Village of South Blooming Grove Regular meeting Monday February 11, 2019 7:00 P.M.  Call to order o Mayor LoFranco called to order the Village Board Meeting at 7:06 p.m. on February 11, 2019, at the South Blooming Grove Village Hall located at 811 State Route 208, within the Village of South Blooming Grove, and having a mailing address of Monroe, New York.  Roll call The following persons were present: o James LoFranco- Mayor o John L. Ross – Deputy Mayor o Sue Anne Vogelsberg – Trustee o James Mullany – Trustee o Johnny Belfort – Trustee o Joseph McKay, Esq. – Counsel  Mayor Comments o Mayor LoFranco read a statement regarding litigation pertaining to violations of a transportation permit. o Mayor LoFranco informed the public that the Village will enter into appropriate litigation to address the situation located at 1233 Route 208. o Mayor LoFranco advised that the owners of the property located at the corner Merriewold Lane South and Virginia Avenue has been served a notice of violation and the matter will be followed up in court. o The Mayor offered that the public will continue to be briefed regarding pending litigation matters. o Mayor LoFranco thanked the South Blooming Grove Fire Department for their quick professional response to multiple emergency calls over the weekend. o Proposals regarding the upgrades to the Merriewold Lake House are currently being obtained.  Correspondence: o None  Public Comments o Wanda Rudzinski, Sears Road – Thanked the Village Board and staff for their hard work. o Brian Mullen, 33 Duelk Avenue – Asked how the Village addresses repeat property maintenance offenders. To date there have been no violations issued to repeat offenders. o John Hickey, Merriewold Lane South – Mr. Hickey read a statement about rumors adding strife and discord within the village. Asked if all residents can bridge the divide between neighbors. o Debbie Bragado, Houston Avenue – Inquired about brown water, Mayor LoFranco advised a water main break was found over the weekend that effected the Duelk Avenue, Houston Road, and Fort Worth Place. 1  Village of South Blooming Grove Regular meeting Monday February 11, 2019 7:00 P.M. o Donna McGoldrick, 44 Dallas – Asked about the fence located at the corner of Dallas and Fort Worth. Mayor LoFranco offered that the violation to date has not been corrected and will be addressed in court February 13. o Bonnie Rum, 64 Shore Drive – Mentioned that she understands that people make a lifestyle choice to not drive. She further asked why non drivers would move to an area with no alternate means of transportation. Expressed opinion that realtors should be required to advise prospective buyers that public transportation is not available within the area. o Steve Kearins, Dallas Drive – Inquired if it is legal for the Village Board meetings to be recorded by nonprofessional personnel. Mr. McKay explained that recording of public meetings is permitted per state law. Mr. Kearins further asked about the bus running within the Village. It was confirmed that the bus is currently running and is in litigation. o Pete Piampiano, Houston Avenue – Advised that it is the property owners responsibility to keep mailboxes cleared of snow and ice. The US Postal Service has guidelines stating that fifteen feet in each direction should be cleared for postal carriers. o Gerry Gagliardi, 15 Bailie Lane – Explained that when DPW pulls out on to Route 208 the trucks leave large amounts of salt in the road that eventually washes into the wells. Expressed concern about the salt reaching the aquifers and inquired if the state can investigate. o Rabbi Yoel Loeb, 4 San Marcos Drive – Will work to understand the laws regarding property maintenance. Offered that the bus company could consider finding a non-Jewish partner who would be able to run the bus service during Sabbath. o Marie Noel, 1 Midland Court – Asked about bulk pickup and violation notices. Mayor LoFranco advised residents to contact the Town of Blooming Grove regarding garbage disposal and bulk pickups. o Isaac Ekstein, 40 Virginia Avenue – Inquired about getting a sewer plant in the Village. Attorney McKay offered that a proposal of this type would be addressed by the county as it would require agreements with multiple municipalities. o Ivette Crespo, 338 Lake Shore Drive – Inquired if a “Welcome Wagon” program can be established and include information regarding property maintenance laws. Mayor LoFranco offered the idea will be considered. o Peter Castellano, 17 Merriewold Lane South – Explained that motorists continue to speed on Merriewold Lane South. The Police Department should be contacted regarding traffic violations. o John Daly, Clove Road – Inquired about the status of the test wells at Lake Ann. Mayor LoFranco offered there has been no new information. Mr. Daly asked how the test wells are monitored, have they been capped for safety? Mayor LoFranco will contact special counsel regarding this issue. o Mr. Feldman, 382 Lake Shore Drive – Expressed opinions about public transportation. o Kathy Cairins, 2 Tappan Drive – Offered support of Welcome Wagon packet being offered in multiple languages. o Kevin Radday, Washingtonville – Mr. Radday offered that Preserve Blooming Grove has received a positive response regarding recording of meetings.  Trustee Comments o Trustee Mullany explained that it may be advantageous for Rabbi Loeb to contact the Village to become familiar with the village code and pass the information on to new residents. 2  Village of South Blooming Grove Regular meeting Monday February 11, 2019 7:00 P.M. o Trustee Vogelsberg offered information about the Moffat Library Book Sale on March 3, 2019 o Trustee Vogelsberg provided information regarding the grant application for water improvements. o Deputy Mayor Ross offered his opinion that tonight’s meeting provided some good dialog and applauded all for attending. o Mayor LoFranco reminded residents about an incoming storm and offered that roads should be cleared for the snowplows.  Abstract o Motion to adopt the Abstract by Trustee Vogelsberg, seconded by Trustee Mullany, 5 Ayes, Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Mullany, Trustee Belfort.  Business o Resolution No. (011) – Resolution of the Village Board of the Village of South Blooming Grove authorizing the Mayor to execute a municipal cooperation agreement. Motion to accept by Deputy Mayor Ross, seconded by Trustee Mullany. Resolution passed. 5 Ayes Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Mullany, Member Belfort. o Resolution No. (012) – Resolution of the Village Board of the Village of South Blooming Grove regarding retention of legal counsel. Motion to accept by Trustee Mullany, seconded by Deputy Mayor Ross. Resolution passed. 5 Ayes Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Mullany, Member Belfort. o Resolution No. (013) – Resolution of the Village Board of the Village of South Blooming Grove authorizing the Mayor to execute an agreement with Bower Web Solutions, Inc. Motion to accept by Trustee Mullany, seconded by Trustee Vogelsberg. Resolution passed. 5 Ayes Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Mullany, Trustee Belfort. o Resolution No. (014) – Resolution of the Village Board of the Village of South Blooming Grove authorizing “Junk Remove All” to perform property maintenance to abate violations of the Village Code’s property maintenance provisions (Chapter 102) for the property located at the following address: 7 Dallas Drive. Motion to accept by Trustee Mullany, seconded by Trustee Vogelsberg. Motion to accept by Trustee Mullany, seconded by Trustee Vogelsberg. Motion to accept by Trustee Mullany, seconded by Trustee Vogelsberg. Resolution passed. 5 Ayes Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Mullany, Trustee Belfort. o Resolution No. (017) – Resolution of the Village Board of the Village of South Blooming Grove to set a time and place for a public hearing regarding the adoption of Local Law # 1 of 2019 to establish a moratorium prohibiting the permitting, construction and installation of stationary storage battery systems within the village. Motion to accept by Deputy Mayor Ross, Seconded by Trustee Vogelsberg.
