City of Salinas Page 1 City Council Meeting Minutes - Unofficial April 26, 2022 PUBLIC HEARINGS ID#22-137 City Development Impact Fees Annual Adjustment Received report from City Engineer Adriana Robles requesting the City Council approve a Resolution adjusting the City development impact fees by 8% to become effective July 1, 2022. The increase is based on the Engineering News Record (ENR) construction cost index (CCI) increase over the last year, which is consistent with the fee ordinance (Salinas Municipal Code Chapter 9, Article V). The updated Schedule of Fees and Charges are effective 60 days after City Council approval on July 1, 2022. MOTION Councilmember Barrera moved to approve the City-wide Schedule of Fees and Service Charges as recommended by the Finance Committee at a 2.5% increase. Motion was second by Councilmember Osornio. Upon motion by Councilmember Barrera, seconded by Councilmember Osornio, Resolution authorizing adjustments and additions to the City-Wide Schedule of Fees and Service Charges as recommended by the Finance Committee at 2.5% effective July 1, 2022 was approved as amended. The motion carried by the following vote: Ayes: 6- Councilmember Barrera, Councilmember Cromeenes, Councilmember Gonzalez, Councilmember Osornio, Councilmember Rocha and Mayor Craig Absent: 1- Councilmember McShane Enactment No: RES 22343 ID#22-208 Zoning Code Amendment 2022-002; An Ordinance Amending Various Sections of Chapter 37 of The Municipal Code (Zoning Code) to Allow a City of Salinas Page 2 City Council Meeting Minutes - Unofficial April 26, 2022 School District or Community College District to Acquire, Construct, Rehabilitate, or Preserve Affordable Housing Consistent with the Teacher Housing Act of 2016 Received report from Community Development Director Megan Hunter regarding the Salinas Union High School District (SUHSD) possible acquisition of an empty apartment complex to provide affordable housing for teachers and school employees. Existing regulations restricting large employer housing would not allow the school district to acquire property for this use.Mrs. Hunter added that as outlined in various plans such as the Salinas Plan and Housing Element, the City has a vested interest in increasing affordable housing and the passage of the Teacher Housing Act of 2016, will allow districts to facilitate the acquisition, construction, rehabilitation, and preservation of affordable housing. Staff recommends that City Council adopt Zoning Code Amendment (ZCA 2022-002) to eliminate current restrictions on employee housing for a school district or community college district consistent with the Teacher Housing Act 2016. ZCA 2022-002 includes provisions to minimize displacement, the school or community college district would be subject to notification and relocation assistance requirements and would be subject to the regulations and standards of the underlying zoning district. Zoning Code Amendment 2022-002 (ZCA 2022-002) categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15305 and introduce Ordinance amending Chapter 37 of the Salinas Municipal Code (Zoning Code) to allow a school district or community college district to acquire, construct, rehabilitate, or preserve affordable rental housing for its staff or public consistent with the Teacher Housing Act of 2016. ID#22-204 Ordinance Adding Sections to Chapter 27 of the Salinas Municipal Code Pertaining to Military Equipment Received report from Salinas Police Chief Roberto Filice regarding Assembly Bill 481 (AB 481 or the Bill), codified in Government Code sections 7070 through 7075 which requires a law enforcement agency (LEA) to obtain approval from the applicable governing body prior to the funding, acquisition, or use of “Military Equipment” as defined by the Bill. Staff recommends that the City Council adopt the proposed Military Equipment ordinance and policy in order to allow the department to continue acquiring and utilizing vital equipment specified therein. CONSIDERATION ID#22-227 Financial Policies Amendments & Reserve Balance Recommendations City of Salinas Page 3 City Council Meeting Minutes - Unofficial April 26, 2022 Received report from Finance Director Mark Roberts regarding reserve policy amendments and reserve balance levels recommended to ensure the City is able to withstand unexpected financial emergencies, such as those which may result from natural disasters, economic downturns, or unanticipated expenditures of a non-recurring nature, and to accumulate funds for large-scale purchases. Additions to the City’s budget policies are recommended to ensure facilities and infrastructure maintenance and repair needs are consistently addressed in the City’s annual budgets. Upon motion by Councilmember Cromeenes, seconded by Councilmember Osornio, Resolution authorizing the amendment of City of Salinas Financial Policies, Reserve Policies, Operating Budget Policies, and establishment of various appropriation reserve balances was approved. One component of the measure requires the Salinas Fire Department and the Salinas Police Department to present a plan outlining public education and enforcement efforts to address illegal fireworks use during the Fourth of July holiday. The plan is multifaceted and includes education, enforcement, and response elements. No action required. The motion carried by the following vote: Ayes: 6- Councilmember Barrera, Councilmember Cromeenes, Councilmember Gonzalez, Councilmember Osornio, Councilmember Rocha and Mayor Craig Absent: 1- Councilmember McShane Enactment No: RES 22351 COUNCILMEMBERS’ REPORTS, APPOINTMENTS AND FUTURE AGENDA ITEMS Councilmember Rocha reported that Community Human Services (CHS) hired a Development Director and will be hiring additional staff. On Thursday, April 25, 2022, there will be a Climate Action Workshop as part of a General Plan Update. Councilmember Rocha expressed concerned regarding the Non-Disclosure Agreement and would like to have that item be added as a future agenda item. Request was seconded by Councilmember Barrera. City of Salinas Page 6 City Council Meeting Minutes - Unofficial April 26, 2022 Councilmember Cromeenes reported she attended the El Día Del Nino event at Salvation Army and the Amor Salinas celebration. Councilmember Gonzalez reported that she attended a Cannabis Subcommittee meeting. She invited the City Council and general public to attend an event organized by the Homeless Union on Wednesday, April 25th in Chinatown. Councilmember Gonzalez announced she attended a Public Safety Meeting last week and invited the community to attend a joint District 1 and District 4 Budget meeting. Councilmember Barrera announced that he would not be present during the May 17th Study Session and the May 24th City Council meeting. Councilmember Barrera stated that on November 16, 2021, he had voted to support the conversion of Sanborn Inn and Salinas Inn to permanent supportive housing; however, he stated that he would like to change his vote to a "no" vote as a symbol of support for the community group that was uninformed on the project. Councilmember Osornio extended an invitation to 13th Annual Asian Festival on Saturday, April 30th. Mayor Craig stated that the recent Taylor Farms fire caused 1300 jobs to be put on hold. She added that Mr. Bruce Taylor is committed to rebuild in Salinas within a year. She added that she and Councilmember Osornio are part of the City/County Joint Memorandum of Understanding Subcommittee. In closing, she reported that she participated in a walkthrough with Councilmember Osornio and City Manager Steve Carrigan of the Youth Center and the Alisal Vibrancy Plan and expressed concern regarding the existing infrastructure.
