Councilmember offered the following: A Resolution Adopting the 2022-2023 Annual Action Plan WHEREAS, the City of Schenectady is required under Title 24 Code of Federal Regulations Part 91 to submit to the U.S. Department of Housing and Urban Development (HUD) an Annual Action Plan, which carries out the City’s Consolidated Plan and provides a concise summary of the actions and activities that it will pursue for its use of Community Development Block Grant (CDBG), HOME Investment Partnerships (HOME), and the Emergency Solutions Grant (ESG) program funding; D WHEREAS, the City of Schenectady will receive $3,501,950.00 in CDBG, HOME, and ESG funding; and RA WHEREAS, a thirty (30) day comment period was declared from April 5, 2022 through May 5, 2022 and a public hearing was held on April 25, 2022 at 7:00 p.m.: NOW THEREFORE BE IT, FT RESOLVED, the City Council adopts the attached “City of Schenectady 2022-2023 Annual Action Plan,” with proposed funding totaling $3,501,950.00; and be it further RESOLVED, that the Mayor or his designee is authorized to execute all necessary contracts pursuant to the implementation of the 2022-2023 Annual Action Plan. Councilmember offered the following: A Resolution Authorizing Fee Waivers for Exterior Building Repair Permits WHEREAS, Chapter 138 of the Schenectady City Code allows for building permit fees to be set by resolution: NOW, THEREFORE BE IT, D RESOLVED, that a building permit fee waiver shall be created, the terms of said waiver is attached and hereby incorporated to this resolution by reference. Corporation Counsel 5 Permit Fee Waiver: Waiver of (Application Fee) for projects that qualify from the following criteria: The scope of the work for the permit is for essential repairs and improvements, such as roof repair / replacement, siding repair/ replacement, porch repair/ replacement, windows replacement, garage, fencing or any exterior repairs / replacement to an existing owner occupied and rental property up to 4 units. If a building project has multiple permits, the maximum permits value of $35,000 will apply to the combined total of all permits and not to each individual permit. DRA 2022 $56 Application Fee for Exterior Permits $100 for Roof Permit FT Permit Fee Waiver Period: Beginning June 1, 2022 until August 31, 2022  Residential Properties (1 to 4 Units)  For this program, building permits must be pulled within the pilot period of June 1, 2022 to August 31, 2022.  In order to close a building permit all works, required documents and inspections are to be completed within 12 months.  If after 12 months the permit remains incomplete, a building permit renewal is required with full permit fees.  Property taxes must be current, and verification of payments must be done by code enforcement office. 6 City of Schenectady, New York RESOLUTION No.: Councilmember John Mootooveren offered the following: A Resolution Authorizing the City to Enter into an Agreement with the U.S. Department of Justice under the Bulletproof Vest Partnership Grant Program FY2021. WHEREAS, the City of Schenectady seeks to enter into an agreement with the U.S. Department of Justice (DOJ) to receive funding under the Fiscal Year 2021 Bulletproof Vest Partnership solicitation grant; and D WHEREAS, the DOJ will provide funds in the amount of $15,033.60 to the City of RA Schenectady for the purpose of purchasing National Institute of Justice compliant armored bulletproof vest: NOW, THEREFORE BE IT FT RESOLVED, that the City Council hereby authorizes the Mayor or his designee to enter into an agreement between the City of Schenectady and DOJ to purchase the vest described hereinabove, the terms of which shall be set by the Corporation Counsel. Councilmember offered the following: A Resolution Accepting an Engineering Planning Grant from NYS Environmental Facilities Corporation WHEREAS, the City of Schenectady has been awarded a $50,000 grant from NYS Environmental Facilities Corporation (EFC), as part of the Engineering Planning Grant Porgram; and D WHEREAS, the grant is for the preparation of a preliminary engineering report for the Mohawk River Inflow Reduction Program; and RA WHEREAS, under the grant program, there must be a local match of at least 20% of the EFC grant award; and WHEREAS, the source of the local match, and any amount in excess of the required match, shall be paid using general water funds; and FT WHEREAS, the proposed study and report associated with the Mohawk River Inflow Reduction Project is a Type II action in accordance with 6 NYCRR Section 617.5(c)(24) pertaining to “information collection, including basic data collection and research; water quality and pollution studies; traffic counts; engineering studies; surveys; subsurface investigations; and soils studies that do not commit the agency to undertake, fund or approve and Type I or Unlisted action”; and Section 617.5(c)(27) for “conducting concurrent environmental, engineering, economic, feasibility and other studies and preliminary planning and budgeting processes necessary to the formulation of a proposal for action, provided those activities do not commit the agency to commence, engage in or approve such action.” Therefore, the proposed data collection and preparation of a preliminary engineering report is not subject to further review under 6 NYCRR Part 617: NOW, THEREFORE BE IT RESOLVED, that this Council, authorizes the Mayor, or his designee, to execute a grant agreement with NYS Environmental Facilities Corporation and any additional documentation to effectuate receipt the grant funds, the terms of said agreement to be set by the Corporation Counsel. 8 Approved as to form this 23rd day of May, 2022. __________________________ Andrew B. Councilmember offered the following: A Resolution Authorizing the City to Enter into a Contract with CARES of NY, Inc. for a Needs Assessment WHEREAS, through the Schenectady HOMES Consortium, the City of Schenectady, the City of Troy, and the Town of Colonie are eligible for $3,832,771 of HOME Investment Partnership Program (HOME) funding for Participating Jurisdictions to assist individuals or households who are homeless or at risk of homelessness, and other vulnerable populations; and D WHEREAS, the Schenectady Consortium must conduct a needs assessment to determine the highest priorities and best use of the funds; and RA WHEREAS, the needs assessment will provide an analysis of homelessness, risks of homelessness, and risks to other vulnerable populations in all three municipalities, as well as recommendations for coordinated efforts to combat homelessness across the consortium. FT WHEREAS, CARES of NY, Inc. has submitted a proposal to conduct the needs assessment for the Schenectady Consortium; and WHEREAS, the City seeks to enter into a agreement with CARES of NY, Inc. to conduct the needs assessment and prepare an allocation plan for a not-to-exceed amount of $45,000 of HOME American Rescue Plan (ARP) funding: NOW, THEREFORE BE IT, RESOLVED, that the City Council authorizes the Mayor to enter into an agreement with CARES of NY, Inc. to conduct the needs assessment and prepare an allocation plan for a not-to- exceed amount of $45,000 of HOME ARP funding, the terms of said agreement to be set by the Corporation Counsel; and be it further RESOLVED, that the City Council authorizes the Mayor or his designee to execute all necessary agreements to effectuate this resolution, the terms of said agreements to be set by the Corporation Counsel. 10 Approved as to form this 23rd day of May, 2022. ____________________________ Andrew B. Councilmember offered the following: A Resolution Authorizing the Sale of a Vacant Lot at 28 Kelton Avenue for $5,000 WHEREAS, it is in the best interest of the City of Schenectady to sell parcel numbered SBL # 49.50-5-16; and WHEREAS, there is no municipal use for the property: NOW, THEREFORE BE IT, D RESOLVED, that the City Council authorizes the Mayor to enter into a contract to transfer the RA title of parcel numbered SBL # 49.50-5-16 to Lakram Rohit and/or assign for the sum of Five Thousand Dollars ($5,000.00); and be it further RESOLVED, that the terms of the contract for sale shall include a clause requiring that the purchaser obtain any required approvals, including a use variance and site plan approval, if necessary, FT from the Zoning Board of Appeals and/or the Planning Commission prior to the transfer of title, as well as any other terms deemed necessary by the Corporation Counsel. Councilmember offered the following: A Resolution Authorizing the Sale of a Vacant Lot on Willowcreek Avenue WHEREAS, it is in the best interest of the City of Schenectady to sell parcel numbered SBL # 60.40-2-21.2; and WHEREAS, there is no municipal use for the property: NOW, THEREFORE BE IT, D RESOLVED, that the City Council authorizes the Mayor to enter into a contract to transfer the RA title of parcel numbered SBL # 60.40-2-21.2 to Paul Lafond, Jr. and/or assign for the sum of Three Thousand Five Hundred Dollars ($3,500.00); and be it further RESOLVED, that the terms of the contract for sale shall include any terms deemed necessary by the Corporation Counsel. D Evaluation/Analysis: RA 145 Barrett St is located in the C-4 Downtown Mixed-Use District, between Franklin St and State St. The property is a three-story brick and wood frame structure believed to be originally constructed as a residential townhouse between 1899 and 1900. Most recently the Property was utilized as a jazz club through the 90s until its closure in 2013. Historically, the property was most notably known as the Carpenter’s Union Hall serving as the meeting hall for the Brotherhood of Carpenters and Joiners of FT America, Local Union No. 146 from 1928 to 1985. Designating this property as a historic structure and including it within the “OH” Overlay Historic District would open the potential for historic tax credits, while also applying the review standards required for historic properties pursuant to Article X of the Zoning Ordinance. Applicant seeks designation of the structure as a historic structure pursuant to Schenectady City Code § 264-75 and application of the “OH Overlay Historic District” (Schenectady City Code § 264-20) to the parcel. FT Section § 264-75 of the Schenectady Zoning Code provides for designation of a historic site or structure where it meets any of the following criteria: (a) Possesses special character or historic or aesthetic interests or value as part of the cultural, political, economic or social history of the locality, region, state or nation; (b) Is identified with historic personages or events; (c) Embodies the distinguishing characteristics of an architectural style; (d) Is the work of a designer whose work has significantly influenced an age; or (e) Because of a unique location or singular physical characteristic, represents an established and familiar visual feature of the neighborhood. After recommendation by the Historic District Commission, Planning Board and City Council, properties meeting the criteria for designation will have the OH Overlay Historic District zoning applied, the purpose of which “is intended to promote, maintain and enhance areas, buildings and neighborhoods of historic, architectural, cultural or aesthetic value and to promote the purpose and intent of Article X governing historic districts. The OH District provides a means of applying historic district review and protection to individual landmark buildings or to areas of diverse land use that may not reasonably be classified as either an RH-1 or RH-2 Historic District.” The Property qualifies for designation as 1) embodies the distinguishing characteristics of an architectural style; and 2) it possesses special character or historic or aesthetic interests or value as part of the cultural, political, economic or social history of the locality, region, state or nation. Photographs of the exterior and interior of the property are attached here as Schedule A. The parcel is shown as Lot No. 1 on the March 20, 1903 “Map of Property belonging to The Est. of Lewis M. Clements2.” While the survey shows the brick walls of neighboring structures, and the current legal description for the parcel references a neighboring brick dwelling, there is unfortunately no indication of a structure on the 1903 survey. The Sanborn maps dated 1894 and 1899 do not show a structure on the parcel either, however, by the release D of the 1900 map a structure is shown which matches the footprint of the current building. On or about September 30, 1903, title was passed to John M. Clement through sale from RA a court appointed referee for the Estate of Lewis M. Clement. References list 145 Barrett Street as the address for John M. Clement, who served as a Supervisor for the Schenectady Public Relief, and his wife Rosella Clement as early as 1899.3 John Clement’s time at 145 Barrett Street was short lived, as he died at some point between 1907 and 1909, leaving his wife the sole heir pursuant to his Last Will and Testament which was admitted to probate March 22, 1909.4 FT By May of 1915, she remarried to Vernon B. Crounse of 833 Albany Street in a ceremony “at the residence of the bride.” “The house was tastefully decorated with palms, potted plants and cut flower.”5 The house stayed with Rosella Crounse (formerly Clement) until March 8, 1923 when it was sold to a Sophia Hussong, and sold again in April 22, 1924 to Charles A. Sullivan and Annie Reinhard. During this period, and possibly during the end of Ms. Crounse’s ownership, the home housed boarders.6 This continued until 1928 which saw an advertisement for sale for, “ROOMING house to lease or for sale, furnished, brick building, 30 seconds to business section, always filled. Terms from owner.”7 Shortly thereafter, on July 2, 1928, the Brotherhood of Carpenters and Joiners of America, Local Union No. 146 took title. The Property underwent a substantial renovation in 1928 to accommodate the use as the Carpenter’s Union Hall. A large meeting hall and stage was constructed on the second floor with 15-foot coffered tin ceilings, while the first floor was converted to retail space also featuring period tin ceilings. During their ownership, newspaper records indicate that while the second floor was reserved for the Carpenter’s Union Hall meetings, and was let for other meetings and events, the first floor housed several commercial and retail ventures from 1928 to its conversion to a bar and music venue in the 1980s.8 Upon Applicant’s acquisition of title, the vestiges of the 1920s tin-clad union hall and retail use were largely obfuscated by a 1980s faux art deco sheet rock and drop ceiling shell built D within the 1920s floor plan. Demolition of these materials revealed period tin ceilings and plaster walls typical of the early 20th century. Records indicate that the Property was converted to commercial use around the time the Carpenter’s Union acquired title in 1928 and the property RA underwent a substantial renovation. While much of the plaster work has been destroyed due to moisture from improper insulation, the tin ceilings are largely intact, as are the windows, floor plan and maple floors from this period. Interior examination indicates the original structure was a ‘walk up’ townhouse lowered to street level presumably for the commercial conversion with an extension added to the back of the building for increased space. FT Perhaps best described as colonial revival, the exterior of the structure is entirely masonry and brick featuring two slate faced dormers with divided light windows on the top floor above a simple projecting cornice with built in gutter. The ornamentation and lintels are very basic and traditional for a commercial structure in the 20th century. The existing roof is asphalt and EPDM rubber. The store front is supported by a steel header with a simple metal cornice which provides a clean horizontal articulation between the building and the store front. The store front is not original to the structure and was replaced during the 1980s and again requires replacement. The store front contains vinyl windows which also require replacement. We have, unfortunately, not found any photographic record of the original store front. The Property remains one of the few historic properties left in what was once originally a residential street containing numerous townhouses along Barrett Street. The Property contains a considerable amount of its historic fabric related to its late 1920s conversion. Special character or historic or aesthetic interests or value as part of the cultural, political, economic or social history of the locality, region, state or nation In the wake of the Triangle Shirtwaist Fire of 1911, where nearly 150 mostly young women workers lost their lives, the worker rights movement exploded. Just months later, tens of thousands of men, women and children joined picket lines in Lawrence, Massachusetts in what would later be called the Bread and Roses strike. World War I was just a few years away from bringing production levels to new heights and just 30 years earlier, the nation's first Labor Day parade was held in New York City. The labor movement as we know it today -- the one that brought about the 5-day work week, overtime laws and an end to child labor -- was in full swing. And union membership meant union halls in New York State and around the nation were D bursting at the seams. In 1906, Schenectady was host to what was the United States' first sit-in strike as 2,000 to RA 3,000 workers at General Electric, members of the Industrial Workers of the World, initiated a strike to oppose plant management. The leading organizations in the city at the time were the Schenectady Labor Temple Association and the Schenectady Trades Assembly, chartered in 1898. They shared goals and often partnered with many other organizations, including fraternal organizations and churches. The City Teachers Association of Schenectady was founded in 1918 FT to promote standards of professionalism in teaching. Other active local unions represented carpenters, newspaper workers, hotel and restaurant workers, electricians, plumbers and pipe fitters, painters, bricklayers and laborers. Unions played a vital role in connecting thousands of new immigrants to both careers and community in Schenectady. By the late 1920s, the labor movement in Schenectady, as was the case across America, had weakened in number -- due to anti-labor court decisions and a string of pro-business presidents -- but not in spirit. Soon after the Great Depression, organized labor rebounded and soared to new heights as the New Deal brought new protections for workers and renewed support for organized labor. The Carpenter’s Union Hall was one of many union halls, and fraternal halls, throughout the city. In fact the neighboring property, now a law firm, served as both the Schenectady Lodge No. 480, Benevolent Protective Order of the Elks and later as Schenectady Lodge #227 Independent Order of Odd Fellows. Sadly, many of the expansive hall spaces, with their vaulted ceilings and period features, are lost or otherwise converted into multiple floors of apartments or offices. Carpenter’s Union Hall remains largely unaltered. Councilmember offered the following: A Resolution Authorizing the Settlement of a Claim by Yugeshwar Gaindarpersaud WHEREAS, claimant served the City of Schenectady with a Notice of Claim (2020-092); and WHEREAS, the Office of the Corporation Counsel has recommended that it would be in the best interest of the City to settle this matter; and D WHEREAS, the settlement proposal was accepted by the City Claims Committee: RA NOW, THEREFORE BE IT, RESOLVED, that the Office of the Corporation Counsel is authorized to enter into a settlement with Yugeshwar Gaindarpersaud to settle the claim for $40,000.00, the terms of which shall be set by FT the Corporation Counsel. These hydrants are required for public safety; and D WHEREAS, the Purchasing Department solicited and issued bids for “Furnishing Hydrants 2022.” A sole bid was received on May 4, 2022, from Ferguson Enterprises, Inc. d/b/a Ferguson Waterworks of Clifton Park, NY in the total amount of $167,212.00: RA NOW, THEREFORE BE IT, RESOLVED, that this Council, acting as a Board of Contract and Supply under FT Section C5-9 of the City Charter, authorizes the Mayor or his designee to enter into a contract with Ferguson Enterprises, Inc. d/b/a Ferguson Waterworks for the “Furnishing Hydrants 2022” in the amount of $167,212.00, the terms of which shall be set by the Corporation Counsel.
