MINUTES Informational Meeting Tuesday, September 8, 2020 at 4:00 PM Carnegie Town Hall, 235 West 10th St., Sioux Falls, SD 57104 1. Call To Order Council Members Present: Janet Brekke (via Telecom), Christine M. Erickson, Alex Jensen, Rick Kiley, Greg Neitzert, Pat Starr (arr. 4:05 p.m.) Council Members Absent: Marshall Selberg, Curt Soehl 2. Committee/Commission Reports A. Operations Committee: Thursday, August 27, 2020 (Council Members: Soehl (Chair), Jensen, Neitzert, Selberg) Neitzert reviewed the following items that were discussed at the Operations Committee Meeting: the stipends for City of Sioux Falls logo wear for staff; Council Member Christine M. Erickson’s drafted ordinance for proposed changes to council committees; the discussion held on modifying procedures for items on the Consent Agenda to give the Administration notice on when items will be pulled for review and discussion; and the discussion to move the National Citizen Survey forward. B. South Eastern Council of Governments (SECOG): Wednesday, September 2, 2020 (Council Members Brekke and Starr) Starr spoke about the impact of the CARES act on other entities in the region. Starr provided a housing update including the demolishing of the Boys and Girls Club on the east side of town and other projects that are developing into affordable housing. SECOG does eight Governors Homes on an annual basis. Their 2021-2024 Transportation Improvement Plan was discussed and has received final approval. Starr stated they discussed the Census and the value of having the reporting complete and up to date. C. Metro Management Council: Thursday, September 3, 2020 (Council Members Erickson and Kiley) Council Member Rick Kiley stated the primary item on the agenda was the discussion and consent to the PSAP joint agreement between the City of Sioux Falls and Minnehaha County. Kiley reviewed the dollar amount contributions for both parties and lease agreement information. Kiley noted there was also an Executive Session held at this meeting. D. Siouxland Heritage Museum Board: Thursday, September 3, 2020 (Council Member Starr)  This meeting was rescheduled to Thursday, September 10, 2020. This update will be rescheduled to the Informational Meeting on Tuesday, September 15, 2020. 3. City Council Open Discussion There was none. 4. Presentations A. Update on City of Sioux Falls CARES Act Funding by Shawn Pritchett, Director of Finance Presentation: Approximately 10 minutes followed by discussion Pritchett reviewed the following items: CARES Act Overview encompassing the timeline for the CARES Act Stimulus Package and the breakdown for documentation review and reimbursements; CARES Act Guidance indicating the guidance issued by the Department of Treasury for the use of the funds; Eligible Expenses covering expenditures incurred between March 1 and December 30, 2020 and substantially dedicated to Public Safety, Public Health, and Other; Use of Funds – Guiding Principals showing what the funds should and should not be used for; Use of Funds – Debt Repayment listed by year showing Original Debt Service, Revised Debt Service, Savings, and Cumulative Savings. Discussion followed regarding: the use of the funds to offset the pandemic by stimulating the economy; spending on areas that have the most short term or long term impact; paying down debt and the impact on the economy; including the Council in decisions regarding the budget; where the funding goes after being received from the CARE Act; appropriated and distribution of the funds and the Council action required; prepayment penalties; bond rates; and transferring money between funds. B. Sioux Falls Floodplain Regulation Update Proposals by Albert Schmidt, Urban Planner Presentation: Approximately 30 minutes followed by discussion Schmidt reviewed the following proposed changes to the Floodplain ordinances. A formal ordinance will be presented to the Councilors after this initial review followed by input and review by other professionals associated with the changes. Information reviewed pertained to: Main Proposed Changes; Goals and Benefits of the Community Rating System (CRS); How Can CRS Help Sioux Falls Residents?; How much work is the CRS; Specific Sioux Falls Flood Ordinance Section Details and Examples; Update requirements for Flood Permits; Allowing the City to use the Newest Base Flood Elevation (BFE) Information; What Does Used Flood Capacity Look Like?; Retain Onsite Flood Storage Capacity; Current Floodplain at Risk to Fill; Update Substantial Improvement and Substantial Damage; Increase Permit Fee; Add a Subdivision Floodplain Development Permit Fee; Restricting Critical Facilities; Restricting Work Along Floodway; Allow Crawl Spaces; Allow for Wet Flood Proofing of Accessory and Agriculture Structures; and Next Steps.  Discussion followed regarding: the impact of those who have homes in the new flood plain area; flood storage capacity in new areas; the potential for higher costs associated with these changes; who will be impacted by the increased permit fee; the timeline for meeting with the Home Builder Association; the community rating; and the updates on FEMA modeling. C. Bump Back Ordinance by Rick Kiley, Council Member; and Curt Soehl, Council Member Presentation: Approximately 10 minutes followed by discussion Kiley spoke about the original bump back ordinance implementation in 2015. He explained what the term “bump back” means in reference to promotions within the unions. Kiley cited specific examples of police and fire leadership having difficulty getting comparable positions within the city and how this amendment would impact the promotion of existing personnel. Police Chief Matt Burns and Fire Chief Brad Goodroad spoke about the positive impact this amendment would have on their staffing challenges. Discussion followed regarding: Erickson spoke about how this amendment impacts unique positions within the city; Kiley provided an update on the timeline for the proposed ordinance with the first reading occurring on September 15, 2020, and the second reading occurring on October 6, 2020. 5.
