June 8, 2021 ***VILLAGE BOARD MINUTES*** June 8, 2021 SAUKVILLE POLICE DEPARTMENT and VIA ZOOM 649 E. GREEN BAY AVE., SAUKVILLE, WI 53080 Village President Barb Dickmann called the meeting to order at 6:30 p.m. Village Clerk Mary Kay Baumann gave the Statement of Public Notice. Members: Barb Dickmann-present, Richard Belling-present, Scott Fischer-present, Trevor Seitz-present, Jim Nowlen-present, and Andy Hebein-present. Others Present: Dawn Wagner, Mary Kay Baumann, Chief Meyer, John Schantz, Roger & Jill Verhunce, Stephen Zehnder, Nicholas & Jennifer Thill, Suzanne Flynn, and Connor Carynski-Ozaukee Press PLEDGE OF ALLEGIANCE CITIZEN COMMENTS AND QUESTIONS None. APPROVE MINUTES OF MAY 18, 2021 MEETING Seitz/Nowlen made a motion to approve the minutes of the May 18, 2021 meeting. Motion carried. COMMUNICATIONS REPORT FROM THE VILLAGE PRESIDENT Dickmann stated that Seitz shared an e-mail with the Board regarding chickens being allowed in the Village. Dickmann stated that Village staff will follow up with this request. REPORT FROM THE VILLAGE ADMINISTRATOR None. PUBLIC HEARING - TO CONSIDER A PETITION SUBMITTED BY STEPHEN ZEHNDER TO REZONE A 6.91-ACRE PARCEL OF LAND OWNED BY HIM AT 743 S. MAIN STREET, TAX KEY NO. 11-050-06-08-005 FROM R-3 SINGLE-FAMILY RESIDENTIAL DISTRICT TO A-1 AGRICULTURAL DISTRICT Dickmann read an e-mail from Carol Rosewitz (attached), neighbor to the subject property, stating concerns with property values and wants the property to remain residential. Suzanne Flynn, next door neighbor, stated that she used to own this property and she and her husband tried to develop the land and they were told no. These people want to do something that is non-offensive and she can’t understand why it’s not allowed. Wagner asked when she tried to develop the property. Flynn stated that it was in 2000 and was told that the Village would never let them develop that property. Wagner stated that the Board was provided with all of the information submitted by Mr. Zehnder and all the information that was distributed for the May 4th Plan Commission Meeting. Zehnder stated that they moved here a short time ago. They would like to have chickens and need agricultural zoning. The current R-3 Residential District zoning does not allow for any farm animals. Dickmann stated that at the Plan Commission the thought was that the Village would be moving away from community by approving. Belling stated that the Plan Commission felt that the decision should be based on highest and best used of the property and that would be residential. June 8, 2021 Flynn reiterated that the Village turned down any development. Wagner stated that it was 21 years ago and the Zoning Code has been updated since that time. Discussion continued regarding what animals Zehnder would like to have, including but not limited to, chickens and goats. Wagner explained the procedural process to petition for a change to the zoning code to allow for chickens in a residential district. She stated that an individual would have to petition for a zoning code text amendment. Zehnder stated that he would like more than just chickens. Nicholas Thill, who lives across the street, stated there is plenty of land there and doesn’t see the issue with the re-zoning. He added that he is not worried about his property values. Belling stated that he still believes it should remain residential. Flynn stated that you are rendering the property useless since the Village will not allow residential expansion in that area. Wagner stated again that the Zoning Code has been updated from 21 years ago. Wagner stated that the Village looks at all aspects of the property when considering development in the Village. Belling wanted to know why someone would not want to develop the property. Wagner added that Zehnder knew the zoning classification of the property when he purchased it. Fischer stated that he is of the mind that it is his property, let him do what he wants with it. Wagner stated by changing the zoning the property owner would be able to have whatever animals are allowed in the agricultural zoning district. Dickmann read the regulations/limits on animals for agricultural zoning. Fischer said the next owner can just change it back. Wagner stated that the Village does not change it back. The new owner would have to petition to have the property rezoned to residential. CLOSE PUBLIC HEARING Hearing no other comments, Dickmann requested a motion to close the Public Hearing. Belling/Seitz made a motion to close the Public Hearing. Roll call vote was taken with all in favor. Motion carried at 7:10 p.m. ORDINANCES – RESOLUTIONS – PETITIONS Ord. #808 –Rezoning Property within the Village Limits from R-3 Single Family Residential District to A-1 Agricultural District – 743 S. Main St. Belling/Hebein made a motion to waive the first reading of Ord. #808 – Rezoning Property within the Village Limits from R-3 Single Family Residential District to A-1 Agricultural District – 743 S. Main St. Motion carried. Fischer/Nowlen made a motion to waive the reading of Ord. #808 – Rezoning Property within the Village Limits from R-3 Single Family Residential District to A-1 Agricultural District – 743 S. Main St. Motion carried. Belling/Nowlen made a motion to deny Ord. #808 - Rezoning Property within the Village Limits from R-3 Single Family Residential District to A-1 Agricultural District – 743 S. Main St. Roll call vote was taken: Seitz – abstain (not enough information) Fischer – nay Belling – aye June 8, 2021 Nowlen – aye Hebein – aye Dickmann – aye Motion carried. Ord. #809 – Amending §§ 55-2{9}H and 55-25 – Class “B” Liquor License Seitz/Belling made a motion to waive the first reading of Ord. #809 - Amending §§ 55-2{9}H and 55-25 – Class “B” Liquor License. Motion carried. Belling/Nowlen made a motion to waive the reading of Ord. #809 - Amending §§ 55-2{9}H and 55-25 – Class “B” Liquor License. Motion carried. Seitz/Belling made a motion to approve Ord. #809 - Amending §§ 55-2{9}H and 55-25 – Class “B” Liquor License. Motion carried. Res. #1335 – 2020 CMAR REPORT Dickmann read Res. #1335 – 2020 CMAR Report. Nowlen/Hebein made a motion to approve Res. #1335 – 2020 CMAR Report. Motion carried. REPORTS OF VILLAGE BOARD COMMITTEES Utility Committee Fischer reported on the meeting of June 8, 2021. Committee reviewed the 2020 CMAR Report. Updates were provided on the lift station upgrades. The Utility Department is working on the water/sewer extension by the Fire Department. The deep well at Well #3 is being replaced. The Utility Dept dealt with a water main break on S. Dries St. on Monday morning. Public Works Committee No report. Public Safety Committee No report. Finance Committee Dickmann reported on the meeting of June 8, 2021. A recommendation was made to the Village Board to approve the Amended Agreement – 535 W Dekora Street with a change of date to October 31, 2021. Belling/Hebein made a motion to approve the Amended Agreement – 535 W. Dekora Street with a change of date to October 31, 2021. Motion carried. Committee went into Closed Session with no action being taken. A recommendation was made to the Village Board to approve a Memorandum of Understanding – Village of Saukville & Neumann Developments, Inc. Nowlen/Belling made a motion to approve the Memorandum of Understanding – Village of Saukville & Neumann Developments, Inc. Motion carried. A recommendation was made to the Village Board to approve a Reimbursement Agreement – Neumann Developments, Inc. June 8, 2021 Seitz/Nowlen made a motion to approve a Reimbursement Agreement – Neumann Developments, Inc. Motion carried. A recommendation was made to the Village Board to authorize staff to negotiate a License Agreement with Jeneil Biotech allowing installation of private sewer lines in the Public Right-of-Way between 651 N. Dekora Woods Blvd and Jeneil Biotech Pre-Treatment Plant on Technology Way. Minutes of the May 4, 2021 meeting were reviewed and approved. Landscape plan, dumpster enclosure, equipment enclosure, and canopy for 150 S Foster Street were reviewed and approved. A recommendation was made to the Village Board to approve a land division by Certified Survey Map for property at 655 N. Riverside Drive, Tax Key #11-050-05-01.010, seeking to divide a 72,130 square foot parcel into two parcels, one of 41,017 square feet and the other of 31,113 square feet.
