PUBLIC HEARING Amend Chapter 225 – Alternate Side of Street Parking on Walworth Street Mayor Kelly opened the public hearing at 6:55 p.m. Commissioner Dalton advised the city has identified that the increased amount of vehicles that are parked on Walworth Street between Washington Street and Cherry Street has created a dense parking situation, which is preventing motorists from reasonably passing one another. The city is proposing to implement alternate side of the street parking regulations, restrict parking to one side of the street each day. No one spoke. Mayor Kelly closed the public hearing at 6:56 p.m. Page 4 of 16 City Council Meeting 12/15/2020 Congress Park Centre PUD Extension Mayor Kelly opened the public hearing at 6:56 p.m. Deputy Commissioner Maire Masterson advised the legislation for Congress Park Centre PUD is set to expire at the end of this month. The applicant is requesting to extend the extension legislation for an additional fifteen-year period until December 31, 2035. The city and county planning boards have reviewed this request and both find in favor of the extension. Mike Toohey, attorney for the applicant, advised this PUD was originally passed in 1993. It has existed in the City of Saratoga Springs for twenty-six and a half years. In 2005, it was granted a fifteen-year life and the legislation expires on December 31 of this year. The applicant wishes to have it extended for another fifteen years. There is no other change to the legislation. It is still a commercial site and it has worked successfully for all these years. Mayor Kelly closed the public hearing at 7:00 p.m. CALL TO ORDER Mayor Kelly called the meeting to order at 7:00 p.m. PUBLIC COMMENT Mayor Kelly said the public comment period is limited to a total of 15 minutes and individuals are limited to two minutes. Mayor Kelly opened the public comment period at 7:01 p.m. Wendy Mahaney of Sustainable Saratoga stated they have reviewed and commented on previous versions of the Natural Resources Inventory and are pleased with the final draft. The assessments in the document can be used as a foundation for making long-range planning decisions like promoting climate resilience, protecting wetlands and water resources. They urge the Council to adopt the Natural Resource Inventory. Max Rosenbaum of Saratoga Springs stated he believes it is important for the City to work closely with the state to re-open the track this season. Also, after speaking with many Saratogians, he has found most don’t have any idea about the UDO. Darlene McGraw of Saratoga Springs stated people need to be able to contact the City in a non-judgmental way. Chris Mathiesen of Saratoga Springs advised since the Saratoga Catholic gala cannot be held, they are doing a fundraiser, a 50/50 drawing. Interested people can contact Mary Guarnieri at the school to purchase a ticket. In addition, he has heard that Commissioner Madigan is not going to run for office again. He thanked her for all she has done and wished her well. Mayor Kelly closed the public comment period at 7:10 p.m. PRESENTATION New York Power Authority: Energy Efficient Program – City Street Lights Commissioner Madigan advised the Public Service Commission approved Section 70(a), allowing municipalities to purchase streetlights from their utility company. Ours is National Grid. The New York Page 5 of 16 City Council Meeting 12/15/2020 Power Authority launched in 2018 Smart Street Lighting New York to replace the streetlights with energy efficient and sustainable alternatives. This will save taxpayers money. NYPA also can provide financing for the project with payments to NYPA made in the years following from the cost savings created by the reduced energy use of the LED street lights. These can be up to fifty to sixty-five percent more efficient than alternative street lighting options. Self-financing is an option which the director of finance is looking into. NYPA is offering the city the current rate, which is at a significant discount for those who execute required program documents by year-end 2020. For the city, this would be equivalent to about a $300,000 per year on of the project. The authorization to proceed is a non-binding letter of intent. Under its terms, the city is not obligated to complete project implementation. The next step is for the City of Saratoga Springs to sign and return the authorization to proceed letter. NYPA will then initiate the design phase of the project and will select an implementation contractor that will serve as the engineer of record. Kevin Luteran of Smart Street Lighting New York presented. They have a goal to convert 500,000 streetlights to LED by 2025. NYPA has developed a full turnkey service to help communities with the conversion process. By purchasing and owning your own streetlights, you will realize a huge savings. LEDs will improve the quality of lighting, which will help improve safety. They are helping over 130 municipalities across New York. It will take about 6 to 10 months to complete the purchase process of the streetlights from National Grid. While that is happening, the will assist with the design of the street lighting system. They can assist with financing and no payments will need to be made to NYPA until the project is completed. Tina Carton advised of the various local cities who are currently going through this process. Smart City technologies can be attached to the poles (smart poles) that can provide things like hosting wi-fi transmitters, attachment of smaller microcell towers, air quality sensors, smart parking, etc. Jeff Flagg, sustainability coordinator for the City of Glens Falls, reported they are about 18 months ahead of the City of Saratoga Springs. He reported on how the process is currently working for them. He would not suggest taking on the conversion but having a third party do it. Ayes – All Discussion and Vote: Approval of $10,000 Donation to Rebuilding Together Saratoga County (20-435) Mayor Kelly advised recently a housing unit at 289 Jefferson Street was released from the workforce housing restrictions. The City received a payment of its established financial interest in the amount of $10,000. The City believes it is in the best public interest to use the money to further the goals of affordable housing. Upon approval, the funds will be transferred to Rebuilding Together Saratoga County. Page 11 of 16 City Council Meeting 12/15/2020 Discussion and Vote: 2021 Tax Rate Approvals (20-444) Commissioner Madigan advised the Council is asked to approve the tax rate generated from the passage of the next year’s budget. The tax rate is $6.4331 per thousand for the inside district and $6.3714 for the outside district. Commissioner Madigan moved and Commissioner Franck seconded to approve the 2021 tax rate approvals as included with the agenda. This project began in 2015 with the Smart City Commission. This network will reach every home and business in the City at no cost to the City. Commissioner Madigan moved and Commissioner Dalton seconded to authorize the mayor to sign the development agreement – amendment #1 with SiFi Networks for the fiber optics project as include with the agenda. Ayes – All Discussion and Vote: Authorization for Mayor to Sign the Smart City Services Agreement with SIFI Networks for the Fiber Optics Project (20-446) Commissioner Madigan advised the Smart City Managed Services Agreement enables the City to receive services to identify City locations over SiFi's fiber optics infrastructure once the same is completed. The agreement identifies twenty initial locations for the service including City Hall, fire stations, DPW garage, and the Visitor's Center. The city has the ability to identify additional locations up to a maximum of 300. Services Agreement shall be for a period of ten years from the commencement date. Commencement date is the date of the first drop connection, and it must occur within twenty-four months from now. If, however, SiFi is unable to achieve the first drop connection by that date, the city may terminate the agreement. Commissioner Madigan moved and Commissioner Dalton seconded to authorize the mayor to sign the Smart City Services agreement with SiFi Networks for the fiber optics project as included with the agenda. Ayes – All Discussion and Vote: Authorization for Mayor to Sign Addendum Three to NYSTEC Agreement for IT Security Services and Smart City Consulting (no-cost) (20-447) Commissioner Madigan advised the contract that we have with them expires on 12/31/20, and this amendment extends it through 12/31/22 at no additional cost. NYSTEC provides the City with IT security and Smart City consulting services. Commissioner Madigan moved and Mayor Kelly seconded to authorize the mayor to sign addendum 3 to NYSTEC agreement for IT security services and Smart City consulting at no cost as included with the agenda. The city needs to have all information available about the governor's budget. Our need to have this information has only increased as 2020 funds for state aid and BLT aid were curtailed by twenty percent, and all jurisdictions, state, county, and local, are squeezed by decreased revenue collection in the pandemic economy. They are working with National Grid. The lease agreement is for $1,500 dollars for a period ending January 31, 2021. For the renewal term, the annual operating contribution is in the amount of one third of $10,000, and the annual capital contribution is in the amount of $40,000. Ayes - All PUBLIC SAFETY DEPARTMENT Announcement: COVID-19 Commissioner Dalton advised in the last seven days, there have been 915 new COVID-19 cases in Saratoga County for a total number of active cases of 1,267. Of those cases, 155 are in the City of Saratoga Springs. There are 436 people in quarantine in Saratoga County and 24 people hospitalized at Saratoga Hospital. Our hospitalization rates have come in relatively stable, which is a positive but our seven-day rolling average for the county is over 5%. That number has been on the rise for a bit and is concerning. As of right now, the governor has not indicated that we are in any other zone. We have not been given a micro-cluster designation. We are not in the yellow or the red zone.
