Final Minutes Zoning Board of Adjustment Carnegie Town Hall Wednesday, October 19th, 2016 6:00 p.m. Members Present Chairperson Kathryn Henning Aaron Norman Ryan Rients Robert Everett Michael Jones Staff Present Shawna Goldammer Bryan Wilcox The meeting was called to order at 6:00 pm APPROVAL OF MINUTES OF SEPTEMBER 19TH, 2016 MEETING A motion was made by Ryan Rients and seconded by Robert Everett to approve the minutes of September 19th, 2016. Chairperson Henning called for a voice vote. All members voted yes. Motion Passed. NEW BUSINESS Case BOA-005464-2016 Variance in (1) the required off-street parking requirement from 30 to 3 and (2) the required front yard setback from 25’ to 0’ along W. Blackhawk Street for parking. Applicant: John Engstler – Henningsen Const. Address: 1101 W. Blackhawk St. A motion was made by Aaron Norman and seconded by Ryan Rients to approve a variance in (1) the required off-street parking requirement from 30 to 3 and (2) the required front yard setback from 25’ to 0’ along W. Blackhawk Street for parking. During the board’s discussion, the board considered separating each variance request and voting individually on each request. Although both requests are tied to each other the board felt that voting on each request would not have any difference in their consideration. Further discussion by the board considered a condition on the variance requests and to amend the motion to approve the variance requests for this use & site plan  only and if the use would change then a new variance request would be required. The board agreed that this would be the best option for how to rule on the requests. A motion to amend was made by Robert Everett and seconded by Ryan Rients to approve with the condition for this use & site plan only. Vote on the amendment to include conditions: Roll Call: Yeses, Robert Everett, Aaron Norman, Ryan Rients, Michael Jones, Kathryn Henning, 5. Noes, 0. Motion Passed. Case BOA-005698-2016 Variance in the allowable size for an accessory structure (detached garage) from 456 sq. ft. to 896 sq. ft. Applicant: Suad Mujcin Address: 1014 N. Walts Ave. A motion was made by Ryan Rients and seconded by Michael Jones to approve a variance in the allowable size for an accessory structure (detached garage) from 456 sq. ft. to 896 sq. ft. Vote to approve: Roll Call: Yeses, 0. Noes, Robert Everett, Aaron Norman, Ryan Rients, Michael Jones, Kathryn Henning, 5. Motion Failed. Variance Denied. ADJOURNMENT A motion was made by Ryan Rients and seconded by Robert Everett to adjourn the meeting at 7:02 p.m. Chairperson Henning called for a voice vote. All members voted yes. Motion Passed.
