Village of South Blooming Grove Regular meeting Monday April 22, 2019 7:00 P.M. ➢ Call to order o Mayor LoFranco called to order the Village Board Meeting at 7:06 p.m. on April 22, 2019, at the South Blooming Grove Village Hall located at 811 State Route 208, within the Village of South Blooming Grove, and having a mailing address of Monroe, New York. ➢ Roll call The following persons were present: o James LoFranco- Mayor o John L. Ross – Deputy Mayor o Sue Anne Vogelsberg – Trustee o Johnny Belfort – Trustee o Joseph McKay, Esq. – Counsel Absent: o James Mullany – Trustee ➢ Comments o Mayor LoFranco thanked all who attended the Village Clean-Up day on April 20 regardless of the poor weather conditions. o Mayor LoFranco advised all residents that the Village of South Blooming Grove is entering into Stage II Water Restrictions effective immediately. o Mayor LoFranco offered information regarding the application for grants to improve the water system within the Village of South Blooming Grove. The mayor further offered details regarding various litigations. o The property located at 37 Dallas Drive has been issued violations and if in non-compliance after May 1, will go to court. ➢ Correspondence: o None. ➢ Public Comments o John Hickey, 16 Merriewold Lane South – Offered information about the water petition that is available at Village Hall. o Joseph Rosenfeld, 9 Houston Avenue – Asked about Freon removal process. Mayor LoFranco advised Mr. Rosenfeld to contact a plumber, the freezer will need to be tagged that Freon has been removed in order for the freezer to be picked up by waste services. o Joe Favia, 17 Mangin Road – Offered that the property at 39 Merriewold does not have a building permit displayed. Asked about tree that is hanging into the road, Mayor LoFranco advised the condition is being reviewed and the board will determine if action is required. Mr. Favia asked about consideration to be given to lower the village speed limit. o Donna McGoldrick, 44 Dallas Drive – Inquired about garbage at 39 Fort Worth Place, asked how far in from the curb is the homeowner responsible. Attorney McKay offered the property owner is 1 Village of South Blooming Grove Regular meeting Monday April 22, 2019 7:00 P.M. responsible up to the curb. Asked when the village will have the streets cleaned; Mayor LoFranco advised that the contract for the street sweeper is included in an Inter-municipal Agreement and South Blooming Grove will be scheduled to have the roads swept by the Town of Blooming Grove. Inquired if court cases are open to the public, the mayor advised that all court cases are open to the public. o Inga Pappas, Tanager Road – Asked about a portable basketball hoop on Merriewold North. A violation notice has been issued. o Shirley Mende, San Marcos Drive – Inquired about garbage violations. Ms. Mende requested if a notice could be sent to all residents regarding garbage disposal and recycling procedures. o Bonnie Rum, 64 Shore Drive – Offered information regarding the recycling of glass. Glass is not to be included in recycling containers. o Rumiguisz Jakubowski, 78 Duelk – Construction done at 5 Dallas Drive has disturbed her property as 78 Duelk Avenue. Condition to be investigated. ➢ Business o Resolution No. (053) – Resolution of the Village Board of the Village of South Blooming Grove granting an annual soliciting certificate to Robert Radice pursuant to Village Code Chapter 75. Motion to accept by Deputy Mayor Ross, seconded by Trustee Vogelsberg. Resolution passed. 4 Ayes, Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Belfort, 1 Absent, Trustee Mullany. o Resolution No. (054) – Resolution of the Village Board of the Village of South Blooming Grove granting a temporary soliciting certificate to Cynthia Overton pursuant to Village Code Chapter 75. Motion to accept by Trustee Vogelsberg, seconded by Deputy Mayor Ross. Resolution passed. 4 Ayes, Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Belfort, 1 Absent, Trustee Mullany. o Resolution No. (055) – Resolution of the Village Board of the Village of South Blooming Grove setting a time and place for a public hearing to determine violations of the Village’s Code Property Maintenance Provisions (Chapter 102). Motion to accept by Deputy Mayor Ross, seconded by Trustee Vogelsberg. Resolution passed. 4 Ayes, Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Belfort, 1 Absent, Trustee Mullany. ➢ Discussion o Mayor LoFranco explained that the Village of South Blooming Grove received a revised Draft DEIS on April 3, 2019 for the Clovewood Project. Upon review, the Village Board determined not to accept the resubmitted draft DEIS, but reserves the potential to do so at a later date if payment of the undisputed village Professionals Fees is paid by the Project Sponsors and adequate measures are being taken to provide for future payment of undisputed Village Professional fees for review of the resubmitted draft DEIS. 2 Village of South Blooming Grove Regular meeting Monday April 22, 2019 7:00 P.M. ➢ Business o Resolution No. (056) – Resolution of the Village Board of the Village of South Blooming Grove regarding Clovewood Project. Motion to accept by Trustee Vogelsberg, seconded by Deputy Mayor Ross. Resolution passed. 4 Ayes, Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Belfort, 1 Absent, Trustee Mullany. o Resolution No. (057) – Resolution of the Village Board of the Village of South Blooming Grove authorizing “Junk Remove All” to perform property maintenance to abate violations of the Village Code’s Property Maintenance Provisions (Chapter 102) for the property located at 92 Duelk Avenue. Motion to accept by Deputy Mayor Ross, seconded by Trustee Vogelsberg. Resolution passed. 4 Ayes, Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Belfort, 1 Absent, Trustee Mullany. ➢ Trustee Comments o Deputy Mayor Ross mentioned that Little League is in full swing and offered residents to come and watch a game. o Trustee Vogelsberg thanked the volunteers for their help on Earth Day Clean Up. o Trustee Belfort reminded residents to be mindful of their property and to clean up garbage. ➢ Abstract o Motion to adopt the Abstract by Deputy Mayor Ross, seconded by Trustee Vogelsberg, 4 Ayes, Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Belfort, 1 Absent, Trustee Mullany. ➢ Adjournment o Motion to enter into attorney client session at 7:37 p.m. by Trustee Vogelsberg, seconded by Deputy Mayor Ross. 4 Ayes, Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Belfort, 1 Absent, Trustee Mullany. o Motion to exit attorney client session at 8:36 p.m. by Trustee Vogelsberg, seconded by Trustee Belfort. 4 Ayes, Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Belfort, 1 Absent, Trustee Mullany. o Motion to close the meeting at 8:38 p.m. by Deputy Mayor Ross, seconded by Trustee Vogelsberg. 4 Ayes, Mayor LoFranco, Deputy Mayor Ross, Trustee Vogelsberg, Trustee Belfort, 1 Absent, Trustee Mullany.
