CONSENT ITEMS 12.1 MOTION - CONTRACT AWARD - TRANSIT SERVICE EVALUATION AND PLANNING ASSISTANCE RECOMMENDATION: It is recommended by the Transportation and Public Works Department that the Council, by motion, award a contract for Transit Service Evaluation and Planning assistance to Nelson\Nygaard Consulting Associates, Inc., in the amount of $129,378. City of Santa Rosa Regular Meeting Agenda and Summary Report Page 5 of 11 CITY COUNCIL OCTOBER 7, 2014 Funding for this contract has been appropriated to charge 120205-5320. The sources of these funds are the federal Surface Transportation Program and state Transportation Development Act Article IV. No City General Fund money is used in this procurement. Attachments Staff Report Attachment 1 12.2 RESOLUTION - APPROVAL OF AMENDMENT NO. 2 TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF SANTA ROSA AND UNIT 2 - FIREFIGHTING REPRESENTED BY INTERNATIONAL ASSOCIATION OF FIREFIGHTERS, IAFF, LOCAL 1401 RECOMMENDATION: It is recommended by the City’s Negotiating Team and the City Manager that the Council by resolution approve an amendment to the Memorandum of Understanding between the City of Santa Rosa Firefighters, Local 1401 for and on behalf of the employees in the City’s Unit 2 - Firefighting for the period of October 15, 2013 through June 30, 2016, which aligns the City with the California Vehicle Code requirements for fire equipment drivers and corrects an erroneously omitted tentative agreement from the adopted memorandum of understanding. It is further recommended that Council authorize the Mayor to execute the amendment. Attachments Attachment Staff Report Resolution Exhibit 13. REPORT ITEMS 13.1 REPORT - AUTHORIZING ENROLLMENT IN SONOMA CLEAN POWER AND DELEGATING SIGNATURE AUTHORITY FOR ENERGY ACCOUNTS AND PROGRAMS BACKGROUND: In July 2014, the City Council approved joining Sonoma Clean Power (SCP), allowing SCP to provide electricity service within the City’s jurisdiction in Phase 2 (beginning December 2014). By law, all accounts are automatically enrolled, but there is no charge to “opt-out” City of Santa Rosa Regular Meeting Agenda and Summary Report Page 6 of 11 CITY COUNCIL OCTOBER 7, 2014 (return to PG&E) during the eligibility period (November 2014 through February 2015). After February 2015, the City can still “opt-out” but must pay $25 per account to do so. Staff examined SCP and PG&E renewable portfolios, rates, projected costs, and greenhouse gas (GHG) emissions to determine which City accounts, if any, to “opt out” of SCP before the eligibility period ends. RECOMMENDATION: It is recommended by the City Manager that Council, by resolution, authorize enrollment of the City’s electricity accounts in Sonoma Clean Power “CleanStart” service and delegate authority to the City Manager and/or his designee to submit, approve and execute power provider applications and agreements for energy accounts and incentive/assistance programs. Attachments Staff Report Attachment 1 Attachment 2 Attachment 3 Attachment 4 Resolution Presentation PDF 13.2 REPORT - SIXTH AMENDMENT TO COOPERATIVE AGREEMENT TO IMPLEMENT ENERGY INDEPENDENCE PROGRAM BACKGROUND: On August 2, 2005 the Santa Rosa City Council adopted Resolution No. 26341 which has established Greenhouse Gas Reduction goals of 20% from 2000 levels for internal operations by 2010 and 25% from 1990 levels by 2015 for community-sourced emissions. On April 14, 2009, City Council adopted Resolution No. 27342 assenting to the City of Santa Rosa’s participation and inclusion in the Sonoma County Energy Independence Program, (SCEIP) with conditions requiring a re-examination of the allocation of the carbon and renewable energy credits attributable to the participation of Santa Rosa residents and businesses. The Santa Rosa property owners participating in SCEIP assign these credits to the County of Sonoma, the Sonoma County Water Agency and City of Santa Rosa Regular Meeting Agenda and Summary Report Page 7 of 11 CITY COUNCIL OCTOBER 7, 2014 the Sonoma County Transportation Authority pursuant to SCEIP documents. Follow up discussions to this letter have been protracted due to the complexity of the issue, the lack of clarity surrounding the creation and use of carbon credits, the expanded effort to include other Sonoma County participating cities, and competing priorities in the City Manager’s Office. RECOMMENDATION: It is recommended by the City Manager’s Office that the Council, by resolution, approve the Sixth Amendment to the cooperative agreement to participate in Sonoma County Energy Independence Program (SCEIP) for another year. During that time, revised language pertaining to the disposition of the environmental credits earned from SCEIP financed projects to include all participating jurisdictions may be finalized. Attachments Staff Report Attachment 1 Attachment 2 Attachment 3 Resolution Exhibit A 13.3 REPORT - AMENDMENT TO THE CLASSIFICATION AND SALARY PLAN TO REORGANIZE THE FIRE PREVENTION DIVISION OF THE FIRE DEPARTMENT BACKGROUND: In April 2014, as part of an ongoing reorganization of the Fire Department’s Fire Prevention Division, Council approved the conversion of a vacant Senior Fire Inspector position to a new Division Chief Fire Marshal position. In continuing the reorganization of the Fire Prevention Division and in servicing Article 25.8 of the current contract between IAFF L-1401 and the City of Santa Rosa, vacant Senior Fire Inspector positions will attrite to a supervisory job classification of Assistant Fire Marshal. An Assistant Fire Marshal classification would be responsible for performing supervisory and technical duties in the areas of fire inspection City of Santa Rosa Regular Meeting Agenda and Summary Report Page 8 of 11 CITY COUNCIL OCTOBER 7, 2014 and public fire education and perform investigative work for the Fire Prevention Division. These duties are currently performed by the Senior Fire Inspector classification. The Human Resources Department reviewed the work proposed for the position in order to determine the appropriate classification title, salary and bargaining unit designation. The Fire Inspector classification will perform the full range of technical inspection, public fire education and investigation work at the journey-level which is currently performed by the Fire Inspector I classification. RECOMMENDATION: It is recommended by the Fire Department and the Human Resources Department that the Council, by resolution, amend the Classification and Salary Plan to reorganize the Fire Prevention Division of the Fire Department by: 1) creating the classification of Assistant Fire Marshal; 2) adding two (2) FTE Assistant Fire Marshal positions; 3) eliminating two (2) Senior Fire Inspector positions; and 4) reclassifying three (3) FTE Fire Inspector I positions to three (3) FTE Fire Inspector positions. RECOMMENDATION: It is recommended by the City’s Negotiating Team and the City Manager that the Council, by resolution, adopt the Memorandum of Understanding for and on behalf of the City’s Unit 4 - Support Services; Unit 6 - Professional and Unit 7 - Technical, represented by the Santa Rosa City Employees Association in affiliation City of Santa Rosa Regular Meeting Agenda and Summary Report Page 9 of 11 CITY COUNCIL OCTOBER 7, 2014 with the International Brotherhood of Teamsters (“IBT”) Local Union Number 856 to be effective October 7, 2014 to July 31, 2016. It is further recommended that Council authorize the Mayor to execute the MOU to implement the changes. Attachments Staff Report Attachment Resolution Exhibit Presentation PDF (revised 10/6/2014) 13.5 REPORT - SONOMA COUNTY ROAD TAX MEASURE (This item is being continued to October 14, 2014) BACKGROUND: The County of Sonoma voted on August 12, 2014 to place a one-quarter of one percent general sales tax measure on the March 3, 2015 ballot along with an Advisory Measure specifying the manner in which the sales tax is proposed to be spent. Santa Rosa, as directed by the City Council at a staff briefing, advised the County that the City wished to allocate ten percent (10%) of the City’s share of the revenues to Transit. As a result of polling results, the County elected to place the measure on the ballot as a general sales tax measure which only requires a majority vote with a companion advisory measure instead of a special sales tax which would require a two thirds vote. It is anticipated that the Board of Supervisors will have additional discussions prior to the deadline for submitted a final ballot measure which is on December 5, 2014. RECOMMENDATION: It is recommended by the City Attorney and the Director of Transportation and Public Works that the Council discuss the proposed Sonoma County General Tax for Roads and provide staff with direction, if any. 14.
