RECOMMENDATION: It is recommended by the Finance and Transportation & Public Works Departments that the Council, by motion, approve the Fifth Amendment to Contract F000321 for the final available one-year contract extension to Smothers Parts International, Inc., Santa Rosa, CA in the amount of $100,000 for a total contract amount not to exceed $620,000. The funds for this expense are included in the Fiscal Year 2015-16 adopted budget and as a regular expenditure, funds to pay the future years’ portion will be included in subsequent fiscal year budget proposals. REPORT ITEMS 13.1 REPORT - SONOMA COUNTY PROPERTY ASSESSED CLEAN ENERGY (PACE) FINANCING MARKETPLACE BACKGROUND: The City of Santa Rosa set a greenhouse gas (GHG) emission reduction target to 25 percent below 1990 levels by 2015. Installation of water and energy efficiency improvements is one of many ways to reduce GHG emissions. In 2009, the City Council authorized the City’s participation in the Sonoma County Energy Independence Program (SCEIP), which is the County’s Property Assessed Clean Energy (PACE) financing program. SCEIP allows for property owners to install renewable energy sources and water and energy efficiency improvements through contractual assessments that are paid back through the property tax bill. In 2014, Sonoma County created the Sonoma County PACE Financing Marketplace (PACE Marketplace) expanding the financing options available to property owners. The PACE Marketplace integrates additional financing options from the CaliforniaFIRST, California HERO and Figtree programs into the region for water and energy efficiency upgrades and the installation of renewable energy. RECOMMENDATION: The Council may choose one of the following options: 1. If the Council wants to offer more PACE financing options within the City boundaries, it may choose, without endorsement of any particular program, to allow operation of three additional PACE programs by adoption of the following resolutions: a. Approving the Insurance and Indemnification Agreement between the City of Santa Rosa and Renewable Funding, LLC and authorizing the Mayor to sign; and Consenting to the inclusion of properties within the City’s Jurisdiction in the CaliforniaFIRST Program; b. Approving the Insurance and Indemnification Agreement between the City of Santa Rosa and Renovate America, Inc. and authorizing the Mayor to sign; Approving the Amendment to the Joint Powers Agreement adding City of Santa Rosa as an Associate Member of the Western Riverside Council of Governments and authorizing the Mayor to sign; and Consenting to the inclusion of properties within the City’s Jurisdiction in City of Santa Rosa Regular Meeting Agenda and Summary Report Page 6 of 11 City Council MARCH 8, 2016 the California HERO Program; and c. Approving the Insurance and Indemnification Agreement between the City of Santa Rosa and Figtree Company, Inc. and authorizing the Mayor to sign; Approving the Joint Powers Authority Associate Membership Agreement between the California Enterprise Development Authority and the City of Santa Rosa and authorizing the Mayor to sign; and Consenting to the Inclusion of properties within the City’s Jurisdiction in the Figtree Program. 2. If the Council wants to offer only the California HERO Program in Santa Rosa, not as endorsement of the program but as it is the only program that offered the City indemnification from both the program administrator, Renovate America, Inc., and the Joint Powers Authority, Western Riverside Council of Governments, the Council would adopt only the following resolution: a. Approving the Insurance and Indemnification Agreement between the City of Santa Rosa and Renovate America, Inc. and authorizing the Mayor to sign; Approving the Amendment to the Joint Powers Agreement adding City of Santa Rosa as an Associate Member of the Western Riverside Council of Governments and authorizing the Mayor to sign; and Consenting to the inclusion of properties within the City’s Jurisdiction in the California HERO Program. 3. The Master Plan includes recommendations for revisions to the Public Art Policy that support the purpose, mission and projects described in the Master Plan. Amending the Policy is an essential step in the implementation the Master Plan. The amended Public Art Policy provides clarity for the operation of the Public Art Program, and increases the effectiveness of the Art in Public Places Committee (APPC). The proposed amendment rewrites the Policy in total. City of Santa Rosa Regular Meeting Agenda and Summary Report Page 8 of 11 City Council MARCH 8, 2016 RECOMMENDATION: It is recommended by the Art in Public Places Committee and the Recreation & Parks Department that the Council, by resolution, adopt the Amended Council Policy 000-42 “Public Art”, or in the alternative, adopt the Amended Council Policy 000-42 “Public Art” as revised to include Council’s preferred method of appointment of members to the Art in Public Places Committee. PUBLIC HEARINGS Public Hearing matters will begin no earlier than 5:00 p.m. or as soon thereafter as the matters are reached on the agenda. 14.1 PUBLIC HEARING - RESOLUTION DECLARING WEEDS AND RUBBISH IN THE SANTA ROSA CITY LIMITS A PUBLIC NUISANCE BACKGROUND: On February 2, 2016, Council declared by resolution, weeds and rubbish as a public nuisance. The second procedure is to publish a notice for a public hearing, at which time a person or persons may voice an objection to the Weed and rubbish Abatement Program. After hearing any or all protests, the Council, by resolution, may grant or overrule any protest and authorize the Fire Department to abate the nuisances. Chapter 9-08 of the Santa Rosa City Code requires a public hearing to hear all objections or protests to the proposed removal of weed and rubbish upon property that such a public nuisance has been declared to exist. The City Council grants or overrules any such protests. The City Council, then, by resolution, may authorize the Fire Department City of Santa Rosa Regular Meeting Agenda and Summary Report Page 9 of 11 City Council MARCH 8, 2016 to abate all weeds and rubbish on or upon private property within the City of Santa Rosa. RECOMMENDATION: It is recommended by the Fire Department that Council, by resolution, over rule any protests and authorize the Fire Department to abate the nuisances Attachments Staff Report Attachment 1 Resolution Public Hearing Notice Presentation **14.2 PUBLIC HEARING - APPEAL OF THE PLANNING COMMISSION’S DECISION TO APPROVE A CONDITIONAL USE PERMIT FOR THE OAKMONT CENTRAL PARK EXPANSION, LOCATED AT 6633 OAKMONT DRIVE - FILE NO. MNP14-014 BACKGROUND: On December 10, 2015, the Planning Commission approved, with a vote of 5-0-1-1 (Commissioner Crocker being absent and Vice-Chair Stanley recusing himself), Resolution No. 11742, the Oakmont Central Park Expansion project. The project includes the addition of four multi-use sport courts and a parking reduction. On December 18, 2015, the City Clerk received a request for Appeal. The purpose of this meeting if for the City Council to consider the expansion of recreational use and either grant the appeal or deny the appeal and approve the Conditional Use Permit.
