PUBLIC HEARINGS Amend Chapter 225-Alternate Side of Street Parking on Beekman Street Commissioner Madigan opened the public hearing at 6:55 p.m. Commissioner Dalton stated this is to make Beekman Street, from Church Street to West Circular Street, alternate side of the street parking. Nora Brennan of Saratoga Springs stated there is very little parking now and to make it alternate side of the street parking will make it worse. It shifts where the problem occurs. Page 4 of 14 City Council Meeting 9/21/2021 Darlene McGraw of Halfmoon stated some of these streets aren’t made to be two ways. Alternate side of the street parking is good here. Commissioner Madigan closed the public hearing at 6:57 p.m. CALL TO ORDER Commissioner Madigan called the meeting to order at 7:00 p.m. PUBLIC COMMENT Commissioner Madigan said the public comment period is limited to a total of 15 minutes and individuals are limited to two minutes. Commissioner Madigan opened the public comment period at 7:01 p.m. Molly Dunn of Saratoga Springs stated one of the officers at the scene at the night of Darryl Mount’s accident has his own arrest record. Saratoga Springs Police have not answered a FOIL request for this officer’s records. What are they trying to hide? Chad of Saratoga Springs thanked the Council for their service to our community. He can think of a few times where the police actions were questionable. He doesn’t want his tax dollars to silence the members of the black community. These arrests were attempts to suppress those who have grievances with the City. He asked for independent investigations to be started. Resident of Clifton Park stated she grew up with some of the people arrested due to the 7/14/21 protest. She has never felt so hurt by her own city. She is a studying EMT and is enraged by the thought she will work next to those cops that abuse their power. This is not a black vs. white issue; it is a human rights issue. Tracy Krosky of Halfmoon stated she is an elementary teacher who does radical dreaming with her students. She asks them to think about what this world could be like. This is not a binary world. In Saratoga, there is no space to question police. Both her kids were in court today. Where is the council’s outrage for their violation of rights by the police? Jerome Steel from Troy stated with upcoming mediation and election, the voters need to understand when the City Council became aware of the warrants issued for the arrests of the activists. Lillian of Saratoga Springs and senior at Saratoga Springs High School stated she is disheartened by the militarized response to protests. She agrees with the NYCLU assessment of the Saratoga Springs Police Department. She asked for the discontinuation of targeting of black citizens and activists. Nora Brennan stated she would like to know why an independent investigation of the Darryl Mount’s death is not being done. If you don’t think it’s warranted, please provide the explanation as to why. Why is there no sense of urgency around the Police Task Force efforts? Do you think Saratoga Springs has a problem with racism? Kristen Dart of Saratoga Springs stated that twice today public access was limited to public proceedings. You all are advocating your power. You made a change for the worse. Charlie Samuels of Saratoga Springs stated he is here to talk about Complete Streets. If we had more bike lanes and safety implementation as well as awareness, it would have been a better day. The Lake Avenue bike lane is great but it doesn’t have anything else connected to it. Page 5 of 14 City Council Meeting 9/21/2021 Reverend Joe Cleveland of Saratoga Springs stated the charges against Black Lives Matters activists need to be dropped and the intimidation needs to stop. There have been black people in this town telling you about their experience – have you heard them? Bob Turner of Saratoga Springs stated it is unfortunate there is a limit on the number of people allowed in this room. His students love coming to the meetings and learning from the decisions the Council has to make. Nedra Hickenbottom stated last Tuesday was disgusting. Her son, Elz Figuereo was arrested for the stupidest thing. Her son went into to court shackled like an animal. You need to think what you’re doing because you are only making things worse. Samira Sangare stated that a week ago she was being processed in the basement for disorderly conduct from a protest two months ago. There is no world where police arrest people eight weeks after a protest. She and her brother were brought to be arraigned in shackles and belts. This is not protocol but a scare tactic. The only time they marched on the streets and exercised their first amendment rights was right after Assistant Chief Catone said he would use 130 years of his family connections to stop their narrative. As an organizer and activist of BLM, there will be no mediation until the charges are dropped. Matthew Williams of Burnt Hills stated it is disgusting how you treat people of color like garbage. He sees his friends being treated differently than him when walking down the street. Logan Williams stated this is wrong. Darlene McGraw of Halfmoon stated she moved out of this City because of the dirty politics. Alexus Brown of Saratoga Springs asked why the BLM organizers and activists were not allowed into court. Commissioner Madigan closed the public comment period at 7:30 p.m. Commissioner Dalton advised she is looking into why people were not let into court this morning. PRESENTATION Unified Development Ordinance (UDO) – Final Vince DeLeonardis, city attorney, reviewed the UDO with Arista Strungys of Camiros (via internet). Vince advised the Comprehensive Plan lays out the City’s vision for the future and the UDO is the tool we use to implement that plan. Vision for the plan is the city within the country. We look to incorporate sustainability in our land use regulations. NYSERDA awarded the City a grant to develop and implement sustainable growth strategies as part of our efforts to update and unify all land use regulations. NYSERDA has been monitoring our progress and reviewing our deliverable to ensure we are incorporating components of sustainability into the UDO. NYSERDA has determined we are in compliance, met the requirements, and have signed off on the final draft of the UDO. He provided a complete timeline of events from the beginning (2015) to current. The City Council held four workshops to review the UDO and provide comment. Hundreds of changes have been made with each draft. Vince reviewed some of those changes. The final draft of the UDO can be found on the City’s webpage. A public hearing will be set to begin October 5, 2021 and conclude October 19, 2021 with a vote on November 16, 2021. April 4, 2022 is the proposed effective date of the UDO. (A copy of the presentation is attached.) Announcement: Independent Advisory Committee – NYS Police Reform and Reinvention Collaborative Plan Report Commissioner Madigan introduced Jason Golub to present. Jason Golub updated regarding the Civilian Review Board (copy of presentation attached). He believes there is evidence that a Civilian Review Board adds value. He provided examples of cities where a CRB did not work. A CRB can fail where there is a lack of support from police and political leaders; a lack of funding, CRBs that are staffed with activists; and CRBs that are not independent from the police department. Appointments to the CRB are made by the mayor for a specified term. Credibility is required in the process as well as in the outcome. Jason advised his best estimate for a starting budget is $100,000 and it would take about 6 months to get this up and running. Commissioner Franck asked if there are professionals that can be hired to train the members. Jason advised there are private firms that can provide the training. Commissioner Dalton believes the Council needs to take the next step. It’s a positive tool for the City. ** City Council took a break at 8:26 p.m. ** City Council returned at 8:30 p.m. Discussion: Cannabis Legislation and Establishment of Public Comment Period Vince DeLeonardis, city attorney, advised March 31, 2021 Governor Cuomo signed into law the Marijuana Regulation and Taxation Act, which made use, possession and transportation of certain amounts of marijuana lawful. The legislation also created the Cannabis Control Board and the Office of Cannabis Page 7 of 14 City Council Meeting 9/21/2021 Management. Governor Hochul appointed members to that board earlier this month. Cities have the opportunity to opt out of one or both of dispensaries and/or on site consumption facilities. This decision must be made by December 31. This would have to be done by local law. The City’s website will have a spot for comments regarding this topic. There is a local tax to impose of 4% with 1% going to the County. Set Public Hearing: Unified Development Ordinance (UDO) – Final Commissioner Madigan set a public hearing for Tuesday, October 5, 2021 at 6:45 p.m. and Tuesday, October 19, 2021 at 6:50 p.m. Announcement: Accept CDTC Saratoga Greenbelt – Wilton Connector Trail Technical Assistance Award Commissioner Madigan announced the Capital District Transportation Committee (CDTC) and the Capital District Regional Planning Commission (CDRPC) has approved the Saratoga Greenbelt Wilton Connector Trail for funding. The amount awarded is $10,360 in CDTC and CDRPC staff support matched with local in-kind local volunteer services valued at $3,741. The City’s match is in-kind employee services supporting the project. Discussion and Vote: Authorization for the Mayor to Execute Discharge/Satisfaction of Mortgage for AgroChem, Inc. Economic Development Loan and Any Other Related Documents (21-390) Commissioner Madigan stated AgroChem has completed all federal hiring requirements Commissioner Madigan moved and Commissioner Franck seconded to authorize the mayor to execute discharge/satisfaction of mortgage for the AgroChem, Inc. economic development loan. Ayes – All FINANCE DEPARTMENT Set Public Hearing: 2022 Comprehensive Budget Commissioner Madigan set a public hearing for Tuesday, October 19, 2021 at 6:40 p.m. Presentation: Bikeatoga Commissioner Madigan introduced Ed Lindner to present. He is the community outreach coordinator for Bikeatoga. Mr. Lindner stated he is here on behalf of Saratoga Springs Safe Cycling Coalition. They are a non-profit that has been around since 2005. They run a volunteer bicycle workshop in the basement of St. Peter’s Church. In 2021, over 250 families have adopted Bikeatoga bikes. They ‘partner’ with other organizations to assist within the community. He is here to talk about the bike connections. Bike lanes entice visitors to visit a city and help increase the spending within a city that provide the ability for people to get around by bicycles. Cycling is a health benefit. Discussion and Vote: Resolution in Support of the Safe Cycling Coalition (21-396) The resolution is as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA SPRINGS, NY IN SUPPORT OF THE SAFE CYCLING COALITION BE IT RESOLVED, by the City Council of the City of Saratoga Springs NY, as follows: WHEREAS, in 2012, the City of Saratoga Springs adopted a general Complete Streets Policy stating that making our City a truly walkable and bikeable community will provide significant benefits to our quality of life and economic vitality. The policy further noted, “In addition to its health benefits, walking and biking decrease automobile dependence, in turn improving environmental quality, sustainability, roadway conditions and the economy.” The 2012 Complete Streets Policy recognized that “the way to increase walking and biking in a community is to provide safe opportunities to do so.” NOW, THEREFORE, BE IT RESOVLED THAT in support of Bikeatoga, the upcoming 10-year anniversary of the 2012 Complete Streets Policy, and the Safe Cycling Coalition, the City Council declares its support for the following resolution presented by Bikeatoga and provided by Saratoga Safe Cycling Coalition: “A Resolution from the Saratoga Safe Cycling Coalition ✤✤✤✤✤ In 2012, the City of Saratoga Springs adopted a general Complete Streets Policy stating that making our City a truly walkable and bikeable community will provide significant benefits to our quality of life and economic vitality. The policy further noted, In addition to its health benefits, walking and biking decrease automobile dependence, in turn improving environmental quality, sustainability, roadway conditions and the economy. Page 9 of 14 City Council Meeting 9/21/2021 Most importantly, the 2012 Complete Streets Policy recognized that the “way to increase walking and biking in a community is to provide safe opportunities to do so.” Much has been accomplished in the years since. In 2016, the City adopted a Complete Streets Plan. As a result: traffic signals were upgraded, crosswalks were improved, bike shares were instituted, sidewalks were built. The Geyser Road trail is now open and the Downtown Greenbelt Connector is on the way. In addition, bike lanes on parts of Lake Avenue, North Broadway and Excelsior Avenue were designed and implemented. Despite these notable accomplishments, much of the work necessary to make Saratoga Springs the safe-cycling community envisioned in 2012 remains undone. Seniors, students and Saratogians from all “bikes of life” still travel city streets without marked bike lanes. The current striping and signage does not adequately alert motorists that cyclists are sharing the road. And others have noticed. The 2021 People for Bikes City ratings places Saratoga Springs in the 19th percentile of U.S. small cities for bikeability. We can do better! The Saratoga Springs cycling community is wide and diverse. We are recreational riders, mountain bikers, utility cyclists, road racers, students, and commuters. We ride for fun and for work. To shop and to get to school. For health, for sport, and for the environment. What we all have in common is the need to share the road safely with motorists and pedestrians. The City’s 2021 Open Space Community Survey reflects this – a “common theme was the desire for safer, accessible bicycle and pedestrian connections.” And so, as we approach the 10-year anniversary of the 2012 Complete Streets Policy, we want to thank the City for its ongoing support of the Complete Street Plan. We ask that City continue to budget for future bike lane signage and striping projects, identified as priorities by the City’s Complete Streets Advisory Board. And, we ask that such projects be completed in the next consecutive three years. As the 2016 plan acknowledges, most of these recommendations can be implemented without having a major impact on existing traffic patterns. They can be installed within the existing curb-to curb width, and will not require major alterations to street cross-sections, such as the removal of travel lanes or parking. The successful implementation of this network will make Saratoga a bike friendly city. Signage and Striping = Safer Streets for cyclists, pedestrians and motorists. Let’s get it done!” Commissioner Madigan moved and Commissioner Franck seconded to approve the resolution in support of the Safe Cycling Coalition as included and uploaded with the agenda. Ayes – All Update: 2022 Comprehensive Budget Commissioner Madigan advised the 2022 comprehensive budget will be presented on October 5, 2021. There will be at least four budget workshops scheduled. Update: Mediation and Communication Services Commissioner Madigan advised she will continue to provide updates to improve the City’s relationship with various advocacy groups. To date she hasn’t had a lot of responsiveness from Saratoga Black Lives Matters. At public comment tonight, they made it clear what it will take to continue with mediation services. Discussion and Vote: Authorization for the Mayor to Sign the City of Saratoga Springs Agreement for the Purchase and Sale of Streetlights with National Grid (21-397) Commissioner Madigan advised there is an ongoing operations and maintenance program that will cost the City less than $50,000 annually. City financing occurs over a period of 15 years and the City will save about $33,000 each year. Once the bond obligation is complete, the City will save over $300,000 each year thereafter. Commissioner Madigan moved and Commissioner Franck seconded to authorize the mayor to sign the City of Saratoga Springs agreement for the purchase and sale of streetlights with National Grid as included with the agenda. Commissioner Madigan moved and Commissioner Franck seconded to authorize the mayor to sign agreement with Saratoga Housing Authority regarding Empire State Development/NYSTEC Smart Cities Grant for LED streetlights – Wi-Fi analytics and other as included with the agenda. Ayes – All Discussion and Vote: Budget Transfers – Contingency (21-403) Commissioner Madigan advised this transfers is for the non-profit group RISE to cover annual expenses. The transfer is in the amount of $18,000. Lindsey Connors of Community Development Department advised RISE is part of the homeless court program. The program has very successful with 77% of participants appeared at all of their court dates, 85% had no new contact with police, and 81% avoided the Woodlawn Parking Deck area. Over the past 3 months, the caseload has almost doubled. She is working with the City of Glens Falls to replicate the program there. Commissioner Madigan advised she is looking at including RISE as one of the non-profits in the budget for next year since it has been a successful program. Commissioner Madigan moved and Commissioner Dalton seconded to approve budget transfers from contingency as included with the agenda. Prior to the transfer, the contingency appropriations held $185,651.70; subsequent to this transfer, there will remain $167,651.70. Ayes – All Announcement: Household Hazardous Waste Day Commissioner Scirocco announced household hazardous waste day is October 16, 2021 from 8 a.m. – noon at the Weibel Avenue ice rink. The program is for City residents only and residents must pre-register. Announcement: Fall Tire Recycling Program Commissioner Scirocco announced the fall tire-recycling program is October 19, 2021 from 4:30 p.m. – 5:30 p.m. behind Malta Town Court. Proof of residency is required. Ayes – All Discussion and Vote: Accept Donation for Mounted Unit (21-409) Commissioner Dalton advised this is a donation from Holly Grande in the amount of $400. Commissioner Dalton moved and Commissioner Madigan seconded to accept the donation in the amount of $400. Ayes – All Announcement: Update NYS Police Reform and Reinvention Collaborative Plan Commissioner Dalton announced she will pick back up with this item when Kim Galvin is at a City Council meeting. SUPERVISORS Matt Veitch Update from NYSAC Conference Supervisor Veitch reported this conference was held last week in Syracuse. The Public Safety Committee passed three resolutions: asking the state to amend the bail and discovery reform laws, opposing qualified immunity reform, and enact civil service reform for public safety professionals. He attended several seminars including how to handle COVID-19, transforming New York recycling system, EMS and crisis, crypto currency and block chain. 2022 Saratoga County Budget Update Supervisor Veitch reported they are still in the development stage. Their preliminary budget must be presented by October 15th. Saratoga County Bike Route System Supervisor Veitch reported they have a proposal to present to the County of bike routes. 2021 – 2022 HEAP Home Heating Assistance Supervisor Veitch reported this program starts on October 1, 2021 and runs through March 15, 2022. Workforce Development Local Area Plan Supervisor Veitch reported this sets up the plan and the funding for the career center. County Department Consolidation/Restructuring Supervisor Veitch reported they voted on three department consolidations. The county historian was moved from the Board of Supervisors’ Department to the County Clerk, the Youth Bureau is being dissolved and merged with the Public Health Department and Aging Department, and the Office of Emergency Service Department will be merged with the Sheriff’s Department and renamed the Office of Emergency Management.
