Councilmember offered the following: A Resolution Authorizing the City to Enter into a Grant Agreement With NYS Environmental Facilities Corporation WHEREAS, the City of Schenectady has been negotiating an agreement with the New York State Department of Environmental Conservation (DEC) regarding the sewer collection system and overflows; and WHEREAS, in order for the City to resolve certain issues with it sewage collection system and, should the anticipated agreement with DEC become effective, to comply with the terms of said proposed agreement, the City must assess and make changes to the sewage collection system; and WHEREAS, by resolution 201 3-3 17, the City authorized a contract with CDM Smith to conduct a study; and WHEREAS there may be %rantmoney available to assist with the costs associated with the proposed study, with said grants requiring a minimum of a twenty percent (20%) match from the local municipality, with said match being as outlined on the annexed EPG Budget; and WHEREAS this Council has determined that the proposed study constitutes a Type I1 action and, therefore, is exempt from review: NOW, THEREFORE BE IT RESOLVED that either the Mayor or Paul LaFond, Supervisor of Water and Wastewater, is authorized to execute a Grant Agreement with the NYS Environmental Facilities Corporation aid any and all other contracts, documents and instruments necessary to bring about the Project and to fulfill the City of Sclienectady's obligations under the Engineering Planning Grant Agreement; and it is further RESOLVED that the City authorizes and appropriates a nrinimum 0 E 2 0 ~ ~ match as local required by the Engineering Planning Grant Program for the Wastewater Engineering Stud? WHEREAS, a the City is undertaking an engineering study of its wastewater facilities; and WHEREAS said study is only collecting information and does not commit to any action being taken; and WHEREAS 6 NYCRR Section 61 7.5 (Title 6 of the New York Code of Rules and Regulations) under the State Environnlental Quality Review Act (SEQR) provides that certain actions identified in subdivision (c) of that section are not subject to environmental review under the Environmental Conservation Law: NOW, THEREFORE BE IT RESOLVED, that the City of Schenectady hereby determines that the proposed Wastewater Engineering Study is a Type I1 action in accordance with 6 NYCRR Section 61 7.5(~)(18),(21) in that the same constitutes the "information collection including basic data collection and research, water quality and pollution studies, traffic counts, engineering studies, surveys, subsurface investigations and soils studies that do not commit the agency to undertake, fund or approve any Type I or Unlisted action; conducting concurrent environmental, engineering, economic, feasibility and other studies and preliminary planning and budgetary processes necessary to the formulation of a proposal for action. provided those activities do not commit the agency to commence, engage in or approve such action" and is therefore not subject to review under 6 NYCRR Part 61 7. The NFPS was inundated from severe flooding resulting from Hurricane Irene during the Fall of 201 1, at which time the Mohawk River's water level rose above the 100 yr flood elevation and raw sewage and river water breached the dividing wall between the wetwell and drywell areas flooding the interior of the pump station. The flooding of the pump station interior caused significant damage to the facility's electrical and control systems as well as emergency generator thereby rendering the facility inoperable until the flood waters subsided, at which time the City accessed the station and made repairs to the pump station to bring it back on line. Due to the age and condition of the existing pump station, the City has decided to pursue the construction of a new pump station to replace the existing pump station. EvaluationIAnalysis: The City sent out a Request for Proposals in October of 2013 for the above project. Proposals were received in sealed envelopes by the Water Department on November 18, 2013. The City then established a committee to review all proposals. Based on a unanimous decision of the review committee, it is the recommendation of the review committee that the City Council enter into a professional service agreement with MJ Engineering and Land Surveying, P.C. as the lowest responsible proposal in the amount of $175,800.00. Recommendation: Authorize the Mayor to enter into an agreement with MJ Engineering And Land Surveying, P.C. for the Engineering Report, Design, Construction Administration & Construction Inspection Services for the North Ferry Street Pump Station Replacement in the amount of $175,800.00. Subdivision 3 of section 103 of t h e General Municipal Law provides that the purchase o f materials, equipment and supplies, when available through County contracts extended t o political subdivisions in the County under County Law, 9408-a(2), are exempt from the competitive bidding requirements of the General Municipal Law, 9103(1). Schenectady County Department o f Engineering and Public Works solicited and issued uniform bids for "Hot-in-Place Recycling" available for County projects and municipal projects within the County and the lowest responsible bid was received from Highway Rehabilitation Corporation o f Brewster, New York. This work is t o be charged t o the Capital Budget Code that will be designated for the CHlPs fund.
