MINUTES Wednesday, November 15, 2017 Charter Revision 4 PM at Carnegie Town Hall Commission Meeting 235 West Tenth Street Members Present: Sue Aguilar, Jill Entenman, Pauline Poletes, Justin Smith and Robert Thimjon Staff Present: Daniel J. Brown, Assistant City Attorney; and Cari Hanzel, Paralegal/Clerk 1. Call To Order Commission Chair Robert Thimjon called the meeting to order at 4 p.m. 2. Approval Of Minutes A. November 1, 2017 A motion was made by Justin Smith and seconded by Sue Aguilar to approve the minutes. A voice vote was taken, all members voted yes. Motion Passed 3. Old Business A. Charter Article II - City Council 1. Presented Amendment RE: Election by Plurality o Section 2.02. Composition, eligibility, election, and terms, (c) Election and terms After discussion, the commission recommended further review at the final meeting to determine if this proposed amendment will be added to the ballot. 2. Presented Amendment RE: Voting on Sales Tax Revenue Bonds o Section 2.11 Procedure, (c) Voting Council Member Christine M. Erickson provided information regarding the proposed amendment.  After discussion, the commission recommended further review at the final meeting to determine if this proposed amendment will be added to the ballot. 3. Presented Amendments RE: Removal of the Mayor from City Council o Section 2.02 Composition, eligibility, election and terms, (a) Composition o Section 2.03 Mayor o Section 2.06 Vacancies; forfeiture of office; filling of vacancies, (c) Forfeiture of office o Section 2.11 Procedure, (c) Voting No additional input was provided at this time. After discussion, the commission decided that this item will not be reviewed at the final meeting. B. Charter Article III - Mayor 1. Presented Amendment RE: Election by Majority o Section 3.02 Election and qualifications of mayor Council Member Greg Neitzert provided additional input regarding the proposed amendment. After discussion, the commission recommended further review at the final meeting to determine if this proposed amendment will be added to the ballot. 2. Presented Amendment RE: Removal of Mayor from City Council o Section 3.03 Mayor's duties and responsibility After discussion, the commission decided that this item will not be reviewed at the final meeting. 4. New Business A. Charter Article IV - Departments, Offices, and Agencies Discussion was held regarding the 2016 charter updates.  Council Member Theresa Stehly provided an overview of the following proposed amendment: Section 4.01 General provisions. (c) Parks & Recreation Board. The parks and recreation board shall be composed of seven members, each of whom shall be a registered voter of the city. Five members shall be appointed, one member from each of the city’s five districts that they reside in, as provided in City Charter Article VI, and two members shall be appointed without regard to a city council district. A member may complete their appointed term if their residency outside their district is caused during their term of office by a district adjustment pursuant to City Charter Section 6.02. This provision shall become effective August 1, 2024. Bruce Danielson provided input on this proposed amendment. Council Member Rex Rolfing provided input on this proposed amendment. Discussion was held regarding the creation of departments by the Charter. After discussion, the commission determined there would be no need for further review of the proposed amendment to Section 4.01 (c) at this time. B. Charter Article V - Financial Procedures There was no input or discussion. C. Charter Article VI - Elections Instant-runoff voting was discussed. After discussion, the commission determined this item would not be brought forward for additional consideration. 5. Public Input Rex Rolfing provided input regarding the following proposed amendments: election by plurality and voting on sales tax revenue bonds. Bruce Danielson provided input regarding the proposed amendment regarding election by plurality. Janet Brekke provided input regarding the drafting of the language for the  Charter Amendment with specific reference to election by plurality. Theresa Stehly provided input regarding the proposed amendment regarding election by plurality. 6. Open Discussion The Charter Revision Commission will meet again on: Wednesday, December 6, 2017, and Wednesday, December 20, 2017. Both meetings will be held at 4 p.m. at the Carnegie Town Hall, 235 W. 10th Street. Discussion was held regarding holding an additional meeting in January, 2018, to review and approve the draft report. This meeting date will be discussed and scheduled at a future meeting. 7.
