MINUTES Tuesday, March 5, 2013 Informational Meeting 4:00 PM at Carnegie Town Hall Sioux Falls City Council 235 West Tenth Street Members Present: Kenny Anderson Jr., James Entenman, Michelle Erpenbach, Greg Jamison, Dean Karsky, Rex Rolfing, Kermit L. Staggers, Sue Aguilar Members Absent: Mike T. Huether Staff Present: Lorie Hogstad, CMC, City Clerk; Jim David, Legislative/Operations Manager; David Bixler, Budget Analyst; and Rich Oksol, Lead Internal Auditor 1. Call To Order City Council Chair Michelle Erpenbach called the meeting to order at 4:00 p.m. 2. Staff Report A. Jim David, Legislative/Operations Manager Jim David reported on the 2013 Legislative Session. The legislators will be working through March 8 and will recess to provide an opportunity for the Governor to reconsider and veto bills. Legislators will return on March 25 with the potential to override any vetoes. David will continue to watch SB51 regarding sales tax collection allowance; he noted that HB1120 regarding sewer utility rates and charges is awaiting the Governor's signature; and that HB1108 regarding the open meeting law has been tabled. 3. Land Use Committee A. Report on meeting held Tuesday, February 19, 2013 Council Member Rex Rolfing, Chair of the Land Use Committee, stated the committee reviewed the final report from the Urban Agriculture Task Force Committee. A proposed ordinance will be coming to the full Council on March 12, 2013 for first reading. Rolfing added that this topic generated a great deal of feedback from the public. 4. City Council Open Discussion Erpenbach said that one of the members of the Minnehaha County Commission proposed that the City Council, the Minnehaha County Commission, and the Lincoln County Commission meet together as a group. Rolfing asked what topics would be discussed. Erpenbach has the same question and stated there is nothing on the table. Council Member Greg Jamison liked the idea of camaraderie and efforts to get together, but without an agenda, this type of meeting would not be productive. Council Member Kenny Anderson Jr. agreed and stated that all three groups have the opportunity to interact at the monthly Breakfast Club Meetings at the Washington Pavilion, along with the surrounding school districts, held on a monthly basis from September through May. Erpenbach directed Legislative/Operations Manager David to relay the Council's decision to Minnehaha County staff. Jamison stated he participated in a ride-along on a compliance check with the Police Department last week and had done the same thing last month. There was one underage sale in this compliance check and the officers handled the situation very professionally. Last week Councilors Rolfing and Dean Karsky met to talk about this issue with Jamison. They have some ideas that they will share with the rest of the Council at a later time. Council Member Jim Entenman asked if the business that sold to the minor had done everything it needed to do to set their team member up for success. Jamison stated this was the case and the business owners are doing a good job. Anderson Jr. asked what happens if a person goes into the store that is of age and purchases for someone underage. Discussion followed. 5. Presentations A. Great Bear Recreation Park Management Agreement by Dave Fischer, Assistant Director of Parks and Recreation; and Steve Sanford, President of Great Bear Recreation Inc. Fischer presented the details of the agreement. Steve Sanford, President of the Board of Directors of Great Bear Recreation Board Inc., gave a brief history of Great Bear. B. Management Agreement for Mary Jo Wegner Arboretum by Dave Fischer, Assistant Director of Parks and Recreation; and Chuck Gullickson, Arboretum Society Fischer presented this management agreement. Chuck Gullickson, Chair of the Board of Directors of the Wegner Arboretum Society, also addressed the Council. In addition, Lori Kiesow, Executive Director, was present as well as Judy Jasper, who gave a generous gift for the Judy and Mabel Jasper Education Center at the Arboretum. C. Shape Sioux Falls Update by Planning Staff Jeff Schmitt, Chief Planning and Zoning Official, gave an overview of Shape Places in preparation for the first reading on the Council Meeting this evening. Sam Trebilcock, Transportation Planner, assisted in the presentation. 6. Adjournment Erpenbach adjourned the meeting at 5:14 p.m. Lorie Hogstad, CMC City Clerk
