June 20, 2017 ***VILLAGE BOARD MINUTES*** June 20, 2017 SAUKVILLE MUNICIPAL CENTER 639 E Green Bay Ave SAUKVILLE, WISCONSIN Village President Barb Dickmann called the meeting to order at 8:00 p.m. Village Clerk Mary Kay Baumann gave the Statement of Public Notice. Members: Barb Dickmann-present, Dan Sauer-present, David Maglio-present, Mike Krocka-present, Michael Gielow-present, Joe Caban-present, and Scott Fischer-present Others Present: Dawn Wagner, Mary Kay Baumann, Chief Goetz, Sgt. Ramthun, Ray deBruijn, Ray Hartmann, Ross Brooks-U-Haul, and John Morton-Ozaukee Press. PLEDGE OF ALLEGIANCE CITIZEN COMMENTS AND QUESTIONS None. APPROVE MINUTES OF MAY 16, 2017 MEETING Maglio/Krocka made a motion to approve the May 16, 2017 minutes as presented. Motion carried. COMMUNICATIONS REPORT FROM THE VILLAGE PRESIDENT Dickmann requested a motion to re-affirm the appointment of John Ross to the Joint Review Board. Gielow/Krocka made a motion to re-affirm the appointment of John Ross to the Joint Review Board. Motion carried. REPORT FROM THE VILLAGE ADMINISTRATOR No report. PUBLIC HEARING - to hear comments on a proposed Zoning Ordinance Text Amendment to create § 205-57.P to allow propane refill/dispensing stations as a Conditional Use in the B-4 Highway Shopping Center Business District and a proposed Zoning Ordinance Text Amendment to amend § 205-15.B to provide for a Temporary Occupancy Permit and to amend § 205-89.B regarding calculation of total lifetime structural repairs and alterations for nonconforming uses. Wagner gave an overview of the proposed Ord. #776. Wagner stated that the Plan Commission reviewed the ordinance at its May 2, 2017 Meeting. Wagner stated that there is a proposed language change that would allow for a propane refill/dispensing stations in the B-4 Zoning as a Conditional Use. The proposed language includes a 13 ft. maximum for a propane tank. The area would also require fencing and/or vegetation. Wagner stated that if early occupancy is requested, a bond will be required prior to the issuance of early occupancy. The early occupancy certificate shall bear an expiration date. Wagner stated that language regarding existing non-conforming structures has also been updated. Sauer asked if this would be the only propane filling/dispensing station in the Village. Wagner stated yes.  June 20, 2017 Caban asked if the Fire Department would be involved. Wagner stated that the Fire Department would review the proposal. Ross Brooks, U-Haul, stated that in reviewing the proposal, the tank is actually 13 ft., 3 inches. 3 inches over the 13 ft. limit. After discussion it was determined that the ordinance language would be changed to “overall structure height shall not exceed 159 inches”. CLOSE PUBLIC HEARING Hearing no other comments, Dickmann requested a motion to close the Public Hearing. Sauer/Krocka made a motion to close the Public Hearing. Roll call vote was taken with all in favor. Motion carried at 8:18 p.m. ORDINANCES – RESOLUTIONS – PETITIONS Ord. #776 - Creating §205-57.P – Business Uses and Amending §205-15.B – Certificate of Compliance and Occupancy Required; Floodland Requirements, and §205-89.B – Existing Non-Conforming Uses. Sauer/Krocka made a motion to waive the first reading of Ord. #776 - Creating §205-57.P – Business Uses and Amending §205-15.B – Certificate of Compliance and Occupancy Required; Floodland Requirements, and §205-89.B – Existing Non-Conforming Uses. Motion carried. Krocka/Maglio made a motion to waive the reading of Ord. #776 - Creating §205-57.P – Business Uses and Amending §205-15.B – Certificate of Compliance and Occupancy Required; Floodland Requirements, and §205-89.B – Existing Non-Conforming Uses. Motion carried. Krocka/Sauer made a motion to approve Ord. #776 - Creating §205-57.P – Business Uses and Amending §205-15.B – Certificate of Compliance and Occupancy Required; Floodland Requirements, and §205-89.B – Existing Non-Conforming Uses with the wording change in Section 205.57.P to “overall structure height shall not exceed 159 inches”. Motion carried. Res. #1260 – 2016 CMAR Report Dickmann read Res. #1260 – 2016 CMAR Report. Sauer/Fischer made a motion to approve Res. #1260 – 2016 CMAR Report as presented. Motion carried. Res. #1261 - Resolution Amending Final Resolution Authorizing Public Improvements and Levying Special Assessments Against Benefitted Properties Krocka/Caban made a motion to waive the reading of Res. #1261 – Resolution Amending Final Resolution Authorizing Public Improvements and Levying Special Assessments Against Benefitted Properties. Motion carried. Sauer/Krocka made a motion to approve Res. #1261 - Resolution Amending Final Resolution Authorizing Public Improvements and Levying Special Assessments Against Benefitted Properties. Motion carried. REPORTS OF VILLAGE BOARD COMMITTEES Utility Committee No report. Public Works Committee No report. Public Safety Committee Maglio reported on the meeting of June 20, 2017.  June 20, 2017 Discussion was held regarding safety concerns on Foster Drive with the semi traffic. Chief Goetz will be contacting the DOT regarding the timing of the lights on STH 33 and Foster Drive. The new incentive program for the EMS is working well. Finance Committee Dickmann reported on the meeting of June 20, 2017. Claims for May in the amount of $621,761.01 were reviewed and approved. The Budget Watch and Investment Report were reviewed. Resolutions #1261 and #1262 were reviewed and recommended to the Village Board for approval. OTHER MATTERS The Utility Department received recognition from Ozaukee Christian for the great job they are doing on the project and their help with the lateral issue at the school. Jean DeGrave, Church St. resident, called and commented on what a great job the onsite inspector and staff is doing on the project. Curb & gutter on Center Street and Tower Street will be poured this week. Live @ the Triangle received an award from the Saukville Chamber honoring its 10 year anniversary. The August 15th Village Board Meeting has been moved to August 22nd. REPORTS OF SPECIAL COMMITTEES Plan Commission Dickmann reported on the meeting of June 20, 2017. Minutes of the May 2, 2017 meeting were reviewed and approved. A request for fencing at Eddie’s Service, Inc., 150 N. Riverside Drive, was reviewed and approved. A request for updates to the exterior faced at Blau’s Saukville Meats, 501 E. Green Bay Ave., was reviewed and approved. A request for new and updated signs at VAC Saukville Animal Hospital, 303 W. Dekora St., was reviewed and approved. The Village received a letter from Wal-Mart stating that the exterior of the building will remain tan as requested by the Village. Community Development Authority/Industrial Review Committee Dickmann reported on the meeting of June 20, 2017. Minutes of the April 18, 2017 meeting were reviewed and approved. A request for a modified site plan and fencing at Dawgs in Motion, 508 N. Dekora Woods Blvd, was reviewed and approved. A request for a parking lot expansion in association with a scrap pre-heater project at Charter Steel, 1658 Cold Springs Road, was reviewed and approved. A request for a proposed Accessory Storage Building and Site Plan, and Landscaping Plan for Standard Machine, 301 N. Progress Drive, was reviewed and approved.  June 20, 2017 Library Board Report on the meeting of June 13, 2017. Caban stated that he did not attend the meeting but shared that Kathy Lepak has resigned and Martin Morante-Rodriguez would be taking the position vacated by Lepak. Mid-Moraine Municipal Association The next meeting is scheduled for September. OPERATOR’S LICENSE APPROVALS Krocka/Maglio made a motion to approve the Renewal Operator License Applications for Anderson for Mel’s Club 33, Allen for Firehouse Restaurant, Gaudet and O’Donnell for Railroad Station, and Baumann for J’Sports Bar. Motion carried. Krocka/Fischer made a motion to approve New Operator License Applications for Pritchett for Wal-Mart, Guerrero for Firehouse Restaurant, Hilton for Tri-Par, and Seaver for Rally Time. Motion carried. LIQUOR LICENSE APPROVALS None. CITIZEN MATTERS AS NOTICED None. ADJOURNMENT Krocka/Maglio made a motion to adjourn to July 11, 2017.
