Village of South Blooming Grove Regular meeting Monday May 13, 2019 7:00 P.M. ➢ Call to order o Mayor LoFranco called to order the Village Board Meeting at 7:00 p.m. on May 13, 2019, at the South Blooming Grove Village Hall located at 811 State Route 208, within the Village of South Blooming Grove, and having a mailing address of Monroe, New York. ➢ Roll call The following persons were present: o James LoFranco- Mayor o Sue Anne Vogelsberg – Trustee o Johnny Belfort – Trustee o James Mullany – Trustee o Joseph McKay, Esq. – Counsel Absent: o John L. Ross – Deputy Mayor ➢ Comments o Mayor LoFranco provided an update on pending cases presently in litigation. o Mayor LoFranco advised all residents about an interim measure to improve water quality that will include an implementation of a sequestering agent that has been submitted to the Orange County Department of Health for approval. ➢ Correspondence: o Letter received April 24, 2019 from Lanc & Tully on behalf of Metro Assets application to enter into the Village Water and Sewer system. o Vendor Peddler Application received May 8, 2019 from Exit Realty ➢ Public Comments o David Krause, 305 Lake Shore Drive – Expressed concern about speeding in the Village. New signage is being installed and proposal being made to lower the village speed limit. o John Hickey, 16 Merriewold Lane South – Offered information regarding speed bumps or strips being installed within the Village. Insurance carriers to be contacted. Mr. Hickey reminded residents to sign the petition that is at Village hall regarding drinking water conditions. o Norm Cairns, 2 Tappan – Requested electric speed detectors to be installed. o Donna McGoldrick, 44 Dallas Drive – Inquired about speed limit signs that are being removed. Mentioned home with overflowing garbage pails on Fort Worth Place o Samantha Rappa-Giovagnoli, 2 Red Bird Drive – Offered suggestions for residents to contact state authorities regarding drinking water conditions. Ms.Rappa-Giovagnoli will provide contact information to residents and will drop copies of the contacts at Village Hall. o Edie Johnson, 153 Round Hill Road – Offered information about a new federal grant. o Bonnie Rum, 64 Shore Drive – Inquired about broken water meters. Mayor LoFranco explained the process regarding water meter repairs. Asked if indoor pools are filled with municipal water, Mayor 1  Village of South Blooming Grove Regular meeting Monday May 13, 2019 7:00 P.M. LoFranco explained that no pools, indoor or outdoor, are to be filled while on water restrictions. Offered information regarding RC-1 code definition. o Shirley Mendi, 8 San Marcos – Reported about emergency vehicles speeding in the development. Speeding is a police matter and Mayor LoFranco offered reporting the issue to the police department. Reported about a large tree that is blocking a speed limit sign o John Salka, Clove Road – Inquired about broken meters and high water usage, Mayor LoFranco explained the meter repair process and billing process for high water usage. Inquired if there is fire code violation regarding large amounts of garbage. Consideration given to review with code enforcement. Mr. Salka asked about rumble strips, Mayor LoFranco offered rumble strips have been ordered for various locations within the village. Mr. Salka inquired about the removal of trees on private property. Attorney McKay offered information about permit requirements for clearcutting. Mr. Salka asked about having meetings recorded by the Village and placed on YouTube. Mayor LoFranco explained that there are state regulations that would need to be researched. Mr. Salka inquired about complaints and violations that have been filed in the Village. The F.O.I.L. request is still being worked on and the answer is forthcoming. Mayor LoFranco asked Mr. Salka to visit Village Hall to review the issue. o Kelly Parzer, 2 Laredo – Asked about garbage pickup that took place several weeks ago in the middle of the night. Mayor LoFranco explained the pickup was organized and paid for by a private group and was not scheduled by the Village. The mayor explained that the police were informed. o Debbie Bragado, 4 Houston Avenue – Offered details about large trucks driving down Houston Avenue in the middle of the night, Trustee Mullany explained the residents should call police. ➢ Business o Resolution No. (058) – Resolution of the Village Board of the Village of South Blooming Grove authorizing the Mayor to execute an agreement with Alpha Geoscience. Motion to accept by Trustee Mullany, seconded by Trustee Vogelsberg. Resolution passed. 4 Ayes, Mayor LoFranco, Trustee Mullany, Trustee Vogelsberg, Trustee Belfort, 1 Absent, Trustee Mullany. o Resolution No. (059) – Resolution of the Village Board of the Village of South Blooming Grove adopting a Local Law establishing a four (4) month moratorium prohibiting the permitting, construction, and installation of any and all stationary storage battery systems in the Village of South Blooming Grove. Motion to accept by Trustee Vogelsberg, seconded by Trustee Mullany. Resolution passed. 4 Ayes, Mayor LoFranco, Trustee Mullany, Trustee Vogelsberg, Trustee Belfort, 1 Absent, Deputy Mayor Ross. o Resolution No. (060) – Resolution of the Village Board of the Village of South Blooming Grove requiring all building permit applications and accompanying documents to be reviewed by Village’s Engineer (McGoey, Hauser and Edsall, DPC). Motion to accept by Trustee Vogelsberg, seconded by Trustee Mullany. Resolution passed. 4 Ayes, Mayor LoFranco, Trustee Mullany, Trustee Vogelsberg, Trustee Belfort, 1 Absent, Deputy Mayor Ross. 2  Village of South Blooming Grove Regular meeting Monday May 13, 2019 7:00 P.M. o Resolution No. (061) – Resolution of the Village Board of the Village of South Blooming Grove setting a time and place for a public hearing to determine violations of the Village’s Code Property Maintenance Provisions (Chapter 102). Motion to accept by Trustee Vogelsberg, seconded by Trustee Mullany. Resolution passed. 4 Ayes, Mayor LoFranco, Trustee Mullany, Trustee Vogelsberg, Trustee Belfort, 1 Absent, Deputy Mayor Ross. ➢ Discussion o 1032-Route 208—Petition seeking zone change from RR to RC-01 District. Mayor LoFranco explained what the petition entails. The petition is under review by Special Counsel, the Village Planner and Village Engineer. ➢ Trustee Comments o Trustee Mullany offered information regarding the Moodna Creek and kiosk at Merriewold Lake. Mentioned a local Boy Scout is looking to make additional improvements for his Eagle Scout project. o Trustee Vogelsberg provided details about upcoming School Board Elections meet the candidates at Round Hill Elementary that will be held on May 21. o Trustee Belfort explained the police should be called if private driveways are blocked.
