1. Call To Order
Committee Chair Christine M. Erickson called the meeting to order at 4:42 p.m.
2. Review and approval of minutes dated September 8, 2015
A motion was made by Kenny Anderson Jr. and seconded by Michelle Erpenbach to
approve the minutes.
Erickson called for a voice vote. All members voted yes.
Motion Passed.
3. Prohibition On Use Of Electronic Communication Device While Operating A
Motor Vehicle by Michelle Erpenbach, City Councilor
Council Member Michelle Erpenbach, representing the Central District, gave a
PowerPoint presentation regarding Safer Streets Ordinance - Wireless Communication
Device Restrictions. She spoke about: the role of elected officials; the Sioux Falls texting
ban; the approval of a State-wide texting ban; texting tickets; Rapid City's texting ban
and enforcement of it. Erpenbach spoke about possible additions for the current
ordinance, which included the topics of: Hands-Free Mode of Operation; Prohibition on
Use of Electronic Communication Device; and Exceptions on Use of Electronic
Communication Devices. A list of organizations, which have banned the use of cell
phones in employee vehicles, and individuals supporting the ban were noted.
Rich Lauer spoke in support of the ban. He mentioned statistical information, education
funding and mentioned a death due to distracted and driving.
Gary Conradi spoke in support of the proposal.
City Council Member Rick Kiley encouraged this issue be considered by the entire
Council.
Dick Sabers, retired State Supreme Court Justice, said the City of Sioux Falls is the
leader of almost everything, in the State. He added that the city should be the leader in
safety issues, too.
Dick Gregerson mentioned how his daughter and granddaughter were in a car accident
near his home. They believe the accident was due to someone texting and driving. He
stressed the importance of this issue.
Erpenbach opened the discussion for questions. Discussion followed. The ordinance was
moved out of committee, to the City Council, for a first reading on Monday, October 19,
2015, and a second reading on Tuesday, November 10, 2015.
4. Mobile Vending Ordinance by Adam Roach, Neighborhood Development
Coordinator
Adam Roach, Neighborhood Development Coordinator, provided an update on mobile
food vending. His last presentation on the issue was in May. He gave a PowerPoint
presentation, which included slides on: Purpose; Process; Definitions; Permits; Mobile
Vending Locations; Prohibited Conduct; Hours of Operation; Parking; Fire Safety; ADA
Access; Health; Litter Control; Liability and Insurance. Discussion followed.
A motion was made by Council Member Kenny Anderson Jr. and seconded by Council
Member Michelle Erpenbach to move the Mobile Vending ordinance to City Council.
Erickson said as a consensus they will move it forward for a first reading. Roach is to
work with staff to have it scheduled on a City Council Meeting.

There was none.
6. Adjournment
A motion was made by Kenny Anderson Jr. and seconded by Michelle Erpenbach to
adjourn.
