MINUTES Informational Meeting Tuesday, May 21, 2019 at 4:00 PM Carnegie Town Hall, 235 West 10th St., Sioux Falls, SD 57104 1. Call To Order Council Members Present: Janet Brekke, Christine M. Erickson, Greg Neitzert, Marshall Selberg, Curt Soehl, Pat Starr, Theresa Stehly Council Members Absent: Rick Kiley Council Chair Christine M. Erickson called the meeting to order at 4 p.m. 2. City Council Open Discussion Council Member Theresa Stehly praised neighborhood associations/neighborhood watches and mentioned an upcoming amendment to change a meeting date to allow the Council to attend some neighborhood watch events. 3. Presentations A. Partner Organizations - Sioux Falls Development Foundation, Bishop Dudley Hospitality House and Downtown Sioux Falls by Bob Mundt, President & CEO of the Sioux Falls Development Foundation; Chad Campbell, Executive Director of the Bishop Dudley Hospitality House; and Joe Batcheller, President of Downtown Sioux Falls Presentation: Approximately 30 minutes followed by discussion Dustin Powers, with Planning and Development Services, stated that the department has provided funding for several partner organizations over the years. This was an opportunity, prior to the budgeting cycle, to meet with some of them and have them explain how they use their City funds and how it benefits the community. Mundt spoke about the following during his presentation: the SFDF Mission Statement; the SFDF Vision Statement; the SFDF Strategic Circle; SFDF Strategic Priorites; Growing Property Tax Base & Quality Jobs; Foundation Park; Park VIII; Campus Crossing; Growing Property Tax Base & Quality Jobs; Marketing Efforts; Prospect Activity; Growing Property Tax Base & Quality Jobs; BR & E (Business Retention & Expansion) for Customes; To Date BR & E Activity; Development Connections; Growing Property Tax Base & Quality Jobs; Strategic Workforce Action Agenda; External Programming; Internal Programming; Business Partnerships; Win In Workforce Summit - Shared Focus; Coordinated & Consistant Marketing; and SIOUXFALLS.COM.  Discussion followed regarding: compliments to Mundt for his character; charging for the Workforce Summit; City funding; and long range strategic planning for cities. Campbell spoke about: the history of the Bishop Dudley House, their services, family programs, guest numbers, financials, success, and gratitude, during his presentation. Discussion followed regarding: mental health issues and the homeless; tough love; the annual sleep over; staff size; transitioning of guests; and lessons learned from the Bishop Dudley Hospitality House. Batcheller spoke about the following during his presentation: the organization's Core Belief; Mission; Programs; Outcomes; New Website; Co-op Adverstising; DTSF Gift Card Program; the $3.36 million in economic impact from DTSF events and added Shoulder Season Events;Economic Activity Dashboard; Pedestrian Counters; Secured Trolley Funding Through 2022; Paw-Pup Dog Park; Advocacy; unaudited revenue and expenses; 2019 Outlook; and Downtown Matters. Discussion followed regarding: the trolley; the potential future of downtown parking meters; and downtown events. B. Midco Franchise Agreement and Vast Broadband Open Video License by Jason Reisdorfer, Director of Innovation & Technology; and Mike Bradley, Bradley Law Presentation: Approximately 15 minutes followed by discussion Council Member Pat Starr stated that he had a potential conflict with this item and recused himself from the discussion and meeting. Reisdorfer spoke about the following, during his presentation: the contracts, Midcontinent Communications, Cable Franchise Renewal Agreement; and VAST Broadband, OVS (Open Video System) License Renewal Agreement; Currrent Contracts; Franchise Fee Definition; City Franchise Revenue (MIDCO); MIDCO Top 20 Cities Comparison (Sioux Falls is the lowest with a 2.5% franchise fee); Proposed Agreements; Proposed Breakdown; Potential Use of Revenues; Side-By- Side Comparison; and Midco Franchise Fee Scenarios. He then introduced Outside Counsel Michael R. Bradley, Bradley Law, LLC, out of the Twin Cities. Bradley spoke about the following: his background with cable service; a brief explanation and history of both cable systems and their agreements; and upcoming legislation. Discussion followed regarding: franchise fees and the rate increase for customers; KCPO TV station; sales tax remittance; notice to customers on rate increases; why other cities have higher franchise fees and what are they doing with the money: the future of cable; why a 10 year agreement; a future10 G City; franchise fee cap; community grant; rights given to cable companies and OVS companies in the right- of-way; contract for MIDCO swimming pool; what if the Council votes no to the franchise fee; how does the OVS impact the City channel; not being able to watch City meetings without cable; and the history on why Sioux Falls was low, regarding the franchise fee, in comparison to other Cities; and use of franchise fees for projects. 4.
