactment No: RES 20871 COUNCILMEMBERS’ REPORTS, APPOINTMENTS AND FUTURE AGENDA ITEMS Councilmember Craig announced she has an opening for in the Library and Community Services Commission if anyone is interested in serving in that capacity representing District 5. Councilmember Barrera announced upcoming community events. Councilmember De La Rosa appointed Elizabeth Ana Ambriz to the Library and Community Services Commission and appointed Anthony Rocha to the Youth Advisory Commission. Councilmember Castaneda appointed Natalie Mendoza to the Youth Advisory Commission. He requested a report on the City’s sales tax measure and how it will impact the proposed sidewalk ordinance shifting liability to property owners. Councilmember Castaneda further requested looking at the sidewalk repair program and consider increasing future funding. He additionally requested the City consider declaring a state of emergency to address the homeless and a winter warming shelters. Councilmember McShane requested an update on the timeline for construction of the new police station. He additionally requested an update on the proposed Transportation Agency for Monterey County proposed transportation tax. Mayor Gunter announced that on the upcoming Veterans Day Parade and festivities and announced there will be a community meeting to discuss an ordinance relating to Medicinal Marijuana in the Rotunda.
