PUBLIC HEARING SPA Housing Zoning Ordinance Mayor Yepsen opened the public hearing at 6:51 p.m. Commissioner Mathiesen advised this is a continuation of the public hearing opened a number of weeks ago. Vince DeLeonardis, city attorney, stated changes municipalities have seen relate to due process claims and takings claims. The ordinance must show it is intended to achieve a public purpose and is a reasonable means to achieve the purpose. A density bonus for the developer is usually enough for takings claims. Some component of a period of time (sunset clause) does make sense as it is an established need. We have a period of affordability established for the rental units but do not have a period of affordability established for the sale units. There are a couple issues with rental only versus rental and sale units. If the ordinance applies to rental units only, it has an indication this is some form or rent control. Commissioner Madigan asked if the ordinance could be re-written to focus on certain districts. Vince stated the issue with that is inclusionary zoning is to disperse workforce housing. Page 3 of 12 City Council Meeting 5/16/17 Dave Morris of Saratoga Springs asked if this is really inclusionary zoning. It excludes the people that need it the most. No one is thinking this through; it is not going to help. Darlene McGraw of Saratoga Springs asked for the exact definition of workforce housing. Do you expect people to walk from locations that have no bus service? Commissioner Franck verified other points he brought up at the workshop (i.e. sunset clause) should be in the law. He feels the timeframe of for sale units before selling out right needs to be longer than 6 months. There was also concern regarding language in the deed. Vince advised the proposal contains language there will be some restrictions on a deed. The banks do want to be part of this. They are taking a risk when providing mortgages with a low to no down payment. Commissioner Franck stated the banks would like to work with Vince and Commissioner Mathiesen to put in template language. Vince stated it may not be a bad idea to put in some language. Mayor Yepsen concluded the public hearing at 7:14 p.m. and kept it open. Amend Chapter 225 – Traffic Control Signals Mayor Yepsen opened the public hearing at 7:14 p.m. Commissioner Mathiesen stated this is in regards to intersections on Ballston Avenue and Geyser Road not having been codified in the City Code. Darlene McGraw of Saratoga Springs stated she appreciates the community making it easier to get through traffic when she walks somewhere. Mayor Yepsen closed the public hearing at 7:16 p.m. Amend Chapter 225 – Stop Intersections Mayor Yepsen opened the public hearing at 7:16 p.m. Commissioner Mathiesen stated this is in regards to removing stop signs due to the installation of traffic lights. The City Code book needs to be updated. No one spoke. Mayor Yepsen closed the public hearing at 7:16 p.m. CALL TO ORDER Mayor Yepsen called the meeting to order at 7:16 p.m. PUBLIC COMENT Mayor Yepsen said the public comment period is limited to a total of 15 minutes and individuals are limited to two minutes. Page 4 of 12 City Council Meeting 5/16/17 Mayor Yepsen opened the public comment period at 7:17 p.m. Ken Gray of Saratoga Springs stated he is here as a representative of Complete Streets Advisory Board and himself. He submitted his comments in writing (attached). Dave Morris of Saratoga Springs stated no one spoke to the home owners of Geyser Road. The home owners are not happy about the Geyser Road Trail. Douglas Myer of Saratoga Springs is here representing Saratoga Greenbelt Trail Committee. Decisions need to start being made. Decisions can’t be made based upon what has been done in the past or what benefits just a few properties. Decisions need to be based upon what is best for the community as a whole. Maureen Roberts of Saratoga Springs stated she hopes we haven’t missed the boat with Lake Avenue. We need to start thinking about making these streets more viable for everyone; not just cars. Dave Bronner of Saratoga Springs stated he is here again to talk about the fire/EMS on the east ridge. The response time of 8 minutes and up is not acceptable. We need to put a fly car at the Lake Avenue station that can respond to any emergency medical condition. The situation we have now is not acceptable. There seems to be a reluctance to do this. Mary Ellen of Gansevoort stated she owns a business and works in Saratoga. A friend of hers was molested in Saratoga Springs. She is asking for the Council’s support for the passage of the Child’s Victims Act. NYS legislators want to hear from the Council. Darlene McGraw of Saratoga Springs stated the sidewalks are getting better. She fell again yesterday in the same place she fell before. Mayor Yepsen closed the public comment period at 7:35 p.m. Commissioner Mathiesen stated the household income being target for rental units is $45,000 - $70,000. The income for home purchases is $55,000 - $85,000. In regards to fly cars; the City will not permit speeding through City streets to get to an emergency. They are looking in making some changes in the way the department is staffed to be sure there are 3 engine crews available. They continue to look at land for the third fire/EMS station. Improvements are being made to pedestrian traffic on Lake Avenue. Mayor Yepsen stated she listened to a segment on the radio tonight on economic values of trails and paths. Property values on and near trails are going up significantly in New York. PRESENTATION Public WiFi Project for Congress Park Commissioner Madigan stated this is in regards to the public WiFi project in Congress Park. Kevin Kling, manager of IT, advised we can transmit signals that can stay within the park. The intent is to make this free to the public; primarily for people in the park not for people next to the park. Measures will be put in place to secure the wireless network. People will need to agree to a disclaimer that the City is not responsible and will need to be acknowledged every 24 hours. The City will have no ability to monitor what websites are being visited but will be able to log what devices are using the WiFi. A policy will need to be drafted regarding the type of information being collected; device information only. Commissioner Franck asked if the City will be selling data like they do when you go into a mall. Kevin Kling advised they will not be collecting or selling data. Page 5 of 12 City Council Meeting 5/16/17 Commissioner Madigan thanked DPW for assisting them with the wiring. This will allow them to do this project for $5,000. She has not budgeted for this; however the fund balance is at 19%. She is going to make some recommendations regarding a reserve fund for IT. Invoice (17-148) Mayor Yepsen advised the amount of the invoice is $4,305 and was for the red diamond baseball mix. Mayor Yepsen moved and Commissioner Mathiesen seconded to pay Hadeka Stone Corp. invoice. Ayes – All Discussion and Vote: Accept Camp Saradac Scholarships (17-149) John Hirliman of the Recreation Department thanked the Rotary Club and Martha and George Parker. Mayor Yepsen stated the Rotary Club is donating $500 and the Parkers are donating $1,600. Mayor Yepsen moved and Commissioner Madigan seconded to accept Camp Saradac scholarships. Ayes – All Announcement: Saratoga Springs Recreation Programs and Leagues John Hirliman of the Recreation Department announced registrations are being accepted for programs. There are also some spots still available for Camp Saradac. Discussion and Vote: Authorization for the Mayor to Sign Corporate Health Drug Testing Contract (17-150) Page 6 of 12 City Council Meeting 5/16/17 Mayor Yepsen stated this incorporates drug testing protocols for various departments. Mayor Yepsen moved and Commissioner Mathiesen seconded to authorize the mayor to sign a Corporate Health Drug Testing contract. Ayes – All Announcement: 2016 Municipal Zero - Emission Vehicle (ZEV) & ZEV Infrastructure Rebate Program Award Mayor Yepsen announced the City has received $16,000 from the Zero Emission Vehicle & ZEV Infrastructure Rebate Program. The program covers up to 80% of the cost of installing, maintaining, and operating a minimum of 2 electronic charging stations at the Woodlawn Avenue parking garage. Discussion and Vote: Approval to Make $2,500 Payment to Memorial Day Parade Committee (17-151) Mayor Yepsen stated the Memorial Day Parade is organized and run by the Disabled American Veterans Department of New York. Some of the parade expenses are covered by this payment. Mayor Yepsen moved and Commissioner Madigan seconded to approve the $2,500 payment to the Memorial Day Parade Committee. Ayes – All Discussion: Formation of the City’s ADA Employee Committee Vince DeLeonardis, Marilyn Rivers, Brad Birge, Tina Carton, Mike Veitch, John Hirliman, Kate Maynard, Meg Kelley, Jack Donnelly, and Tim Wales. Vince DeLeonardis, city attorney, advised ADA covers a number of different areas and imposes different requirements on municipalities. One of the things they are charged with is a transition plan; identify sufficient, less sufficient, and those sidewalks in immediate need to be improved. This is tied to the receipt of federal highway dollars; and doesn’t solely relate to CHIPS money. Commissioner Mathiesen asked if this relates to public and private sidewalks. Vince advised it involves all pedestrian pathways in the right of way. nd Announcement: Human Rights Town Hall Meeting in Music Hall on Monday, May 22 at 7:30 p.m. Mayor Yepsen announced she is holding a human rights town hall meeting. She will be introducing the Human Rights Task Force. th Announcement: Memorial Day Parade on Broadway Thursday, May 25 at 6:30 p.m. th Mayor Yepsen announced the Memorial Day Parade will be held on Thursday, May 25 at 6:30 p.m. It is being brought back to Broadway this year. Announcement: Review Council Meeting Schedule Exceptions Mayor Yepsen announced the City Council will be meeting on the following dates: • June 19th – pre- agenda and City Council meeting. • July 5 – pre-Agenda and City Council meeting. th • September 5 - pre-Agenda and City Council meeting. th • November 6 - pre-Agenda and City Council meeting. th Page 7 of 12 City Council Meeting 5/16/17 ACCOUNTS DEPARTMENT Announcement: Grievance Day – May 23, 2017 Commissioner Franck announced Grievance Day is Tuesday, May 23, 2017. There are 3 sessions in which grievances are heard: 9 a.m. – noon; 1 p.m. – 4 p.m.; and 7 p.m. - 9 p.m. in the City Council Room. Questions can be directed to the Assessment Office. FINANCE DEPARTMENT Discussion and Vote: Resolution for City Council Support SSHA Affordable Housing Development Grant (17-152) Commissioner Madigan read the following resolution: RESOLUTION for City Council Support of Saratoga Springs Housing Authority (SSHA) Affordable Housing Development Project WHEREAS the City of Saratoga Springs wishes to further the development of workforce housing to create a diverse population within the city while meeting the needs of the city’s workforce; and WHEREAS over the last decade there has been no new development for affordable workforce housing; and WHEREAS the Saratoga Springs Housing Authority is applying for funds to develop 24 units of affordable housing through the New York State Homes and Community Renewal’s “Small Development Project Initiative” (SRDI); and WHEREAS the grant is extremely competitive and the scoring system will evaluate local municipal support and contributions for the project; and WHEREAS the SSHA has requested the city to show its support and commitment to this project by providing “In Kind” funding by means of waiving the PILOT payments associated with the project and waiving building permit fees required by the project. NOW, THEREFORE BE IT RESOLVED, the City Council of Saratoga Springs approves the waiving of the PILOT payment’s and associated building permit costs pursuant to Article V of the Public Housing Finance Law to execute an exemption agreement on behalf of the Saratoga Springs Housing Authority’s new 24-unit development at Jefferson/Vanderbilt Terrace for the duration of the program. Commissioner Madigan moved and Commissioner Franck seconded to approve the resolution to support SSHA affordable housing grant as just read. Paul Feldman stated this grant is due next Thursday. This is a very competitive grant and working to get every point they can possibly get. They are applying for $4 million dollars. Commissioner Madigan stated there is no cost to the City. Ayes – All st 1 Quarter 2017 Financial Report Commissioner Madigan advised of the following general fund revenues: • Property taxes in the General Fund are recognized as revenue for the full amount levied at the time the tax roll is posted to the general ledger. As of 03/31/17, 53% has been collected ($8,576,79.00); last year at this time 51% was collected. Property taxes can be paid in four installments with the first installment due March 1. The City offers a discount of 2.25% if the full year is paid on or before March 1 which accounts for the greater than 25% collection rate after only the first due date has passed. • Sales Tax figures include only one month since February and March collections are not distributed to the City from NYS Taxation and Finance until April and May, respectively. • VLT Aid is paid in June. • Hotel Occupancy Tax is paid to the City from the County on a quarterly basis. The first quarterly payment for 2017 will be received in April. • County surplus distribution is paid on a quarterly basis too, with the first payment due in April. • NYRA Admissions Tax is paid annually after the racing season has closed. Page 8 of 12 City Council Meeting 5/16/17 • The bulk of Franchise Tax is paid annually, in the last quarter of the year. • State Aid Revenue sharing is distributed in two installments, September and December. The largest share is received in December. • Mortgage Tax is paid semiannually in May and November. Water and Sewer Revenues: • The first quarter water and sewer bills for 2017 are mailed in April for a May 15 due date. th Capital Revenues: • The City will issue a ggeneral oobligation bond in June to finance the 2017 capital projects. EXPENSES: General Fund Expenses • Mayor’s Office – Many contributions to outside organizations and events have been paid in full as of 03/31/17. Most other expenses are fairly consistent. • Finance Office – Expenses are approximately 22% used as of 03/31. Discounts are taken if taxes are paid on or before March 1, however the expense is recorded by journal entry. In 2017 more taxpayers took advantage of the discount than ever before. As a result the appropriation is not sufficient a budget transfer from contingency must first be approved before the journal can be posted. All liability insurance has been paid in full for the year. Additional expenses would be for claims or additional coverage. Most departments’ expenses are running at about 25%, which is on target for 03/31/17 and is consistent with the first quarter of 2017. Variances are due to seasonal expenses and grants. Capital Expenses • Capital expenses are usually larger in the months where weather is more conducive to construction. In addition, large vehicle purchases often take many months to be built according to bid specifications. Community Development • Community Development block grants are awarded on a different schedule than the City’s fiscal year, no budget is established. Discussion: Best Practice for Employee Upgrade Commissioner Madigan pulled this item to provide the Council time to review and will bring it back at the next Council meeting. Approve Budget Transfers – Payroll (17-153) Commissioner Madigan moved and Commissioner Mathiesen seconded to approve the budget transfers – payroll which were previously distributed and uploaded with the agenda. Ayes – All Approve Budget Transfer – Contingency (17-154) Commissioner Madigan stated the contingency fund balance is currently $200,000 and there will be $158,495.56 remaining after the posting of this transfer. She is requesting $41,504.44 transfer from contingency. Page 9 of 12 City Council Meeting 5/16/17 Commissioner Madigan moved and Commissioner Mathiesen seconded to approve the budget transfer – contingency which were previously distributed with the agenda. Ayes - All PUBLIC WORKS DEPARTMENT Announcement: Update on the CHIPS Program Commissioner Scirocco announced DPW has started their 2017 paving program. They have a CHIPS balance of $614,253.98 and the Pave New York Program has allocated $280,327.90 along with $92,959.51 of EWR funding. Announcement: Update on Curbside Debris Pick-Up Commissioner Scirocco announced the curbside debris pick-up is back into full swing. Branches need to be cut so that it will fit into a bag or barrel. **Council took a break at 8:48 p.m. **Council returned at 8:51 p.m. PUBLIC SAFETY DEPARTMENT Announcement: 2017 MADD Stop DWI Award Winner Commissioner Mathiesen announced Officer Kaitlyn Freshwater received the 2017 MADD Stop DWI Award. She arrested 45 individuals in 2016 for driving while intoxicated. Discussion and Vote: Authorization for Mayor to Sign Contract with QPK Design (17-155) Commissioner Mathiesen moved and Commissioner Madigan seconded to authorize the mayor to sign a contract with QPK Design in the amount not to exceed $38,500. Ayes – All Announcement: Nightclub District Update Commissioner Mathiesen announced there was an effort on behalf of our Police Department and the Department of Motor Vehicle to address underage drinking. Some bar owners have purchased license readers to help identify fake ids. Announcement: Outstanding Service Award to Saratoga Springs Fire Department Commissioner Mathiesen announced the Fire Department received an Outstanding Service Award from the Preservation Foundation for containing the fire at 26 Caroline Street on Thanksgiving Day. Announcement: Cities RISE Application Commissioner Mathiesen announced he and the mayor signed an application for the first round of a Cities RISE grant. This is part 1 of a 3 round grant program. The first round winner gets access to a building blocks program; a cloud based web application to coordinate housing and asset management related data to execute their plan to combat vacant properties. There is no matching requirement from the City. Page 10 of 12 City Council Meeting 5/16/17 Discussion: Bike Lanes on Lake Avenue Commissioner Mathiesen advised Complete Streets and community individuals questioned why bike lanes were not installed when Lake Avenue was recently paved. Mark Benaquista suggested not allowing parking on the north side of Lake Avenue from St. Clements to East Avenue to allow for a bike lane. If parking was removed it would have an adverse affect on homeowners as most driveways in that area are short and don’t allow for multiple vehicles. Commissioner Madigan agreed that we can’t always put bike lanes in every time a road is paved. People do need to have a place to park. Mayor Yepsen stated this requires more communication and we should come up with an implementation plan. Discussion and Vote: Authorization for Mayor to Sign Contract with Axon Enterprise, Inc. (17-156) Commissioner Mathiesen advised this is for unlimited cartridge supplies for tasers. This is a 5 year contract. Commissioner Mathiesen moved and Commissioner Scirocco seconded to authorize the mayor to sign a contract with Axon Enterprise, Inc. in the amount of $36,395.57. Ayes - All Discussion: White Supremacist Fliers Commissioner Mathiesen thanked Chief Veitch for a quick response to the fliers. There are no indications of threats but people should remain vigilant. SUPERVISORS Matt Veitch Veteran’s Committee Supervisor Veitch reported they met last week. The trust fund has been growing over the past years so the County will be reviewing the use of the funds. A Saratoga Springs veteran will be honored in August. 2017 Fish Stocking Program Supervisor Veitch reported the County did a fish stocking event in the Corinth Reservoir. Public Safety Building Update Supervisor Veitch reported they received a presentation from their architects and they presented a plan for a building on the County farm. The plan includes the Sheriff’s Department, the Probation Department, the Office of Emergency Services, and the Public Health Department. He is working to keep public health in Saratoga and not moving it to this location. Law & Finance Committee Supervisor Veitch reported they passed going into a partnership between our sewer district and Albany County’s sewer district to look for a regional bio-salvage digestive facility. Page 11 of 12 City Council Meeting 5/16/17 Peter Martin Public Health Supervisor Martin reported the County entered into a 3 year agreement with New York State to fund outreach and resource programs for children with developmental disabilities. Equalization and Assessment Supervisor Martin reported they had some problems with their auctions where people bid on the property, then go look at the property and back out on their offer. They have developed new procedure to avoid this issue. Social Programs Supervisor Martin reported the Meals on Wheels contractor cancelled their contract with the County. The County put that out to bid and the same contractor was the low bidder. It is costing County $1.15 per meal more. The County paid the Shelters of Saratoga $66,100 for Code Blue; the County retained $7,500 for costs it incurred regarding Code Blue services. Board of Supervisors Meeting st Supervisor Martin reported for the period ending March 31 , the City of Saratoga Springs will be receiving a distribution of $971,825 in mortgage tax from the County Clerk’s Office. EXECUTIVE SESSION Mayor Yepsen moved and Commissioner Mathiesen seconded to enter into executive session for the proposed acquisition, sale, or lease of real property when publicity would substantially affect the value thereof at 9:35 p.m. Ayes – All Council returned at 9:55 p.m. Mayor Yepsen reported no decisions were made in executive session to announce to the public.
