MINUTES Wednesday, January 6, 2016 Charter Revision 4 PM at Carnegie Town Hall Commission Meeting 235 West Tenth Street Members Present: Sue Aguilar, Jill Entenman, Pauline Poletes, Justin Smith, and Robert Thimjon Members Absent: None Staff Present: David Pfeifle, City Attorney; Cari Hanzel, Paralegal/Clerk; and Tamara Jorgensen, MMC, Assistant City Clerk 1. Call To Order Commission Chair Robert Thimjon called the meeting to order at 4 p.m. 2. Approval Of Minutes A. December 9, 2015 A motion was made by Sue Aguilar and seconded by Justin Smith to approve the minutes dated December 9, 2016. Thimjon called for a voice vote. All members voted yes. Motion Passed. 3. Old Business A. Charter Section 7.02(a)(1) - Prohibitions Review and discuss written proposal as suggested at the last meeting. Section 7.02 Prohibitions. (a) Activities prohibited. (1) No person shall be appointed to or removed from, or in any way favored or discriminated against with respect to any city position or appointive city administrative office because of race, gender, age, handicap, religion, country of origin, or political affiliation. City Attorney David Pfeifle reviewed the proposed language on this amendment. Discussion was held regarding adding the terminology “sexual orientation” to this listing as well as changing the word “handicap” to “disability”. Pfeifle provided additional information regarding protective classes. The proposed changes will read as follows: (1) No person shall be appointed to or removed from, or in any way favored or discriminated against with respect to any city position or appointive city administrative office because of race, gender, sexual orientation, age, disability, religion, country of origin, or political affiliation. A motion was made by Sue Aguilar and seconded by Pauline Poletes to accept the proposed changes. Thimjon called for a voice vote. All members voted yes. Motion Passed. There was no public input for this item. 4. New Business A. Charter Revision Commission - Draft Ballot and Summary Report by David Pfeifle, City Attorney The draft ballot was reviewed and discussed. There was no public input for this item. A motion was made by Justin Smith and seconded by Jill Entenman to accept the draft ballot with the understanding that the proposal recommended to the voters for Charter Section 7.02(a)(1) will be added to the ballot as “Amendment F”. Thimjon called for a voice vote. All members voted yes. Motion Passed. Pfeifle reviewed the summary report and explained the process to the Commission members. There was no public input for this item. A motion was made by Justin Smith and seconded by Pauline Poletes to approve the Summary Report with the understanding that information on Amendment F will be included. Thimjon called for a voice vote. All members voted yes. Motion Passed. 5. Public Input There was none. The final Charter Revision Commission Meeting is scheduled for Thursday, January 14, 2016, at 3:30 p.m. at the Carnegie Town Hall, to approve the minutes from the January 6, 2016 meeting. 6. Adjournment Chairman Thimjon thanked the staff and members of the Charter Revision Commission for their time, hard work, and diligence in serving on the Commission.
