ORDINANCES – RESOLUTIONS – PETITIONS
PETITION – FROM James Jackson per S. 159-2.B(2) Requesting Waiver of Sump Pump Connection
Requirement for 151 W. Linden St.
Wagner stated that Mr. Jackson provided the Village with the requested information/evidence. That
information was reviewed by the Village Attorney.
deBruijn met with the homeowner to inspect the area and felt that the waiver was justified.
deBruijn stated that it would cost approximately 10% of the home’s value for the homeowner to comply.
Krocka/Caban made the following motions, “First, I move that the requirement that Mr. Jackson provide
a video recording as provided by sec. 159-2.C of the Village Code be waived as Village staff has verified
that a recording cannot be made due to the unique condition of this property. Second, I move that the
Village Board find that the cost to install a clear water drainage system at 151 W. Linden Street including
a sump pump connection would result in financial hardship to the current property owner, the property
owner’s situation is unique, and that the financial hardship to the property owner exceeds the benefit to
the Village or public. Third, I move that the Village Board approve the waiver of the sump pump
connection requirement for the current owner of 151 W. Linden Street, James A. Jackson, provided that
Mr. Jackson executes the written waiver agreement as provided by the Village Attorney and that the
Village Administrator is authorized to sign that waiver agreement on behalf of the Village.” Motions
