Village of South Blooming Grove Board of Trustees Regular Meeting Monday December 12, 2016 7:00 P.M.  Call to order o Mayor Robert Jeroloman called to order the Village Board Meeting at 7:00 pm on December 12, 2016 at the South Blooming Grove Village Hall located at 811 State Route 208, within the Village of South Blooming Grove, and having a mailing address of Monroe, New York.  Roll call The following persons were present: o Robert Jeroloman- Mayor o James Mullany - Trustee o John Hickey – Deputy Mayor o James LoFranco- Trustee o Joseph McKay, Esq. o Police Chief Carl Schupp Absent o Dorine Sas - Trustee  Trustee Comments o Deputy Mayor Hickey stated that what occurred the other night regarding the traffic incident on Sears Road was completely unacceptable. There should have been stricter enforcement at the scene, but given the circumstance there wasn’t. He thinks that in the future, if it’s necessary, to have that kind of event by whomever, then enforcement must be utilized (summonses). There were people parked on people’s property that had no right to be there, that is criminal trespass; there should have been arrests or summons issued; however, it evolved where cars kept coming and going. It restricted the passage of cars through the roadway and it should never have happened. stated that our new neighbors should assimilate and adhere to the rules and o It was referred to as an event however I don’t think it was scheduled or advertised so it wasn’t anticipated advertised or planned, people did not get invitations. He stated the board and/or the police department didn’t know anything about this event. o Trustee Mullany stated that to have an event between 9 and 12 midnight during winter months is ludicrous  Chief Schupp o His response that there should have been arrests “no one from his department has related to him that there has been any complaints (there is not complainant) he had meeting his morning. If there is no complainant to sign a complaint He spoke with Sgt. Today, but nothing was related to him after this  Village of South Blooming Grove Board of Trustees Regular Meeting Monday December 12, 2016 7:00 P.M. event of somebody complaining that there was damage on property. He feels there will be a lot of first that never happened before. His policy regarding parking was explained and he further advised that all people will be treated the same. o If there is no complainant, there is no complaint. He is going to review the reports of the weekend but has not had anything related to him any information regarding a complaint. He had a meeting this morning and he understands there will be a lot of “first’ events His goal is to control these events so the public is not impacted at all and it never happens again.  Adoption of Prior Meeting Minutes o Motion to adopt meeting minutes of November 28, 2016 by Trustee Mullany, seconded by Trustee LoFranco, 4 Ayes, 1 Absent. 11/28/2016 minutes adopted.  Public Comments o Erin McEvoy – people walking in the street she advised that she was witness to the incident on Sears Road. She called the police because she didn’t know what was going on. It was snowing and there was a constant stream of cars going by, vehicles were parking in houses occupied by people and parking at houses where people no longer live but still own them. The police told her that there was an “event” going on. She asked if there were any policies regarding the amount of people you can have at a household event? The Mayor advised that during this time of year there is no parking on the streets to allow for salt/plow trucks to get through. The Mayor and Chief Schupp and the Chief advised that there was parking on both sides of the street and it was difficult to get a vehicle through the street let alone a plow, they must get through in order keep the roads safe. Normally during an event a residence notifies the board and asks that the “no parking” be suspended and the village would create a resolution but will always include clause to cover snow event. Asked regarding the recent traffic incident on Sears Road, if an event is to take place in the future would it have to take place into the late evening. o Is there a limitation of the amount of people allowed at an event that needs a permit? – Chief advised Not that he is aware of o Eric Vogelsburg – suggested to the board and Chief Schupp to inquire about first time future events and determine how we can prepare. o Donna McGoldrick – Inquired as to why back-up (i.e. Sheriff or State Police) were not called to the recent event on Sears Road. She felt that parties involved were not complying and they were trying to provoke residents. Chief Schupp advised that his officer and his sergeant did not see a necessity for “back-up”. Were any vehicles issued summons or tickets, and the Chief advised no. o Theresa Campo – Suggested that in the future people should rent a place to host such an event. Trustee Hickey disagreed stating that other people host parties at their homes.  Village of South Blooming Grove Board of Trustees Regular Meeting Monday December 12, 2016 7:00 P.M. o Pete Piampiano – He was and is concerned that events causing traffic congestion make it difficult or impossible for emergency vehicles to pass. He suggested that emergency services should be notified of such events that will cause such traffic congestion. o Mayor Jeroloman explained how the village has issued block party permits wherein the street is temporarily closed off but always in a manner that would allow emergency vehicles access to the street. o Brian Bohan – stated that “we are dealing with a cult here” a cult that looks down on us. Additionally, he stated that next ATF agents are who you will be sitting with. o Pete Piampiano – advised that Quality school bus #777 fails to make a complete stop at Houston and Dallas. He advised that while driving down Dallas Drive around the turn he had to quickly brake as right on the turn there was Quality school bus #718 parked on Dallas at the intersection of Fort Worth Place. The bus proceeded to waive him on. He is concerned as this is a safety issue. o Vicky Codner – She is concerned with drivers failing to follow traffic laws. She observed a van driving directly through the stop sign at Pine Hill Road across Dallas Drive right into a residential driveway. She observed on Merriewold Lane South dump trucks traveling at 45 mph, a Quality Bus traveling at 50 mph and 2 vans (one after the other) traveling at 48 mph. Trustee Hickey agreed that speeding is unacceptable and a solution to the speeding on Merriewold Lane South has not yet been reached. oDonna McGoldrick – Yesterday morning she made a right hand turn from Dallas onto Pine Hill Road, where she had to stop behind a Quality school bus which remained stopped at a residence with its safety “stop” lights on and proceeded to beep the horn waiting for the children to come to the bus for approximately 9 minutes. While she was waiting additional cars pulled behind her vehicle wherein they were impeding traffic at the intersection of Pine Hill and Dallas.  Correspondence o None  Mayor Comments o The Mayor explained that recently on Sears Road there was an incident wherein numerous vehicles were on the road and the police were called and the plow/sand trucks were unable to get through. o Advised that he will review whether utilizing the calling system or providing a written notification/flyer to notify of events would meet the standards.  Trustee Comments o None  Village of South Blooming Grove Board of Trustees Regular Meeting Monday December 12, 2016 7:00 P.M.  Abstract o Motion to accept the abstract by Deputy Mayor Hickey, seconded by Trustee LoFranco. 5 Ayes - Abstract Accepted.  Business o Resolution No. ( ) – Authorizing the Village Treasurer to refund an application fee. Motion to accept by Trustee LoFranco, seconded by Trustee Sas. Resolution passed. 5 Ayes – Mayor Jeroloman, Deputy Mayor Hickey, Trustee Mullany, Trustee Sas and Trustee LoFranco. o Resolution No. ( ) – Setting a time and place for a public hearing regarding the adoption of rents and rates for the Village’s Water District on December 12, 2016 at 7:01 pm. Motion to accept by Trustee Sas, seconded by Trustee LoFranco Resolution passed. 5 Ayes – Mayor Jeroloman, Deputy Mayor Hickey, Trustee Mullany, Trustee Sas and Trustee LoFranco. o Resolution No. ( ) – Setting a time and place for a public hearing regarding the adoption of rents and rates for the Village’s Sewer District on December 12, 2016 at 7:02 pm. Motion to accept by Trustee Mullany, seconded by Trustee Sas. Resolution passed. 5 Ayes – Mayor Jeroloman, Deputy Mayor Hickey, Trustee Mullany, Trustee Sas and Trustee LoFranco. o Resolution No. ( ) – Authorizing the Mayor to execute a developers agreement for the Sleep Inn/Gagliardi Hotel Project. Motion to accept by Trustee Mullany, seconded by Trustee Sas. Resolution passed. 5 Ayes – Mayor Jeroloman, Deputy Mayor Hickey, Trustee Mullany, Trustee Sas and Trustee LoFranco. oResolution No. ( ) – Adopting an amended schedule of fees and costs. Motion to accept by Deputy Mayor Hickey, seconded by Trustee Sas. Resolution passed. 5 Ayes – Mayor Jeroloman, Deputy Mayor Hickey, Trustee Mullany Trustee Sas and Trustee LoFranco.  Closed Session o Motion to enter into a closed session to discuss contractual matters and litigation by Deputy Mayor Hickey, seconded by Trustee Sas at 7:33 pm. 5 Ayes. o Motion to exit closed session by Trustee Sas, seconded by Trustee LoFranco at 9:20 pm. 5 Ayes.  Adjournment o Motion to close the meeting by Trustee Sas, seconded by Trustee LoFranco at 9:21 pm. 5 Ayes.
