Spearfish City Council Regular Session Minutes June 5, 2017 The Spearfish City Council met at 5:30 PM on Monday June 5, 2017. Mayor Boke presided and called the meeting to order. All stood and recited the pledge of allegiance. Roll Call was taken with the following members present: Clark, Hodgs, Jacobs, Klarenbeek, Lee and Schmit, Also present: Assistant Finance Officer DeNeui, City Planner Watson, City Attorney Davis, Public Works Administrator Johnson, Assistant Police Chief Jacobs, Fire Chief Sachara, Parks and Rec Director Mader, Human Resource Director Friedel, Wastewater Treatment Facility Superintendent Evridge and Legal Intern Hoffman. Order of Business – Order of business was amended to add a Human Resources item, add a special event to Consent Agenda, remove one malt beverage license from the renewal list and to move WalGreens Malt Beverage License to a separate item outside of Consent. Klarenbeek moved, Hodgs seconded and all voted to approve the Order of Business as amended. Schmit declared a conflict-of-interest regarding the annual approval of the 2017-2018 Malt Beverage License for his employer and will abstain from vote. Klarenbeek declared a conflict-of-interest with the SEDC item and will abstain from vote. License – Lee moved, Hodgs seconded to approve the 2017-2018 Malt Beverage License for Walgreens. Schmit abstained and the motion passed with all voting approval. Consent Agenda – Clark moved, Jacobs seconded and all voted to approve the Consent Agenda as follows: A. Appoint and authorize Fire Chief Mark Sachara to sign any documents related to the South Dakota Department of Agriculture Wildland Fire Division Cooperative Fire Suppression Agreement. B. Move Kevin Gose from a Limited Hour employee to a regular employee. C. Add Sean Mets, Robert Veiga, John Bohlinger, John Riley and Christy Harwood to the 2017 Fire Department Volunteer List and add Renee Ashworth for the Fire Department auxiliary. D. Add Myriam Nielder to the 2017 Recreation and Aquatics Center Volunteer List. E. Move John Walk to a grade 12, step 2, $16.23 per hour effective 6/4/2017. Approve Minutes of City Council Regular Session dated May 15, 2017. HUMAN RESOURCES Position – Lee moved, Klarenbeek seconded and all voted approval of the Recreation and Youth Development Coordinator position description and authorization to advertise to for this position. Added Item – Human Resources Director Friedel provided update on the interview process for City Administrator. Candidates are being selected for in-person interviews. Of note, next week’s committee meetings will begin at 3:45 rather than 4:15 to make room for Special Sessions on Tuesday-Friday to accommodate the interview process. Appropriate agendas and notifications will be posted in advance. HEARINGS License – Mayor Boke opened a public hearing at 5:38 PM to consider an application from Josh Fritz with Crow Peak Brewing for a special malt beverage license for the Gold Rush Gravel Grinder on June 10, 2017 from noon to 5:00 p.m. at the City Park Bandshell. There were no oral or written comments and the public hearing was closed at 5:38 PM. Hodgs moved, Jacobs seconded and all voted to approve the special license. PUBLIC WORKS Phase 2 – Lee moved, Clark seconded and all voted to award the Old Town Sanitary Sewer Trunk Line Project-Phase 2 to Rapid Construction at a total cost of $187,003.82. Rapid Construction has agreed to honor its established unit prices from the Old Town Sanitary Sewer Trunk Line Project-Phase 1. Project consists of extending the City's 21" trunk line 986 lineal feet from East 8th Alley & Hudson Street to State & Federal Street. FINANCE SEDC Request - SEDC submitted a request for additional $35,000 in operational funding support from 218-Spearfish Economic Revolving Fund. 2017 Budget included funding of $30,000 and that amount will be paid June 5th Bill List. Fund balance available in the 218 fund is $1,733,000. Lee moved, Jacobs seconded and all voted to approve the request with Klarenbeek abstaining from vote. Proposal – Lee moved, Klarenbeek seconded and all voted to accept the proposals from Time Clock Plus and Incode to have all city staff utilize the Time Clock Plus program for time sheets and scheduling and for the two programs to interface with each other to process payroll. Total cost is $11,388, funded from 201-Second Penny Sales Tax. PLANNING AND ZONING Revision – Lee moved, Hodgs seconded and all voted to approve a revision to the concept plan for a DRD zoned parcel at the northwest corner of Highway 85 and Yukon Place and approve final plan pertaining only to site access. City Planner Watson also provided an update regarding public comment from Paul Thomson and Greg Dias/Historic Preservation. Parkside Village – Representatives from Dakota Land Trust discussed the concept of Parkside Village – an affordable housing proposal on 5th Street between Grant and Federal. Schmit moved, Klarenbeek seconded and all voted to direct staff to prepare a report to City Council that outlines the decisions needed, tasks to be completed, and parties responsible. City Planner Watson stated some of these key Council decisions will be prepared for the next regular session. Dedication – Schmit moved, Klarenbeek seconded and all voted to approve the Dedication Agreement for Colorado Loop - new street and utilities serving the Elkhorn Ridge travel center at Exit 17. Encroachment – Jacobs moved, Clark seconded and all voted to approve an Encroachment Agreement to allow a parking space for the Newman Center to be located in the King Street Right of Way. Watson stated this $75.00 annual encroachment license fee is for one handicapped parking space.
