Village of South Blooming Grove Regular meeting Monday January 14, 2019 7:00 P.M.  Call to order o Mayor LoFranco called to order the Village Board Meeting at 7:04 p.m. on January 14, 2019, at the South Blooming Grove Village Hall located at 811 State Route 208, within the Village of South Blooming Grove, and having a mailing address of Monroe, New York.  Roll call The following persons were present: o James LoFranco- Mayor o John L. Ross – Deputy Mayor o Sue Anne Vogelsberg – Trustee o James Mullany – Trustee o Johnny Belfort – Trustee o Joseph McKay, Esq. – Village Attorney o Police Chief – Carl Schupp  Mayor and Trustee Com o Mayor LoFranco introduced newly appointed Trustee Johnny Belfort and informed that Deputy Mayor Ross and Trustee Belfort will be running for re-election in March. o Mayor LoFranco advised about water main break that took place over the weekend at 61 Duelk Avenue. The Village worked along with the Town of Blooming Grove to repair the break in a timely manner. o Two reports of unprompted solicitation have been reported. The police were notified and the solicitor was informed of the local law. o Mayor LoFranco reviewed 2018 statistics: 119 building permits 9 stop work orders 178 incident reports 54 building violations 270 violation notices for property maintenance 10 violation notices required action by the village  Correspondence: o Department of Transportation letter regarding “No Parking” signs along Route 208, received January 7, 2019.  Public Comments o John Hickey, Merriewold Lane South – inquired about a home that is being renovated at the top of Merriewold Lane South. Currently there is a stop work order on said property. The mayor will confer with counsel regarding any future actions. 1  Village of South Blooming Grove Regular meeting Monday January 14, 2019 7:00 P.M. o John Salka, Clove Road – Mr. Salka advised as Fire Chief of the Village of South Blooming Grove that the structure mentioned above at Merriewold Lane South is unsafe. Mayor LoFranco asked Mr. Salka to submit a letter with his recommendations and upon submission it will be reviewed with the village engineer. o Sarah Gutman, 347 Lake Shore Drive – Appreciates the new shuttle bus and says it is a positive development for the Jewish community that resides in the Village of South Blooming Grove. Expressed disappointment that there are not more stops and additional bus runs. Requested that the village permit more stops. Mayor LoFranco advised that the permit is for 90 days and will be reviewed. o Bonnie Rum, 54 Shore Drive – Ms. Rum expressed concerns about running a full size public city bus in the Village of South Blooming Grove. Mayor LoFranco advised that the bus is a private enterprise, it is not a full size city bus, and the bus is not run by the village. o Donna McGoldrick, 44 Dallas Drive – Asked why a meeting was held on Wednesday, December 26; stated that in the past eleven to twelve years Village Board meetings have never been held on any other day than a Monday. Mayor LoFranco informed that the meeting schedule has been public information since a year ago. Board of Trustees 2018 Meeting Schedule was adopted December 11, 2017, was posted in the Times Herald Record January and July of 2018, and noticed on the billboard located outside of Village Hall since adopted in December 2017. Ms. McGoldrick asked why there have been many water main breaks recently. Mayor LoFranco offered that during the winter, water main breaks are a common occurrence. Expressed dissatisfaction with quality of water. Mayor LoFranco explained that the village is in the process of addressing water concerns by applying for grants to upgrade the infrastructure as well as the purchase of a new filtration system. Ms. McGoldrick voiced her concern that an additional bus poses a safety issue to residents. In Ms. McGoldrick’s opinion, additional stops would further cause more safety problems. o Barbara Hanley, 364 Lake Shore Drive – Asked if there is system in place to assure that the bus is following requirements set forth on the permit. Mayor LoFranco advised the resolution that was passed includes the conditions that the bus company must follow. o Theresa Campo, 52 Fort Worth Place – Expressed concern about bus drivers following traffic laws. Trustee Vogelsberg offered that residents should document when violations occur. Police Chief Schupp offered that residents should call the police department regarding traffic violations. Ms. Campo asked about the fence at the corner of Fort Worth and Dallas Drive that is a visual impairment. The building department will be contacted regarding this fence. o June Caleca, 19 Dallas Drive – Expressed concern about speeding drivers on Dallas Drive and Duelk Avenue. Trustee Mullany offered that residents should contact BGPD regarding moving violations. o Guy Jones, Blooming Hill Farm – Offered that the speed limit has been changed to 45 miles per hour and asked for Blooming Grove Police to reinforce the lower speed limit. Mr. Jones asked if the construction on Route 208 has been completed, portions of the road are icy. The Highway Department will be contacted. Mr. Jones asked about property located at 1233 Route 208. The sloped driveway washes out onto the Route 208 during storms. Per Mr. Jones there has been activity at this location with many large trucks that appear to be taking a toll on the roadway. Further expressed concern about a health problem that may arise if there is not adequate septic for large amount of occupants in the home. The building inspector will be contacted to investigate if adequate septic system is installed. 2  Village of South Blooming Grove Regular meeting Monday January 14, 2019 7:00 P.M. o Lucille Kelly, 13 Merriewold Lane South – Mentioned speeding issue on Merriewold Lane South that needs to be addressed. Chief Schupp offered the police department to increase presence in the area. Ms. Kelly asked about bright lighting at Shannon Lane and Merriewold Lane South. The code to be reviewed regarding lighting. o Debbie Bragado, 3 Houston Avenue – Mentioned a sheet of ice that is forming from water runoff, asked for salt or sand. Highway department will be contacted. o Kevin Radday, PO Box 250, Blooming Grove –“Very disturbed by Ms. Vogelsberg’s comment to me as she sat down, she said it’s good to see people from other parts of town. Because I’m a former resident of South Blooming Grove. I moved about ten years ago or so into the Town of Blooming Grove. I’m also on the Chamber Board and the Vice President of the Kiwanis Club and I attend every Town meeting and most Village Board meetings and I was insulted that Ms. Vogelsberg insinuated that because I do not live in Village that I don’t care about this community.” o Resident from 23 Pine Hill Avenue– Advised there is an icy patch on Pine Hill Road, requested the area can be salted. Highway Department will be notified. o Dov Posen, 16 Pennsylvania Avenue – Requested additional stops for the Blooming Grove Shuttle Bus. Thanked the Village Board for the opportunity to have a shuttle bus in the Village. o Goldy Weiss, 33 Virginia Avenue – Asked if the Shuttle Bus schedule could be adjusted to include more stops and additional times. o John Salka, Clove Road – Asked for clarification on the picture taking request, why are photos needed for documentation for a violation? Can violations be reported without photos? Mayor LoFranco responded that photos make a stronger point but are not required. Village Attorney McKay explained there is and never has been any requirement of photographs in order to file a complaint. Mr. Salka expressed dissatisfaction regarding the shuttle bus hours, asked for more availability on scheduled days off. Mr. Salka requests information be gathered and analyzed by the Village regarding the necessity of the shuttle bus. o Donna McGoldrick, 44 Dallas Drive – Expressed there is a need for a bus all days of the week. o John Hickey, Merriewold Lane South – Explained the Shuttle Bus is not the first private entity to come before the board. The Village Board established the safety issues of running a shuttle bus.  Business o Resolution No. (001) – Resolution of the Village Board of the Village of South Blooming Grove establishing the polling location and hours of voting for village elections on March 19, 2019. Motion to accept by Trustee Vogelsberg, seconded by Trustee Mullany. Resolution passed. 5 Ayes Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Mullany, Member Belfort. o Resolution No. (002) – Resolution of the Village Board of the Village of South Blooming Grove amending its fee schedule. Motion to accept by Trustee Mullany, seconded by Deputy Mayor Ross. Resolution passed. 4 Ayes Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Mullany. 1 Absent, Trustee Belfort. 3  Village of South Blooming Grove Regular meeting Monday January 14, 2019 7:00 P.M. o Resolution No. (003) – Resolution of the Village Board of the Village of South Blooming Grove setting and time and place for a public hearing to determine violations of the Village Code’s property maintenance provisions (Chapter 102). Motion to accept by Trustee Mullany, seconded by Trustee Vogelsberg. Resolution passed. 5 Ayes Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Mullany, Trustee Belfort.  Abstract o Motion to adopt the Abstract by Deputy Mayor Ross, seconded by Trustee Vogelsberg, 5 Ayes, Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Mullany, Trustee Belfort.  Trustee Comments o Deputy Mayor Ross asked residents to not stir the pot of ignorance. Please get the correct information. o Trustee Mullany asked for residents to take safety precautions when out during evening hours. o Mayor LoFranco explained that a lot of work took place in 2018. o Trustee Vogelsberg explained that the Village will have to address water issues in the future.
