April 20, 2021 ***VILLAGE BOARD MINUTES*** April 20, 2021 SAUKVILLE POLICE DEPARTMENT and VIA ZOOM 649 E. GREEN BAY AVE., SAUKVILLE, WI 53080 Village President Barb Dickmann called the meeting to order at 7:00 p.m. Village Clerk Mary Kay Baumann gave the Statement of Public Notice. Members: Barb Dickmann-present, David Maglio-present, Richard Belling- present, Scott Fischer- present, Trevor Seitz-present, Jim Nowlen-absent, and Andy Hebein-present. Others Present: Dawn Wagner, Mary Kay Baumann, Maureen Hartjes (via Zoom), Chief Meyer, Ray DeBruijn, Dan Helm, Sara deBruijn, Holly Skelton (via Zoom), Mike Krocka, Sean Sullivan (R&M), Mary Lynn Schmid, Bob Schmid, Barbara Schwister, Tim Schwister, Linda Dolezal, Brigid Stucky and Peggy Stucky PLEDGE OF ALLEGIANCE CITIZEN COMMENTS AND QUESTIONS None. CEREMONIAL OATHS OF OFFICE Clerk Baumann stated that the Village President and 3 Trustees had already taken their official oaths prior to the meeting. Baumann administered the Ceremonial Oaths to President Dickmann and Trustees Belling, Hebein, and Maglio. TRUSTEE APPOINTMENTS Maglio/Belling made a motion to approve the Trustee appointments as presented. Seitz stated that he did not feel that spouses should serve on the same committees. Seitz added that he would like to see an announcement made to the public regarding available positions on committees. Motion carried with Seitz voting Nay. COMMITTEE APPOINTMENTS Dickmann stated that she would ask for a motion for Committees by page. Dickmann asked for a motion to approve the following: Architectural Review Board – Jim Nowlen (chair) Board of Review – Barb Dickmann (chair) Cemetery Commission – Trevor Seitz (chair) Community Development Authority/Industrial Review Committee – Barb Dickmann (chair) Finance Committee – Barb Dickmann (chair) Maglio/Hebein made a motion to approve the committees listed above with appointed committee chairs. Motion carried. Dickmann asked for a motion to approve the following: Library Board – David Maglio (Board representative) Mid-Moraine Legislative Committee – Jim Nowlen (Board Representative) Plan Commission – Barb Dickmann (chair) April 20, 2021 Public Safety Committee – Andy Hebein (chair) Public Works Committee – Trevor Seitz (chair) Belling/Hebein made a motion to approve the committees as listed with appointed committee chairs. Motion carried. Dickmann requested a motion to approve the following: Utility Committee – Scott Fischer (chair) Board of Zoning Appeals – Andy Hebein (chair) Fire Department Manpower Study Sub-Committee – Dawn Wagner (chair) July 4th Committee – Mary Kay Baumann (staff representative) Maglio/Hebein made a motion to approve the committees as listed with appointed committee chairs. Motion carried. Dickmann stated that at 4:00 pm today the Village received a call from Mark Haessly stating that he would not be able to continue his appointment to the Public Safety Committee. Dickmann did reach out to someone that had a previous interest but also asked if anyone had a person that would be interested to please give her the information. A new appointment for the Public Safety committee will take place at the May 4th Village Board meeting. APPROVE MINUTES OF APRIL 13, 2021 MEETING Maglio/Belling made a motion to approve the April 13, 2021 minutes as presented. Motion carried. COMMUNICATIONS REPORT FROM THE VILLAGE PRESIDENT No report. REPORT FROM THE VILLAGE ADMINISTRATOR No report. PUBLIC HEARING – to hear all interested parties regarding Colonial Parkway Special Assessments for Public Improvements (7:06 pm) Sean Sullivan-Ruekert & Mielke gave an overview of the Colonial Parkway Project. The project will start at Deer Pass Road and continue south to Cedar Sauk Road. Sullivan stated that all corners will be ADA compliant. Homeowners will not be assessed for any sidewalk or curb replacement related to the ADA compliance requirements. Sullivan stated that the Village has hired Payne & Dolan as the contractor for the project. He explained the process of awarding a project to a contractor. Sullivan stated that Payne & Dolan was the low bidder for the project and the Village has worked with them successfully on previous projects. Sullivan explained the low bid process for the Village. Sullivan stated that homeowners will have access to their properties at all times. Sullivan added that the only time they may have to park on the street is during the pouring and curing of the concrete. Homeowners will be notified when that work is to be done. Sullivan also stated that if a homeowner has a special situation in which the work on a project would affect them, they need to communicate that to him. Sullivan encouraged open communication between the Village, residents, and R & M. This will make the project move much smoother. A resident asked about the work to be done that is the responsibility of the homeowner. Sullivan stated that April 20, 2021 some contractors, time permitting, will complete work for homeowners while they are on site. This work would be the financial responsibility of the homeowner. It was asked how the cost estimates are determined. Sullivan stated that it is a best educated guess based on previous projects. Sullivan noted that if a resident is being assessed for a certain amount and it comes in less, that homeowner will be charged the lesser amount. If the charge comes in over, the resident will only be charged for what the assessment listed, not more. deBruijn stated that, based on conversation he had with one of the residents, Expediters Inc. came in and televised and realized that all but 5 of the properties were already connected to the storm sewer system and those 5 properties, have laterals that need to be connected. deBruijn added that the Village does not have any record of the installation of those laterals. Tim Schwister stated that he is assisting one of the residents with their home that is going into escrow. He wanted to know how that would be handled. Wagner stated that the assessment would be a lien against the property. Sullivan stated that residents will receive an update every other week, usually in the form of a hanger on their front door. It was asked who pays if the contractor cracks the sidewalk or driveway. Sullivan stated that, at the beginning of the project, they will walk through and take pictures. If any new damaged is incurred by the contractor, the contractor will be responsible for the repair and associated cost. Another resident asked about widening approaches. Sullivan stated that, yes, they will work with the homeowner to either widen and/or move the approach to line up with the driveway at the expense of the homeowner. deBruijn stated that they will be replacing all storm sewers and catch basins, adding that 2 areas will have double catch basins installed. It was asked how the grass/landscaping will be replaced. Sullivan stated that the Village will be doing something different with this project. The Village will be hiring a separate contractor to do the repair/replacement of grass. Hopefully this will result in a better outcome for the homeowners. Wagner explained the current payment plan on the assessments: Assessments shall be due within 45 days of billing date. • Less than $200 shall be paid in one (1) installment • $200 or more but less than $1,000 may be made in three (3) annual installments • $1,000 or more but less than $3,000 may be made in five (5) annual installments • $3,000 or more but less than $5,000 may be made in sever (7) annual installments • $5,000 or more may be made in ten (10) annual installments All payments may be paid in cash to the Village Treasurer or in installments as described above. Installments shall be place on the tax roll commencing with the 2021 tax year and shall bear a fixed annual interest of 4.25% per year from November 1, 2021. Wagner stated that if you have a payment plan, you will not incur interest if you make the minimum payment by November 1st each year. Baumann explained that if you have a $6,000 assessment and have 7 years to pay it you would only be charged April 20, 2021 interest on the yearly payment if it goes on the tax roll. You do not accrue interest on the full amount. Hearing no other comments, Dickmann requested a motion to close the Public Hearing. Belling/Maglio made a motion to close the Public Hearing. Roll call vote was taken with all in favor. Motion carried at 7:35 p.m. ORDINANCES – RESOLUTIONS – PETITIONS Res. #1333 – Final Resolution Authorizing Public Improvements and Levying Special Assessments – Colonial Pkwy Project Fischer/Hebein made a motion to waive the reading of Res. #1333 – Final Resolution Authorizing Public Improvements. Motion carried. Dickmann stated that the 4.25% seemed high. Discussion was held about lowering the assessment rate. Seitz asked if the rate could be changed to 0.5% over prime instead of 1%. Wagner stated that the current policy requires an interest rate of 1% above the prime rate at the time of special assessment. Wagner noted that the Village needs to collect a minimum of 0.54% to cover its debt service. That does not include any administrative fees, it was noted however, the Village could charge a maximum administrative fee of 2% for a total of 2.54%. After further discussion the recommendation was made to charge what is required to cover the Village’s debt service payments (0.54%) plus an administrative fee of .5%. Also discussed was the concept of a minimum interest rate (3%). It was determined that the resolution should be Tabled until the wording for the resolution is amended and reviewed. Seitz/Belling made a motion to Table Res. #1333 – Final Resolution Authorizing Public Improvements and Levying Special Assessments – Colonial Parkway Project. Motion carried. REPORTS OF VILLAGE BOARD COMMITTEES Utility Committee No report. Public Works Committee No report. Public Safety Committee Maglio reported on the meeting of April 20, 2021. The Fire Department is doing updates to Chp. 101 – Fire Prevention, Protection, and Control Code. The Fire Department is now combining its training with the Village of Grafton Fire Department. The Police Department recently issued 2 Life Saving Awards. The Village is in the process of eliminating the river gauge on Riverside Drive. Finance Committee The Finance Committee Meeting scheduled for today was cancelled. REPORTS OF SPECIAL COMMITTEES Plan Commission None. April 20, 2021 Community Development Authority/Industrial Review Committee None. Library Board NO report. Mid-Moraine Municipal Association No report. LIQUOR LICENSE APPROVALS None.
